mandates I am pleased that the Supreme Court, by a 6-3 vote, held that the federal Occupat
ional Safety & Health Administration lacked constitutional authority under its “workplace
safety” regulations to impose a vaccine mandate that would have affected more than 80 mill
ion employees across the country. As the Supreme Court majority opinion stated, “Although
Congress has indisputably given OSHA the power to regulate occupational dangers, it has no
t given that agency the power to regulate public health more broadly.” I can appreciate th
e distinction the Supreme Court made between the OSHA mandate for workers generally and th
e CMS mandates for medical workers, but I continue to have serious concerns about the effe
ct the ruling will have on retaining health care workers, many of whom may elect to simply
quit rather than get the vaccine, seriously exacerbating staffing issues, especially in o
ur rural medical facilities. As I have emphasized from the beginning, the lawsuits were no
t about whether people should get vaccinated, they were about opposing federal overreach.

Thank you, again, for making the trip to Minot with Perrie last night. I think it was a great opportunity for
communication and bridge-building. Per our conversation last night, we would love to see Attorney General
Stenjehem come out with an advisory opinion and position statement specific to vaccine mandates. Many North
Dakotans are facing the impossible decision to keep their job or to make a medical decision they don't want to
make, and I think a strong, clarifying statement from our Attorney General would be very helpful. I am

the following statement in response to the conclusion of its December State Committee Meeting:
"I want to thank the hardworking members of the NDGOP State Committee who took the time before the

I ran for public office because of my love for North Dakota. And my love of our
state has only grown during that time.
When you walk into the front of my office in the Capitol you will see a composite
photograph of all the people who have served North Dakota as Attorney
General since statehood. After my photo there are seven blank spaces. Those
spots are reserved for the people who will come after me. I know that whoever
is fortunate enough to have his or her photo included after mine will inherit a
talented, dedicated group of employees who come to work every day with the
goal of keeping North Dakota the very best place.
My current term runs through the end of 2022, and we still have lots of time to
continue the important work we have in the year ahead.
I wish you all the best of the Christmas Season, and look forward to continuing
our important work in 2022!

This e-mail and my response invited a conversation that still needs to take place.
The last few election cycles have demonstrated that our country is in an ideological war. The two coasts
represent different values than middle America.
Rather than working together with our elected officials to defend those middle America values, we are under
attack. Why would that be?
One of the attachments to this e-mail offers several points for further conversation that might provide insight. I
recognize and respect that there may be a diversity of opinions on these points.
The other attachment is a copy and paste of all the nay votes on agency budgets taken from the daily journals.
The final page of that attachment lists all who voted nay on more than 10 of the 49 budgets. This is not a few
bills cherry picked to advance an agenda. These are all the budget bills. Some people on this list have different
reasons for voting nay than others. Some are very engaged in the budget conversations. Others vote no without
conversation.
Abdication of the responsibility we have to fund state government may be a Libertarian position, but is certainly
not a conservative position.

I have hesitated to send this e-mail for several months because of the respect that I have for the Institution you
and I have the privilege to serve, the people with whom we serve, and the Republic we love. Ultimately, we
have a responsibility to defend all three. It is in that spirit that I offer these comments.

Thank you for this conciliatory e-mail. I have to say that I have no problem with your Bastiats holding a
different perspective than the rest of us. I have a serious problem with you advancing your agenda at everyone
else's expense.
I am a Republican and I am a conservative. I know what that means. Being conservative is not about voting no.
Being conservative is about voting yes on the right priorities. Voting no on all the budget bills might be fiscally
conservative, but only in one sense. It is a complete abdication of the responsibility that we have to fund
government. Without even a conversation on the budget, you make yourselves irrelevant to the budget process.
Calling yourselves conservative and everyone else a RINO, only adds to the cynicism that exists against the
Legislature.
I have struggled with how to initiate a conversation on these matters. I would like to take your e-mail as an
invitation to a smaller discussion. I would be happy to visit with you and others in your caucus of your

