Examination Rules

COURSES
1. There are two streams of Program of law leading to Bachelors Degree in Law as hereunder:
a. A three year degree course in law (LL.B. (Hons.)) undertaken after obtaining a
Bachelors’ Degree in any discipline of studies from a University or any other
qualification considered equivalent by the Bar Council of India
b. A double degree integrated course combining Bachelors’ Degree course in a discipline
(BA, BBA or B.Com.) of study together with the Bachelors’ degree course in law,
which shall be of not less than five years’ duration leading to the integrated degree in
the respective discipline of knowledge and Law together (BA. LL.B (Hons), BBA.
LL.B (Hons) & B.Com. LL.B. (Hons)).
2. The Integrated Degree of Bachelor of Law (BA. LL.B (Hons), BBA. LL.B (Hons) & B.Com.
LL.B. (Hons)) shall comprise of a course of study spread over a period of five years and the
candidates will be full time regular students.
3. The Degree of Bachelor of Law (LL.B. (Hons)) shall comprise of a course of a study spread
over a period of three years and the candidates will be full time regular students.

ELIGIBILITY FOR ADMISSION


1. For Integrated Degree Program
a. An applicant who has successfully completed Senior Secondary School course
(‘+2’) or equivalent from a recognized University of India or outside or from a
Senior Secondary Board or equivalent, constituted or recognized by the Union or
by a State Government or from any equivalent institution from a foreign country
recognized by the government of that country for the purpose of issue of qualifying
certificate on successful completion of the course, may apply for the integrated
degree in law.
b. The candidate must have completed the age of 17 years and must not be more than
22 years at the time of admission. (Age of admission shall be subject to approval of
the concerned board of studies as per the guidelines of Bar Council of India
amended time to time in this regard.)
2. For Three Year Law Degree Course
a. An applicant who has graduated in any discipline of knowledge from a University
established by an Act of Parliament or by a State legislature or an equivalent
national institution recognized as a Deemed to be University or foreign University
recognized as equivalent to the status of an Indian University by an authority
competent to declare equivalence, may apply for a three years’ degree program in
law leading to conferment of LL.B. degree

ACADEMIC STANDARDS AND CURRICULUM


1. Details of subject to be taught during the five year and three year programs, curriculum
pattern and examination scheme for each year course shall be subject to approval of the
concerned Board of studies as per the guidance of the Bar Council of Indian in this regard.
2. One semester shall be of 16-18 weeks of academic work.
3. One credit equals to one hour per week for undergraduate program.
4. There shall be not less than 36 class-hours per week including seminar, moot court and
tutorial classes and 30 minimum lecture hours per week.

5. The teaching shall start in July and January of every year and the Examinations there of
shall be held twice a year ordinarily in the month of December and May.
6. In integrated degree program, one has to take one major subject and two minor subjects in
addition to English/ Language. There shall be 6 papers in major and three papers each in
minor and in languages.

PROMOTION RULES
1. No student of any of the degree program shall be allowed to take the end semester test in
a subject if the student concerned has not attended minimum of 75% of the classes held in
the subject concerned as also the moot court room exercises, tutorials and practical training
conducted in the subject taken together.
2. Students in a program will pass by combining marks of internal and external examination.
However if a student is absent in the external examination, that student will be considered
as absent and thereby the student will be unsuccessful in that course.
3. The internal/ external examination components will be in 40:60 ratios. The internal marks
will be given out of 40 converted to 4 grade point, external marks will be given out of 60
converted to 6 grade point.
4. The 10 point grading system with the following letter grades is given below:

7. Each program will be evaluated out of 10 grade points Cumulative Grade Points Average
(CGPA) that can be converted into percentage as follows:

