AN APPLICATION TO THE RECOVERY OFFICER TO WAIVE OF
THE RECOVERY AMOUNT.
From: - I, P. Kishnan, with the registered office located at Co. 2, 509,
B Wing, 5th floor, Mayuresh Trade Center, Plot no. 4, Sector-19, Vashi, Navi Mumbai-400705, hereby make the following request.
1. I wish to address the demand notice served by your department
for the recovery of Rs. 5,42,184/- pertaining to non-payment of ESIC contribution for the period spanning from 10/05/2015 to 10/12/2018. Additionally, an interest of Rs. 3,20,238/- has been levied on the aforementioned amount due to non-payment until 26/06/2022.
2. I declare that I was unaware of the rules and regulations of the
ESIC department. Following the instructions given to me, I obtained an ESIC number and registered twenty employees, although in reality, my company only had eight employees working at the time.
3. I request the waiver of the recovery amount imposed on me by
your department. The circumstances leading to the imposition of this recovery amount were beyond my control, and I respectfully seek your understanding and leniency in this matter.
4. I affirm that I am not highly qualified in matters related to
government regulations and accounting. Therefore, I have been relying on the guidance and assistance of my consultant to handle all my governmental and accounting requirements.
5. I assert that during the period from 2015 to 2018, my company
employed only 8 individuals. None of my employees have raised any complaints regarding nonpayment of ESIC contributions. It was never my intention to evade or neglect ESIC payments; rather, I was unaware of the requirement to pay ESIC contributions. This responsibility rested with my consultant, whose duty was to keep me informed about such matters. Unfortunately, he failed to fulfill this obligation.
6. I emphasize that I am a senior citizen, and my company is
currently experiencing financial losses. I have shut down the company, and for the past five years, there has been no activity. Additionally, there are currently no employees working with me. Given these circumstances, I respectfully request that my plea be taken into consideration. I seek a waiver of the recovery amount and the interest accrued on the same. Furthermore, I do not have any income source or any property that can help me in paying the outstanding amount. 7. I say that granting the waiver of the recovery amount will greatly alleviate the financial burden on me and my company. It will also enable me to focus on resolving any outstanding issues and ensuring full compliance with all applicable regulations.
8. I request a hearing to be conducted at your office, providing me
with an opportunity to present my case and explain my points in detail. I believe that this hearing will enable you to make a well- informed decision after hearing my defense.
