A RESOLUTION OF BOTH HOUSES OF CONGRESS


PROPOSING AMENDMENTS TO CERTAIN ECONOMIC PROVISIONS OF THE
1987 CONSTITUTION OF THE REPUBLIC OF THE PHILIPPINES,
PARTICULARLY ON ARTICLES XII, XIV AND XVI

Be it enacted by the Senate and House of Representatives of the Philippines in Congress


assembled:

1 WHEREAS, the Constitution is the supreme law of the land, enshrining the
2 foundations of our nationhood and reflecting the consensus of our citizenry;

4 WHEREAS, the nation's economic policy must be reframed under the demands of
5 this increasingly globalized age, while still protecting the general policy of Filipino-first
6 that guides the economic provisions of the Constitution;
7
8 WHEREAS, there is a need to institutionalize the reforms laid down in the Public
9 Service Act to liberalize industries, promote efficient service delivery, and foster
10 competition as an enduring policy;

12 WHEREAS, our children deserve to have access to the best educational
13 institutions, both Filipino and foreign, to ensure that they receive the best training to
14 become globally competitive citizens in the modern world;
15
16 WHEREAS, the advertising industry currently already has foreign players and
17 liberalizing the same is a logical and sound policy to attract foreign direct investment in
18 that industry;

21 RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES, by a
22 vote of three-fourths (3/4) of all its Members, each House voting separately, and pursuant
23 to Article XVII of the Constitution to propose amendments to Articles XII, XIV & XVI of
24 the 1987 Constitution of the Republic of the Philippines, with the following proposals:

26 1. Section 11 of Article XII (National Patrimony and Economy) is amended to read
27 as follows:

29 "Section 11. No franchise, certificate, or any other form of
30 authorization for the operation of a public utility shall be granted
1 except to citizens of the Philippines or to corporations or
2 associations organized under the laws of the Philippines, at least
3 sixty per centum of whose capital is owned by such citizens,
4 UNLESS OTHERWISE PROVIDED BY LAW; nor shall such
5 franchise, certificate, or authorization be exclusive in character or
6 for a longer period than fifty years. Neither shall any such franchise
7 or right be granted except under the condition that it shall be
8 subject to amendment, alteration, or repeal by the Congress when
9 the common good so requires. The State shall encourage equity
10 participation in public utilities by the general public. UNLESS
11 OTHERWISE PROVIDED BY LAW, the participation of foreign
12 investors in the governing body of any public utility enterprise shall
13 be limited to their proportionate share in its capital, and all the
14 executive and managing officers of such corporation or association
15 must be citizens of the Philippines."

17 2. Paragraph 2, Section 4 of Article XIV (Education, Science and Technology, Arts,
18 Culture, and Sports), is amended to read as follows:

20 "Section 4. (2) BASIC educational institutions, other than those
21 established by religious groups and mission boards, shall be owned
22 solely by citizens of the Philippines or corporations or associations
23 at least sixty per centum of the capital of which is owned by such
24 citizens. The Congress may, however, require increased Filipino
25 equity participation in all educational institutions. The control and
26 administration of educational institutions shall be vested in citizens
27 of the Philippines, UNLESS OTHERWISE PROVIDED BY LAW."

29 3. Paragraph 2, Section 11 of Article XVI (General Provisions), is amended to read
30 as follows:

36 Only Filipino citizens or corporations or associations at least seventy per
37 centum of the capital of which is owned by such citizens shall be allowed
38 to engage in the advertising industry, UNLESS OTHERWISE
39 PROVIDED BY LAW.

41 UNLESS OTHERWISE PROVIDED BY LAW, the participation of
42 foreign investors in the governing body of entities in such industry shall
43 be limited to their proportionate share in the capital thereof, and all the
44 executive and managing officers of such entities must be citizens of the
45 Philippines."