8. The SGPA and CGPA shall be rounded off to 2 decimal places. Each subject marks shall
be rounded off to absolute figures, less than 0.5 to lower figure and more than 0.5 to higher
figure. If a student obtains F or Ab grade in any course, the student will be considered to
have unsuccessful in the course.
9. On completing requirement for award of the degree the CGPA will be calculated and this
value will be indicated on degree along with division.
10. Division awarded at end of the program
1st Division with distinction- The candidates has earned minimum number of credits
required for award of degree in first attempts with CGPA of 8.00 or above
First Division - The student has earned minimum number of credits required for the award
of degree with CGPA of 6.5 or above.
Second Division - The student has earned minimum number of credits required for award
of degree with CGPA of 5 or above but less than 6.5.
Pass - The student has earned minimum number of credits required for award of the degree
with CGPA of 4 or above but less than 5.
11. Where a student secures less than 5 SGPA in a semester and has passed in all the subjects
then the final result will be considered as ATKT (unsuccessful). The student shall have to
choose two courses in which the student’s Grade Point Average is less than 5 to appear for
re-examination. If such student has failed a course then he/she shall not be given a choice
and the student shall have to appear in the course in which he/she has failed.

12. A student shall not be admitted in the fifth or higher semester classes unless the student has
fully cleared the first and second semester examination.
13. A student shall not be admitted in the seventh or higher semester classes unless the student
has fully cleared the third and fourth semester examinations.
14. A student shall not be admitted in the ninth or higher semester classes unless the student
has fully cleared the fifth and sixth semester examinations.
15. As per the DAVV UTD (University Teaching Department of Devi Ahilya
Vishwavidhyalaya), A student shall not be eligible for promotion to the next semester, if
the student is carrying more unsuccessful courses than half of the total courses, i.e. student
secured less than half of the total credits any semester.
16. If student secures at least half of the total credits in a semester and fails in some courses
offered in that semester then he/she will be provisionally promoted to the next semester
with ATKT (Allowed To Keep Term) in those courses in which he/she fails.

17. No student shall be declared to have cleared the final examination for the degree unless the
student has cleared the previous semester. The results of students who have cleared the final
semester but not the previous semester shall be withheld. The student shall be deemed to
have passed the final examinations in the year in which the student clears all the previous
semester examinations.
18. A student who has been declared unsuccessful in an examination may at his/her option
reappear at it subsequently, as an ex-student without being required to attend regular course
of study again for the same semester subject to the condition that such student shall abide
by and governed by the provisions of these rules and other rules/ordinances passed by
DAVV and BCI. Marks obtained earlier in internal assessment will be carried forward and
added to the marks obtained in repeat end semester examination to decide the grade in the
repeat course.
19. The examination of odd semester shall be held with the odd semester and the examination
of even semester shall take place with the even semester.
20. In order to be successful at the semester examination, a student must secure atleast 40% of
marks in each course and also at least 50% of aggregate of grand total.

ELIGIBILITY FOR DEGREE


1. A student shall be eligible for the integrated degree (BA. LL.B (Hons), BBA. LL.B (Hons)
& B.Com. LL.B. (Hons)) when the student has undergone the prescribed course of study
for a period of not less than five year, and not more than eight years, in the Institute and
has passed the requisite examination in all the courses.
2. A student shall be eligible for the LL.B. (Hons) degree when the student has undergone the
prescribed course of study for a period of not less than three year, and not more than six
years, in the Institute and has passed the requisite examination in all the courses.

A moot court exercise, or mooting, simulates a real court environment to give law students an
opportunity to put their learning into practice. This simulation replicates a court environment,

SESSION PLAN:

IMPORTANT: Please note that the duration of all sessions are 60 minutes. Sessions will not be
used to teach concepts, but they will be used to facilitate your learning. This will require

COURSE DESCRIPTION:
The course aims at acquainting students to the Rules, Regulations and Laws in the Indian Banking
domain. The course is systematically planned so as to introduce students to the evolution of
banking. It further includes various associated legislations like Banking Regulation Act, 1949;
Negotiable Instrument Act, 1881 etc. The course also deals with recent developments in the
Banking Sector.

