DEED OF MUTUAL GRANT OF PERPETUAL RIGHT OF WAY

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Mutual Grant of Perpetual Right of Way is made and entered into by and
between:

CORPORATION, a corporation duly organized and existing in accordance with


laws of the Republic of the Philippines, with business and office address at
Bacolod City, Negros Occidental and herein represented by RAYMUNDO G,
Corporate Secretary and hereinafter referred to as the “First Party”;

and

CORPORATION, a corporation organized and existing under and by virtue of


the Laws of the Republic of the Philippines, with business address at Salcedo
Village, Makati City and branch office address at Rizal Street, Barangay V, Silay
City, Negros Occidental., represented by its President, ENRIQUE hereinafter
referred to as the “Second Party”.

WITNESSETH:

WHEREAS, the FIRST PARTY is registered owner of certain parcel of land with an area
of TWO THOUSAND SIX HUNDRED FIVE SQUARE METERS (2,605 sqm) more or
less, situated at Barangay Rizal, Silay City covered by TCT No. T-407, that intends to
donate as a right of way and a certain portion Lot 314-A-1-C-9-A-9-B-1-B covered by
TCT No. T-42 to be used as drainage right of way in consideration for an ongoing
subdivision development on the adjacent property.

WHEREAS, the SECOND PARTY is owner and developer of Subdivision situated at


Barangay Rizal covered by TCT No. T-37 adjacent to the subject property.

WHEREAS, it is mutually beneficial for both parties that a perpetual right of way be
established over a portion of each other's property for access and egress purposes;

NOW THEREFORE, in consideration of the property development being done by the


SECOND PARTY and to widen the available space for ingress and egress to and from
the properties being develop as subdivisions, FIRST PARTY hereby binds himself and
agrees to allow CSA RESOURCES CORPORATION to use and develop that portion of
the property belonging to the FIRST PARTY alongside TCT No. 37855 with a width of
10 meters as the right of way for ingress and egress and for the construction of
drainage systems along that path and with a length commencing from main road up to
the outfall on portion of Lot 314-A-1-C-9-A- covered by TCT No. T-44

For clarity, a sketch on the plan showing the extent of the drainage right-of-way on the
respective road lots is attached as Annex “A” and forms an integral part of this
Agreement

This DEED shall immediately take effect upon date of signing hereof. Each of the
parties shall have the right and the other hereby authorize to annotate this agreement
on the respective titles.

IN WITNESS WHEREOF, both the FIRST PARTY & SECOND PARTY have there under