choosing. The conversation should include leadership in both chambers and others of their choosing.
I think I would bring perspective that you may not have considered previously. I considered a public discussion,
but that would result in no winners. Someone close to me said, "Dad, you agree with them 90% of the time."
That is true. We should be able to work around the other 10%.
There is one point that needs to be a part of this larger discussion. The Senate Majority Leader has had his
reputation dragged through the mud. Eight Republicans put their name on the bill that came later to be known as
a Red Flag bill. On the surface it appeared to address a serious issue. There was due process in the bill. It was
vulnerable only in the sense that it was subject to abuse, just as domestic violence orders are subject to abuse.
You and your caucus never offered any other solutions and, in fact, opposed all the Behavioral Health initiatives
passed in the session.
It seems to me that your caucus has tried to use the Red Flag bill to lead the public to believe that the Second
Amendment is under threat by this Legislative body and that your caucus stands in the way of any compromise
of it. Reconciliation of your caucus with other Republicans demands that you reconsider that position.
The Senate Majority leader is the hardest working and largest contributing member to the Legislative process.

I have previously written social media posts about the so-called division in our party. My analogy has been that
we are like a family. There will always be family squabbling. There may be a crazy uncle, a weird cousin, and a
stubborn grandma, but they are still family.
We all want to do our job as legislators the best we can. For me, the best thing for both our state, and for our
party has been to fight fervently for less spending, less taxing, and less regulation. I'm fully aware that in that
fight, I have rubbed some of you the wrong way, and of course, that is true conversely as well. Nevertheless, I
have no regrets, and will continue to fight for what I think is best.
Here's the rub; when times are good, and there aren't external threats to us, it's ok to focus on intra-caucus
conflicts (family squabbling) to do what we think is best. In fact, it's probably necessary to chum out the best
product. But when times are less good, or if there are external threats, we must do what families and
communities do: we must unite to fend off a common threat.
One is our counterpart, the Democrat party, seems to be complicit with a far-left movement that is pushing
untenable policies. They aim to transform or crush American history, American morale, and American culture
and society. Although it seems far away from North Dakota, I believe we will need to be united to ensure they
do not succeed in even getting a foot in the door.
lfBiden wins, we will need to be united against his (their) inevitable hits on the economy.
If Trump wins (which I believe he will), there will likely be chaos. We will need to be united to deal with such
chaos without succumbing to actions which restrict liberty.
Another threat is from our executive branch (I know I may lose a few of you here). We have been accustomed to
spending $10,000-$30,000 for a legislative campaign (with a few $100,000+ outliers). GovernorBurgum has
come in with his millions to change the course of Republican primaries to fit his vision. In my opinion this is a
gross overstep. I believe what he did in getting rid of long-time legislator and Appropriations Chairman Rep.
Delzer is unforgiveable.
He really does believe he is the CEO of ND, and we are low-level management that must to do what he wants. I
won't belabor the point, but we need to be united against GovernorBurgum in rolling over us, for whatever is on
his pet project list.

