INSTRUCTIONS TO STUDENTS

1. This is a GROUP ASSIGNMENT of 3-5 people only.


2. This paper consists of THREE (3) QUESTIONS. Please choose only TWO (2)
QUESTIONS.
3. Answer ALL questions in English.
4. Softcopy of the answer must be in PDF file and emailed to
[email protected] with an email subject of ‘LAW240
ASSIGNMENT SUBMISSION’ on or before the last submission date/time. Late
submission will not be tolerated.
5. The PDF file must be named according to this format: Class (capital letter)
followed with group leader’s name (capital letter) e.g.: AC1103J ALI BIN ABU.
6. All answers must be typed using Arial, font size 12, and spacing 1.5. All text
must be justified left and right.
7. Your answer must be between 4-6 pages ONLY, excluding cover page.
8. The cover page must include group member’s name and student ID.
Kindly choose TWO (2) Questions ONLY.

1) In Article 3(1) of Malaysia Federal Constitution, Islam is the religion of the


country, but other religions may be practised in peace and harmony. However,
Malaysia is neither an Islamic country nor a secular country. Islamic law in
Malaysia applies to Muslims only in areas of personal and family law as set out
in the various state administration statutes. In all other areas like crime, contract
and tort, Muslims are governed by civil laws enacted by elected authorities.

In light of the above, discuss the distinction of Civil law and Islamic law in
Malaysia.

2) Kamarul is an operations manager working at Mutiara Rasa Sdn. Bhd. His


colleague, Diana, has made a complaint to the Human Resource Manager that
Kamarul molested her in the pantry room. The Manager viewed this as a
serious matter. He immediately reported this matter to the management with a
recommendation for his dismissal. Kamarul was immediately dismissed from
work without notice.

Advise Kamarul as to his legal position with reference to the relevant statutes.