The faculty member will award marks out of a maximum of 40 marks for the internal performance
of the student. The end semester examination will be worth 60 marks. It will have two sections A
and B. Section A will be of 48 Marks having six theory/application-based questions worth 12
marks each. Students will be required to attempt any four questions from Section A. Section B will
be compulsory. It will comprise of one or more open-ended/close-ended Case(s) worth 12 marks.
*End-term Examination Question Paper Guidelines:
Faculty who designed the question papers will not engage in evaluations. Faculty should design
the question paper based on the following criteria:
(a) equal distribution of questions across the syllabus;
(b) questions that would test their fundamental understanding of the subject (50%);
(c) questions that are application-based and thought-provoking (25%);
(d) questions that will evaluate the students' decision-making abilities (25%)

COURSE DESCRIPTION:

The foundation of the present local self-government in India was laid by the Panchayati Raj System
(1992).But the history of Panchayati Raj starts from the self-sufficient and self-governing village
communities. In the time of the Rig-Veda (1700 BC), evidence suggests that self-governing village
bodies called ‘sabhas’ existed. With the passage of time, these bodies became panchayats (council
of five persons). Panchayats were functional institutions of grassroots governance in almost every
village. They endured the rise and fall of empires in the past, to the current highly structured
system.
Local self-government implies the transference of the power to rule to the lowest rungs of the
political order. It is a form of democratic decentralization where the participation of even the grass
root level of the society is ensured in the process of administration. The acts of 1992 added two
new parts IX and IX-A to the constitution. It also added two new schedules – 11 and 12 which
contains the lists of functional items of Panchayats and Municipalities. It provides for a three-
tier system of Panchayati Raj in every state – at the village, intermediate and district levels.
Panchayat and Municipality are the generic terms for the governing body at the local level. Both
exist as three tier systems – at the lower, intermediate and upper levels. The 73rd Constitutional
Amendment act provides for a Gram Sabha as the foundation of the Panchayati Raj system. It is
essentially a village assembly consisting of all the registered voters in the area of the panchayat.
The state has the power to determine what kind of powers it can exercise, and what functions it
has to perform at the village level.
The 74th Constitutional Amendment act provides for three types of Municipalities:
1. Nagar Panchayat for a transitional area between a rural and urban area.
2. Municipal Council for a small urban area.
3. Municipal Corporation for a large urban area.

The faculty member will award marks out of a maximum of 40 marks for the internal performance
of the student. The end semester examination will be worth 60 marks. It will have two sections A
and B. Section A will be of 48 Marks having Six theory/Case-based questions worth 12 marks
each. Students will be required to attempt any Four questions from Section A. Section B will be
compulsory. It will comprise of one or more Case(s) worth 12 marks.

*End-term Examination Question Paper Guidelines:


Faculty who designed the question papers will not engage in evaluations. Faculty should design
the question paper based on the following criteria:
(a) Equal distribution of questions across the syllabus;
(b) Questions that would test their fundamental understanding of the subject (50%);
(c) Questions that are case-based and thought-provoking (25%);
(d) Questions that will evaluate the students' decision-making abilities (25%)

SESSION PLAN:

IMPORTANT: Please note that the duration of all sessions are 60 minutes. Sessions will not
be used to teach concepts, but they will be used to facilitate your learning. This will require
you to spend an hour to meticulously go through the pre-reads and/or case studies as
mentioned in the section below. Classroom sessions can be utilized to clarify doubts and
discuss application exercises. You will require to again spend 30 to 45 minutes to practice
the application problems as given in your textbook and reference books or any other
reference material to manifest the concepts and gain command on the topic covered, after
a session is over.

COURSE DESCRIPTION:
This course will equip the students with the basic knowledge and vocabulary needed to navigate
this labyrinth of institutions, markets, laws and regulation. This course will be your tour through
the financial system, and the legal and regulatory frameworks that apply to it. Upon completion of
the course, the students are expected to build an understanding of the main ‘players’ in the financial
system (how they are connected, and how they interact), the context behind ts current structure,
and the opportunities and challenges of its future.

*End-term Examination:
The faculty member will award a maximum of 40 marks for the internal performance of the
student. The end semester examination will be worth 60 marks. It will have two sections A and B.
Section A will be of 48 Marks having Six theory/Case-based questions worth 12 marks each.
Students will be required to attempt any Four questions from Section A. Section B will be
compulsory. It will comprise one or more Case(s) worth 12 marks.