February sessions in the Courtroom. Courtroom access will be limited to

The Occupational Safety and Health Administration issued the vaccine-or-test mandate on Nov. 5. It
requires all employers with more than 100 employees to mandate that those employees be either fully
vaccinated against COVID-19 or be tested weekly and wear masks at work. Several challenges to the
rule were filed around the country, by (among others) business groups, religious groups, and Republican
led states, arguing that the mandate exceeds OSHA's authority. The U.S. Court of Appeals for the 5th
Circuit temporarily put the mandate on hold in November, but the challenges were consolidated in the
U.S. Court of Appeals for the 6th Circuit, which reinstated the mandate last week.
The challengers went quickly to the Supreme Court, filing over a dozen separate requests asking the
justices to block the 6th Circuit's ruling. The justices on Wednesday night set two of those requests
for oral argument - one filed by a group of trade associations and the other by a group of states, led
by Ohio - on a highly expedited basis. The 6th Circuit's ruling reviving the mandate will remain in force
until the Supreme Court acts on the challengers' request, although OSHA has indicated that it will not
issue citations for failure to comply with the rule until Jan. 10 at the earliest.
The Biden administration also came to the court last week, asking the justices to allow it to temporarily
enforce a rule issued by the Department of Health and Human Services that requires all health care
workers at facilities that participate in the Medicare and Medicaid programs to be fully vaccinated against
COVID-19 unless they are eligible for a medical or religious exemption. Lower-court rulings blocked the
administration from enforcing the vaccine mandate in approximately half of the states. The justices will
hear argument on whether those rulings should remain in place.
Shortly after receiving the emergency requests last week, the court set a deadline of Dec. 30 for
responses in both disputes. The decision on Wednesday to hear oral argument on the emergency
requests came as somewhat of a surprise: It seemed more likely that the court would dispose of the
requests with a brief order, as it normally does on the so-called "shadow docket." Instead, and perhaps in
response to criticism of the increased use of the shadow docket to litigate major policy disputes, the
justices fast-tracked the cases for oral argument, as they have already done twice this year when fielding
requests for emergency relief in the battle over Texas' controversial abortion law and a
request by a Texas inmate to have his pastor touch him and pray out loud during his execution.

Racing commission will be open to issuing a multi-jurisdictional license to them Such a license
could come with stipulations that our platform not be available to North Dakota residents -
although at some point in the longer term we would love to explore making our platform
available to North Dakota residents as well.

Attached is a letter from Attorney General Marshall to Congress in opposition to the Forced Arbitration Injustice
Repeal (FAIR) Act. The Act would amend federal law to prohibit any contract from requiring pre-dispute
arbitration or precluding class-action litigation with regard to employment, consumer, antitrust, and civil rights
disputes. The letter takes no position on whether or not this is good policy; rather, it argues that this decision
should be left to the states. Notably, all 50 states have laws regulating arbitration.
The position taken in this letter has historically received bipartisan support in the AG community, as evidenced
by the briefs referenced therein.

I want you to know how very much I appreciate your willingness to help our American Legion Loyd Spetz Post #1 with any
questions about charitable gambling. It appears as of now the gaming people, book keepers, accountants, and gaming committee
members are in agreement as to what they have to do to properly account for all gaming activity, revenues, and expenses.
The only one who does not fully understand/appreciate what gaming is all about at the level of our Post #1 is me as Finance
Officer. But I know if something comes up, I will at least try to seek out your direction.
For me as being a former Attorney General when gaming really got started in 1981, I find it is much different being at the level
where gaming is being operated than it was for me as AG when I could rely on experts like you to keep me out of trouble.
Thus, for now, I will stop bothering you. Thank you so very much.

I remember one of the 1 st calls I got when you took office. Sandy Tabor, your 1 st
Assistant AG, called and asked me about conflicts of interest, her concern being
obvious given the boards and commissions on which they AG is a voting member. I
remember saying to her, "Of course there is a conflict of interest." But I told her that's
O.K. since the law and constitution placing the AG in all these positions act as a waiver.
In fact, the law requires the AG to act and vote on these boards and commissions.
I have not wanted to make any comment while you are in office. However, I think
maybe the time is right to take the AG off of these boards and commissions. T his would
leave the AG in a hands-off position to give legal advice without any appearance of a
conflict of interest. I bet the legislature would be interested, as would your fellow state
officials who would love to take a seat in place of the AG.
As you wrap up your term know this. I think, I know, you have done a simply
outstanding job as Attorney General! My words to you are the highest words of praise a
Naval officer can bestow;

