PETROLEUM PRODUCTS EXPORT LICENCE

A. The NATIONAL PETROLEUM AUTHORITY wishes to inform the general public,


specifically those who intend to be, or are already service providers in the petroleum
downstream sector, on provisions under the National Petroleum Authority Act 2005, (Act
691) and the requirements for obtaining a licence.

Section 11(1)

A person shall not engage in a business or commercial activity in the petroleum


downstream industry unless that person has been granted a licence for that purpose by the
Authority.

Section 12

A licence under this Act may only be granted to


a. a citizen of Ghana; or
b. a body corporate registered under the Companies Code, 1963 (Act 179); or
c. a partnership registered under the Incorporated Private Partnerships Act, 1962
(Act 152); or
d. a foreign individual or foreign company in a registered joint venture relationship
with a citizen of Ghana or a Ghanaian company.

B. REQUIREMENTS TO OBTAIN A PETROLEUM PRODUCTS (EXPORT)


LICENCE

a. Evidence of local participation i.e. at least 50% shares to be held by Ghanaian


citizens.
b. A corporate environmental policy culminating in the grant and issue of an
environmental permit by the EPA.
c. Evidence of certificate of quality of the petroleum product(s).
d. Evidence of a minimum of 5,000m3 storage facilities for petroleum products. (Such
facilities could be leased or own storage).
e. Evidence of arrangements for the transportation of petroleum products to final
destination.
f. Evidence of Agreement/Memorandum of Understanding (MOU) between the foreign
Supplier of the petroleum products and the local company.
g. Evidence of Sales/Purchase Contract between the local company and the final
recipient(s) of the petroleum products.

A petroleum products marketing (export) licence authorizes a company to import petroleum products into Ghana and re-export same
to neighbouring countries under customs seal.
Applicant companies that fully satisfy and meet the requirements in A and B shall be granted
Petroleum Product Marketing (Export) Licences (final) to operate as Petroleum Product
Marketing (Export) Companies.

The validity of the final licence is one year.

C. REQUIREMENTS FROM OTHER STAKEHOLDERS AFTER


OBTAINING A PETROLEUM PRODUCT MARKETING (EXPORT) LICENCE

Installation of the front-end of the GCNet in the offices of the respective applicant and
subsequent declaration of all petroleum imports and exports to customs through the
Ghana Customs Management System/Ghana Customs Network (GCMS/GCNet) prior to
the delivery of the cargoes.
