ASSIGNMENT 1 (THEORETICAL) 50 marks

Critique and contrast the cases of Hollington v F Hewthorn & Co Ltd 1943 2 All ER 35

and Hellens v The Minister of Home Affairs and Others (HC-MD-CIV-MOT-GEN-2020/00071)

[2021] NAHCMD 300 (23 June 2021) vis-à-vis opinion evidence.

ASSIGNMENT 2 (PRACTICAL COURT OBSERVATION) 50 marks

Observe a trial in a criminal, civil or labour matter in the Magistrates’ or High Court

or any other government institution, and compile a write up / research report on the

following:

- Stages and procedures in the trial process.

- Rules and procedures of evidence applied by the court.

- An evaluation of whether or not the trial was conducted in accordance with the

constitutional and procedural imperatives.

- The forms or kinds of evidence tendered during the trial and procedure for

admissibility thereof.

- An opinion whether or not our trial system is more or less adversarial or

inquisitorial in nature; and whether it enhances the fact-finding mission of the

court.

NB:

1. Provide the case number of the case observed, two reference persons with full

details/contacts, the court name, the town, dates you attended; and an official

stamp of that Court/Institution on the assessment cover page or reference list.

2. This is an individual assessment; however, you may do it in a group of not

more than 5 students if you so wish.