Bakken Energy addressed all of these issues either in its response letter to the CCCA (attached) or in the hearing last week.
1. Bakken Energy proposes to use 175 million cubic feet of natural gas per day to produce hydrogen. How will the
product be transported to market? Is Bakken proposing to construct an ammonia pipeline? Where would it go and
what is the timeline/likelihood for permitting? If not a pipeline, how will that volume of product be transported?
a. Hydrogen - we stated during the CSEA hearing that we are in conversation with multiple long-haul trucking
companies interested in taking our hydrogen "at the plant gate." This means we expect these long-haul
trucking companies will build the hydrogen transportation system to us.
b. Ammonia - the distribution for ammonia already exists. We don't need to do anything to reach the ammonia
markets other than rely on what is already being done.
2. Basin Electric said it has been losing money at the synfuels plant due to low natural gas prices. But prices have
increased significantly in recent months. Is the plant once again profitable producing syngas from coal? If the plant
is profitable in the next three years of operation, how does it affect the plan to produce hydrogen?
a. As Basin Electric stated during the hearing, they have made the decision to sell this plant to the Bakken
Energy/Mitsubishi partnership in the next 15 months. They have suffered losses the last three years. Bakken
Energy stated its modeling expects losses through 2026. If natural gas prices are high, perhaps some
money will be made, but the variability in this market is not sustainable over the long term. In short, the plans
to convert the plant to hydrogen will not change because of the natural gas markets.
3. Federal grant guidelines generally require local support for a project, but Bakken Energy has not met with the CCCA
membership to answer their questions. Why hasn't that meeting occurred?
a. We told the CCCA when they called us to request a meeting that we have plans for an all employee meeting
at DGC that we have not been able to execute on. We reiterated that in the attached letter. We will meet
with 3 rd party groups after we have met with the employees to lay out specific plans.
4. It appears this project is heavily dependent on federal grants and loans from DOE. Will the parties, Bakken Energy
and Mitsubishi (which is a $5.2 trillion company), proceed with the project if it fails to receive federal support?
a. We stated during the CSEA hearing that while we are pursuing federal loan guarantees and grants, our
project is NOT dependent on securing these funds.
5. If the project depends on federal support that may or may not be received, is it premature for the State of North
Dakota to make a financial commitment at this time? Should the decision of the Industrial Commission be
postponed until there is more certainty about project funding?

Western Dakota Energy Association. The CCCA represents cities, counties and school districts in the three coal-producing
counties. Its members are concerned about the pending proposal of Bakken Energy and Mitsubishi to convert the Great
Plains Synfuels plant to produce blue hydrogen from natural gas. Attached is a letter you previously received stating some
of those concerns.
CCCA members suspect that because the project received the early endorsement of Governor Burgum, important
questions have not been addressed and the project has not been thoroughly vetted. Earlier this week, the application of
Bakken Energy for a grant and loan to support the project was endorsed by the Clean Sustainable Energy Authority, and
will be coming before the Industrial Commission next week. After listening to the orchestrated presentation of Bakken
Energy, and the ensuing discussion with the CSEA board, our coal county members still have many unanswered
questions. Please consider these as you ponder a decision at next week's Industrial Commission meeting:

Statement of Attorney General Wayne Stenehjem in response to today's Supreme Court decisions on
vaccine mandates
I am pleased that the Supreme Court, by a 6-3 vote, held that the federal Occupational Safety & Health
Administration lacked constitutional authority under its "workplace safety" regulations to impose a vaccine
mandate that would have affected more than 80 million employees across the country.
As the Supreme Court majority opinion stated, "Although Congress has indisputably given OSHA the power to
regulate occupational dangers, it has not given that agency the power to regulate public health more broadly."
I can appreciate the distinction the Supreme Court made between the OSHA mandate for workers generally and
the CMS mandates for medical workers, but I continue to have serious concerns about the effect the ruling will
have on retaining health care workers, many of whom may elect to simply quit rather than get the vaccine,
seriously exacerbating staffing issues, especially in our rural medical facilities.
As I have emphasized from the beginning, the lawsuits were not about whether people should get vaccinated,
they were about opposing federal overreach.
Two other lawsuits continue, one against the federal mandate for federal contractors, and the other for
employees, volunteers, and children with Head Start programs.