*End-term Examination Question Paper Guidelines:


Faculty who designed the question papers will not engage in evaluations. Faculty should design
the question paper based on the following criteria:
(a) equal distribution of questions across the syllabus;
(b) questions that would test their fundamental understanding of the subject (50%);
(c) questions that are application-based and thought-provoking (25%);
(d) questions that will evaluate the students' decision-making abilities (25%)

SESSION PLAN:

IMPORTANT: Please note that the duration of all sessions are 60 minutes. Sessions will not
be used to teach concepts, but they will be used to facilitate your learning. This will
require you to spend an hour to meticulously go through the pre-reads and/or case

COURSE DESCRIPTION:
The course introduces a non-traditional legal discourse of Gender Justice. Gender issues as a notion
and a debate becomes essential in a democratic, constitutional and liberal economy where equality
is upheld. This Course is an insight to concept of gender, gender inequality and existing legal
framework combating gender injustices. The course merges gender issues, inequality and law to
enable a student to critically analyse the existing injustice. The course also includes the feminist
theories and feminism movement as a pathway to understanding of Gender inequality and counter
measures.

End-term Examination:
The faculty member will award a maximum of 40 marks for the internal performance of the
student. The end semester examination will be worth 60 marks. It will have two sections A and
B. Section A will be of 48 Marks having Six theory/Case-based questions worth 12 marks each.
Students will be required to attempt any Four questions from Section A. Section B will be
compulsory. It will comprise one or more Case(s) worth 12 marks.

End-term Examination Question Paper Guidelines:


Faculty who designed the question papers will not engage in evaluations. Faculty should design
the question paper based on the following criteria:
(a) equal distribution of questions across the syllabus;
(b) questions that would test their fundamental understanding of the subject (50%);
(c) questions that are application-based and thought-provoking (25%);
(d) questions that will evaluate the students' decision-making abilities (25%)

SESSION PLAN:

IMPORTANT: Please note that the duration of all sessions are 60 minutes. Sessions will not
be used to teach concepts, but they will be used to facilitate your learning. This will require
you to spend an hour to meticulously go through the pre-reads and/or case studies as
mentioned in the section below. Classroom sessions can be utilized to clarify doubts and
discuss application exercises. You will require to again spend 30 to 45 minutes to practice
the application problems as given in your textbook and reference books or any other
reference material to manifest the concepts and gain command on the topic covered, after
a session is over.

COURSE DESCRIPTION:
This course will give students an introduction to the practice of Mergers and Acquisitions (M&A)
in India. M&A involves many legal issues which affect deal structuring, completion timelines,
parties' responsibilities and risk allocation among the transaction parties.

*End-term Examination:
The faculty member will award marks out of a maximum of 40 marks for the internal performance
of the student. The end semester examination will be worth 60 marks. It will have two sections A
and B. Section A will be of 48 Marks having six theory/application-based questions worth 12
marks each. Students will be required to attempt any four questions from Section A. Section B will
be compulsory. It will comprise of one or more open-ended/close-ended Case(s) worth 12 marks.
*End-term Examination Question Paper Guidelines:
Faculty who designed the question papers will not engage in evaluations. Faculty should design
the question paper based on the following criteria:
(a) equal distribution of questions across the syllabus;
(b) questions that would test their fundamental understanding of the subject (50%);
(c) questions that are application-based and thought-provoking (25%);
(d) questions that will evaluate the students' decision-making abilities (25%)

SESSION PLAN:

IMPORTANT: Please note that the duration of all sessions are 60 minutes. Sessions will not
be used to teach concepts, but they will be used to facilitate your learning. This will require
you to spend an hour to meticulously go through the pre-reads and/or case studies as
mentioned in the section below. Classroom sessions can be utilized to clarify doubts and
discuss application exercises. You will require to again spend 30 to 45 minutes to practice
the application problems as given in your textbook and reference books or any other
reference material to manifest the concepts and gain command on the topic covered, after
a session is over.
