On January 30, 2024, the Court of Appeals reversed and rendered Anthony Gerald Fox’s
conviction. Mr. Fox is currently incarcerated. The court’s judgment takes effect when the mandate
is issued. The Court of Appeal’s mandate shall issue twenty-one (21) days after the entry of
judgment unless the time is shortened or enlarged by order. The timely filing of a motion for
rehearing will stay the mandate until disposition of the motion. Miss. R. App. P. 41.
The State, specifically the Mississippi Attorney General, is not filing a motion for
rehearing, nor does it object to the Appellant’s request to expedite the twenty-one (21) day
mandate. Each day that passes with Mr. Fox incarcerated is another day of travesty by allowing a
known, innocent man to remain behind bars. Mr. Fox respectfully requests this Court to expedite
the issuance of the mandate to allow him to be released and to regain his life, liberty, and freedom
once again.