As a result of recent changes made during the last legislative session requiring hospitals to
utilize the ambulance service district the state deems closest and most appropriate, the
Mountrail County Medical Center (MCMC) will utilize the services of the Stanley Ambulance
Service for inter-facility transfers when appropriate as determined by the transferring and
receiving Providers, beginning August 1.
For inter facility transfers, MCMC will continue to use Mountrail County Dispatch, per
policy, to summon the Stanley Ambulance Service when appropriate as determined by the
transferring and receiving Providers. With respect to the needs of the patient, the following
should be understood:
a. If the ground ambulance crew does not contact MCMC within 5 minutes of
requesting a transfer through dispatch, this will be deemed a refusal of
transport by said ambulance and cause to request alternate means of
appropriate transfer.
b. All inter-facility transfers from MCMC are considered emergent transfers unless
explicitly outlined by the referring Provider. Any delay of report to the bedside,
attempt by ground ambulance crew member to delay transfer to a later
time/date or otherwise condition acceptance of transport will be deemed a
refusal of transport.
c. All inter-facility transfers from MCMC are considered ALS transfers unless
explicitly outlined by the referring Provider. Any attempt by a ground
ambulance crew member to modify the requested level of care will be deemed
a refusal of transport.
d. The patient sex, age, medical condition, expected care/interventions, and
destination may be provided to the ambulance over the phone. All other
information will be provided at a bedside report. Equivocal responses will be
treated as a refusal of transport.
MCMC has a 9.atient care first approach to medical care. As an additional request in the
interest of patient care and spirit of teamwork, MCMC is requesting that SAS personnel
communicate to MCMC via state radio, or the recorded EMS line at (701) 628-0367 - upon
dispatch for a 911 call, as well as at the earliest possible time after patient contact to
appraise MCMC staff of potential in-bound patients. MCMC certainly understands that
patient care comes first, but we would like to strive for in-bound report greater than 5
minutes prior to arrival.

T hey are licensed as an Advance Deposit Wagering platform and have a multi-jurisdictional hub license issued by the
Oregon Racing Commission. North Dakota also issues multi-jurisdictional licenses for ADW platforms. They are hoping
the North Dakota Racing commission will be open to issuing a multi-jurisdictional license to them Such a license could
come with stipulations that our platform not be available to North Dakota residents - although at some point in the longer
term we would love to explore making our platform available to North Dakota residents as well.
Mike and team are coming to Bismarck over the next few weeks, hoping you will meet with your in-law cousin once
removed (I have no idea what I am talking about!).

Snippet December 17, 2021 My dear North Dakotans: For the last 21 years it has been my honor to wo
rk with the dedicated people in the office of Attorney General on behalf of the citizens o
f North Dakota. I have had to make many difficult decisions in that time, but never one as
difficult as this one. After visiting with Beth and others, I have decided that this term
will be my last and I will not seek a 7th term in 2022. The decision has been a hard one
because I have truly enjoyed my time in this office, and that is in large part because I h
ave worked with some of the most dedicated and loyal employees anyone could ask for. The c
itizens of North Dakota have seen fit to elect me to this important office six times and i
t has been an honor beyond measure. I hope North Dakotans will respect my work, my steadfa
st support of the US and State Constitutions, the rule of law, and efforts to keep North D
akota the best and safest place to live and work. The end of my current term will mark 22
years as North Dakota’s 29th Attorney General, the longest for an Attorney General in the
state’s history, in fact, as long as my three predecessors added together. In addition to
that, of course, are the 24 years I spent as a member of the North Dakota House and Senate
. I ran for public office because of my love for North Dakota. And my love of our state ha
s only grown during that time. When you walk into the front of my office in the Capitol yo
u will see a composite photograph of all the people who have served North Dakota as Attorn
ey General since statehood. After my photo there are seven blank spaces. Those spots are r
eserved for the people who will come after me. I know that whoever is fortunate enough to

