Under the instructions and on behalf of my

client i.e. Punjab National Bank, branch Mokhra
Distt Rohtak through its Manager, I do hereby
serve you with the following legal notice:-

1.That you was in need of money and hence you

requested my client i.e. Punjab National Bank,
branch Mokhra Distt. Rohtak for grant of loan of
Rs. 90,000/- and you agreed the terms and
conditions as per the requirement of my client.
2.That my client agreed to pay and on 16.10.2013 my
client bank sanctioned the term loan of Rs.
90,000/- vide loan account no. JG-61313 alongwith
interest @ 11.25% p.a. and if you failed to pay the
loan amount, my client is entitled to recover the
entire loan at any time without assigning any
reason.
3.That you in order to discharge legal enforceable
liability to pay the outstanding amount towards
pending loan amount issued cheque bearing no.
640861 dt 2.3.2019, Account no. _________________
drawn on Punjab National Bank, branch Mokhra
Distt. Rohtak of Rs. 83,303/- in favour of my
client with an assurance that the aforesaid cheque
will be honored as and when it will be presented
for collection.
4.That accordingly my client presented the said
cheque with his banker ‘s PNB, Branch Mokhra
Distt. Rohtak to credit the same in its Account.
The banker of complainant forwarded the said cheque
for collection but the banker of accused returned
the said cheque remarking in the returned memo
dated 02.03.2019 remarking therein “Funds
Insufficient” and intimation to this effect was
received to my client by his banker.
5.That you have issued the said cheque to the my
client knowingly, intentionally and malafidely that
said cheque would not be honoured on its
presentation for encashment and to cheat my client,
thus accused has committed the offence punishable
under section 138 of Negotiable Instrument Act read
with sec. 420 IPC.
Now through this legal notice, you are,
therefore, called upon to pay the sum of Rs.
83,303/- to my client within a period of 15 days
from the date of receipt of this notice, failing
which my client shall be constrained to initiate
legal proceedings against you in the competent
court of law and you shall be liable to pay all the
expenses incurred therein including the fee of this
notice

3.That you in order to discharge legal enforceable
liability to pay the outstanding amount towards
pending loan amount issued cheque bearing no.

drawn on Punjab National Bank, branch Mokhra
Distt. Rohtak of Rs. 43122/- in favour of my
client with an assurance that the aforesaid cheque
will be honored as and when it will be presented
for collection.
4.That accordingly my client presented the said
cheque with his banker‘s PNB, Branch Mokhra Distt.
Rohtak to credit the same in its Account. The
banker of complainant forwarded the said cheque for
collection but the banker of accused returned the
said cheque remarking in the returned memo dated
07.03.2019 remarking therein “Funds Insufficient”
 and intimation to this effect was received to my
client by his banker.
5.That you have issued the said cheque to the my
client knowingly, intentionally and malafidely that
said cheque would not be honoured on its
presentation for encashment and to cheat my client,
thus accused has committed the offence punishable
under section 138 of Negotiable Instrument Act read
with sec. 420 IPC.
Now through this legal notice, you are,
therefore, called upon to pay the sum of Rs.
43122/- to my client within a period of 15 days
from the date of receipt of this notice, failing
which my client shall be constrained to initiate
legal proceedings against you in the competent
court of law and you shall be liable to pay all the
expenses incurred therein including the fee of this
notice

cheque with his banker ‘s PNB, Branch Mokhra
Distt. Rohtak to credit the same in its Account.
The banker of complainant forwarded the said cheque
for collection but the banker of accused returned

dated 07.03.2019 remarking therein “Funds
 Insufficient” and intimation to this effect was
received to my client by his banker.
5.That you have issued the said cheque to the my

thus accused has committed the offence punishable

an assurance that the aforesaid cheque will be
honored as and when it will be presented for
collection.
4.That accordingly my client presented the said
cheque with his banker ‘s PNB, Branch Mokhra
Distt. Rohtak to credit the same in its Account.
The banker of complainant forwarded the said cheque
for collection but the banker of accused returned
the said cheque remarking in the returned memo
dated 02.03.2019 remarking therein “Funds
Insufficient” and intimation to this effect was
received to my client by his banker.
5.That you have issued the said cheque to the my
client knowingly, intentionally and malafidely that