The Court will hear all oral arguments scheduled for the January and
February sessions in the Courtroom. Courtroom access will be limited to
the Justices, essential Court personnel, counsel in the scheduled cases, and
journalists with full-time press credentials issued by the Supreme Court.
Out of concern for the health and safety of the public and Supreme Court
employees, the Courtroom sessions will not be open to the public. The
Court will continue to closely monitor public health guidance in
determining plans.
The Court will provide a live audio feed of the January and February oral
arguments. A link to the live audio feed will be available on the homepage
of the Court's website.
The Court building remains open for official business only and closed to
the public until further notice.

Bakken Energy addressed all of these issues either in its response letter to the CCCA (attached) or in the hearing last week.
1. Bakken Energy proposes to use 175 million cubic feet of natural gas per day to produce hydrogen. How will the
product be transported to market? Is Bakken proposing to construct an ammonia pipeline? Where would it go and
what is the timeline/likelihood for permitting? If not a pipeline, how will that volume of product be transported?
a. Hydrogen - we stated during the CSEA hearing that we are in conversation with multiple long-haul trucking
companies interested in taking our hydrogen "at the plant gate." This means we expect these long-haul
trucking companies will build the hydrogen transportation system to us.
b. Ammonia - the distribution for ammonia already exists. We don't need to do anything to reach the ammonia
markets other than rely on what is already being done.
2. Basin Electric said it has been losing money at the synfuels plant due to low natural gas prices. But prices have
increased significantly in recent months. Is the plant once again profitable producing syngas from coal? If the plant
is profitable in the next three years of operation, how does it affect the plan to produce hydrogen?
a. As Basin Electric stated during the hearing, they have made the decision to sell this plant to the Bakken
Energy/Mitsubishi partnership in the next 15 months. They have suffered losses the last three years. Bakken
Energy stated its modeling expects losses through 2026. If natural gas prices are high, perhaps some
money will be made, but the variability in this market is not sustainable over the long term. In short, the plans
to convert the plant to hydrogen will not change because of the natural gas markets.
3. Federal grant guidelines generally require local support for a project, but Bakken Energy has not met with the CCCA
membership to answer their questions. Why hasn't that meeting occurred?
a. We told the CCCA when they called us to request a meeting that we have plans for an all employee meeting
at DGC that we have not been able to execute on. We reiterated that in the attached letter. We will meet
with 3 rd party groups after we have met with the employees to lay out specific plans.
4. It appears this project is heavily dependent on federal grants and loans from DOE. Will the parties, Bakken Energy
and Mitsubishi (which is a $5.2 trillion company), proceed with the project if it fails to receive federal support?
a. We stated during the CSEA hearing that while we are pursuing federal loan guarantees and grants, our
project is NOT dependent on securing these funds.
5. If the project depends on federal support that may or may not be received, is it premature for the State of North
Dakota to make a financial commitment at this time? Should the decision of the Industrial Commission be
postponed until there is more certainty about project funding?

Sorry this is a long email, but please read it in its entirety. The Coal Conversion Counties Association is a subset of the
Western Dakota Energy Association. The CCCA represents cities, counties and school districts in the three coal-producing
counties. Its members are concerned about the pending proposal of Bakken Energy and Mitsubishi to convert the Great
Plains Synfuels plant to produce blue hydrogen from natural gas. Attached is a letter you previously received stating some
of those concerns.
CCCA members suspect that because the project received the early endorsement of Governor Burgum, important
questions have not been addressed and the project has not been thoroughly vetted. Earlier this week, the application of
Bakken Energy for a grant and loan to support the project was endorsed by the Clean Sustainable Energy Authority, and
will be coming before the Industrial Commission next week. After listening to the orchestrated presentation of Bakken
Energy, and the ensuing discussion with the CSEA board, our coal county members still have many unanswered
questions. Please consider these as you ponder a decision at next week's Industrial Commission meeting:
