GUIDELINES

FOR THE CONDUCT OF: (1) IN-PERSON CAMPAIGN, (2) RALLIES, (3)
CAUCUSES, MEETINGS, AND CONVENTIONS, (4) MOTORCADES AND
CARAVANS, AND (5) MITING DE AVANCE UNDER THE NEW NORMAL IN
CONNECTION WITH THE 09 MAY 2022 NATIONAL AND LOCAL
ELECTIONS.

Question: What is RESOLUTION NO. 10732 known for?

Answer: THE GUIDELINES FOR THE CONDUCT OF: (1) IN-PERSON


CAMPAIGN, (2) RALLIES, (3) CAUCUSES, MEETINGS, AND
CONVENTIONS, (4) MOTORCADES AND CARAVANS, AND (5)
MITING DE AVANCE UNDER THE NEW NORMAL IN CONNECTION
WITH THE 09 MAY 2022 NATIONAL AND LOCAL ELECTIONS..

Question: Who are considered candidate?

Answer: Candidate refers to any person aspiring for or seeking an


elective public office, who has filed a certificate of candidacy. For this
purpose, any person who files his or her certificate of candidacy shall only
be considered as a candidate at the start of the campaign period for which
he or she filed his or her certificate of candidacy.

For the purposes of this Guidelines, the nominees of a Party List group
seeking a seat in the House of Representatives through the Party-List
System of Representation, shall be considered as candidates;

Question: What are the campaign period for local and national
election?

Answer:
Campaign Period. Unless otherwise fixed in special cases by the
Commission on Elections, the period of campaign shall be as follows:

(l)For candidates for President, Vice-President, Senator and party-list


groups participating in the party-list system of representation - 08
February 2022 to 07 May 2022;

(2)For Members of House of Representatives, and elective provincial, city,


and municipal officials - 25 March 2022 to 07 May 2022.

The campaign period shall not include 14 April 2022 (Maundy Thursday)
and 15 April 2022 (Good Friday), the day before, and the day of the
election.

Question: What are Caucuses, Meetings, and Conventions ?

Answer: Caucuses, Meetings, and Conventions refer to a meeting of
people held indoors for the purpose of soliciting votes and/or undertaking
any campaign or propaganda for or against a candidate.
Question: What is Miting de Avance ?

Answer: Miting de Avance refers to a public rally conducted by any


candidate, political party, party under the party-list system, or coalition, on
the last day of the campaign period.

Question: What are Motorcades and Caravans ?

Answer: Motorcades and Caravans refer to an organized procession of


vehicles travelling together that move along a sidewalk, public or private
street, highway, or expressway, conducted exclusively for election
campaign purposes.

Question: What is Rally?

Answer: Rally refers to a mass or concerted action held in a public place,


indoors or outdoors, for the purpose of soliciting votes and/or undertaking
any campaign or propaganda for or against a candidate.

Question: What is in-Person Campaign ?

Answer:

In-Person Campaign refers to a form of campaigning wherein a


candidate and his/her supporters personally visit the voters through
house-to-house and other sorties in public places, distribute leaflets,
give away sample ballots, campaign materials, and other goods or
items allowed under Republic Act No. 9006, otherwise known as the
Fair Election Act.

Question: What is Election Campaign Activity?

Answer: Election Campaign Activity refers to an act designed to promote


the election or defeat of a particular candidate or candidates to a public
office which shall include:

(1) Holding political caucuses, conventions, meetings, rallies, motorcades,


or other similar assemblies or gatherings, or in-person campaigns for the
purpose of soliciting votes and/or undertaking any campaign or
propaganda for or against a candidate;
(2) Making speeches, announcements or commentaries, or holding
interviews for or against the election of any candidate for public office; or
(3) Distributing campaign materials designed to support or oppose the
election of any candidate.

Question: What covers ‘Minimum Public Health Standards (MPHS)?’

Answer: Minimum Public Health Standards (MPHS) refers to guidelines set
by the Department of Health and such other issuances subsequent thereto, as
well as sector-relevant guidelines issued by national government agencies as
authorized by the IATF-MEID. Specifically, to:

1. Ensure adequate air circulation and ventilation;


2. Maintain physical distancing of one (1) meter or more; and 3. Proper usage of
face masks and other personal protective
equipment as may be necessary.

Question: What is New Normal?

Answer: New Normal refers to the emerging behaviors, situations, and


minimum public health standards that will be institutionalized in common
or routine practices and remain even after the pandemic while the disease
is not totally eradicated through means such as widespread immunization.

Question: What is the Scope of these Guidelines ?

Answer: These Guidelines shall cover Election Campaign Activities that


involve physical or personal interaction, such as (1) In-Person Campaign,
(2) Rallies, (3) Caucuses, Meetings, and Conventions, (4) Motorcades and
Caravans, and (5) Miting De Avance.

Question: Are candidates considered APOR?

Answer: Candidates as Authorized Persons Outside of Residence (APOR).


-All candidates and their campaign support staff of voting age, who are
going out of their residence to participate in election campaigns, as
defined herein shall be recognized as

Authorized Persons Outside of Residence (APOR) during the campaign


period, regardless of the alert level system and vaccination status.

Question: What are the health protocol requirements of Participants


during campaign?

Answer: Requirements of Participants. - Subject to the prevailing IATF-


MEID guidelines, all persons participating in election campaigns in
whatever capacity are mandated to wear full-coverage face shields
together with face masks (ear loop masks, indigenous, reusable, or do-it-
yourself masks, or other facial protective equipment and observe the
minimum public health standards at all times during the period of the
political activity.

Question: Who are Persons Not Allowed to join election campaign


activties?

Answer: Persons Not Allowed. - Subject to the prevailing IATF- MEID
guidelines, any person below eighteen ( 18) years old, those who are over
sixty-five (65) years of age, and those with immunodeficiency,
comorbidity, or other health risks, and heavily pregnant women are not
allowed to join, participate, or take part in any political caucuses,
conferences, meetings, rallies, motorcades or other similar assemblies for
the purpose of soliciting votes and/or undertaking any campaign or
propaganda for or against a candidate.

Question: What are Allowable Election Campaign Activities under


Category Levels?

Answer:

undertakes the construction of any public works, except for projects or


works except:

1) Maintenance of existing and/or completed public works project:


Provided, That not more than the average number of laborers or
employees already employed therein during the six-month period
immediately prior to the beginning of the forty-five day period before
election day shall be permitted to work during such time: Provided,
further, That no additional laborers shall be employed for
maintenance work within the said period of forty-five days;
2) Work undertaken by contract through public bidding held, or by
negotiated contract awarded, before the forty-five day period before
election: Provided, That work for the purpose of this section
undertaken under the so-called "takay" or "paquiao" system shall not
be considered as work by contract;
3) Payment for the usual cost of preparation for working drawings,
specifications, bills of materials, estimates, and other procedures
preparatory to actual construction including the purchase of
materials and equipment, and all incidental expenses for wages of
watchmen and other laborers employed for such work in the central
office and field storehouses before the beginning of such period:
Provided, That the number of such laborers shall not be increased
over the number hired when the project or projects were
commenced; and
4) Emergency work necessitated by the occurrence of a public calamity,
but such work shall be limited to the restoration of the damaged
facility.

Question: What are the prohibited activities during In-Person


Campaign?

Answer:
1. Entering any private dwelling during house-to-house campaigning, even
with the express permission of the homeowner;

2. Crowding, or allowing there to be, crowds that violate MPHS around the
candidate and his or her companions;
3. Handshakes, hugs, kisses, going arm-in-arm, or any action that involves
physical contact among the candidate, their companions, and the public;
4. Taking selfies, photographs and other similar activities that require close
proximity between the candidate and their companions, and the public;
and
5. Distribution of food and drink, and all other goods or items.

Question: What are the prohibited activities during Conventions,


Caucuses, Meetings, Miting de Avance and Rallies. ?

Answer:
1. Handshakes, hugs, going arm-in-arm, or any action that involves physical
contact among the candidate, their companions, and the public;
2. Taking selfies, photographs and other similar activities that require close
proximity between the candidate and their companions, and the public;
and
3. Distribution of food and drink, and all other goods or items.

Question: What are the passenger capacity for each type of vehicle
shall
Motorcades and Caravans?

Answer:

Only candidates, campaign leaders, and supporters belonging to the same
household are allowed to be in the same vehicle.

The following activities are strictly prohibited during Motorcades, in all


Category Levels:

c. l. Stopovers, layovers, and other similar stoppages for the conduct of


other election campaign activities;
c.2. Handshakes, hugs, kisses, going arm-in-arm, or any action that
involves physical contact among the candidate, their companions, and the
public;
c.3. Taking selfies, photographs and other similar activities that require
close proximity between the candidate and their companions, and the
public; and
c.4. Distribution of food and drink, and all other goods or items.

Question: What are the PROCEDURE FOR APPLICATIONS FOR THE


CONDUCT OF ELECTION CAMPAIGNS ?

Answer: Approval of the CCC COMELEC Campaign Committee - No


election campaign activity under this Guidelines shall be conducted without
first obtaining the prior approval from the corresponding CCC.

Question: Where and when to file the applications for the conduct of
election campaign?

Answer: Where and when to file. - Applications for the conduct of


election campaign activities shall be filed at least seventy two (72) hours
prior to the intended schedule, before the following committees:
a. Regional COMELEC Campaign Committee (RCCC) at the Office of the
Regional Election Director - for Presidential, Vice Presidential, Senatorial,
and Party-List Candidates;
1. Provincial COMELEC Campaign Committee (PCCC) at the Office of the
Provincial Election Supervisor - for Gubernatorial, Vice Gubernatorial,
District Representative, and Sangguniang Panlalawigan Candidates; and
2. Municipal/City COMELEC Campaign Committee (M/CCCC) at the concerned
Office of the Election Officer - for Mayoralty, Vice Mayoralty, and
Sangguniang BayaniPanlungsod Candidates.
The CCC concerned shall, upon due evaluation, either approve or deny the
application within forty-eight (48} hours from receipt thereof. Inaction of
the concerned CCC shall be deemed an approval of the application.

Question: What are the penalty for Violations of the MPHS?

Answer: Any person committing an act constituting a violation of Sections
87, 88 and 89 of the Batas Pambansa Blg. 881 or the Omnibus Election
Code (OEC), as amended shall be prosecuted under Section 262 of the
OEC. If proven guilty, he/she shall be punished with imprisonment of not
less than one (1) year but not more than six (6) years and shall not be
subject to probation. In addition, the guilty party shall be sentenced to
suffer disqualification to hold public office and deprivation of the right of
suffrage. If he/she is a foreigner, he/she shall be sentenced to deportation
which shall be enforced after the prison term has been served. Any
political party found guilty shall be sentenced to pay a fine of not less than
ten thousand pesos, which shall be imposed upon such party after criminal
action has been instituted in which their corresponding officials have been
found guilty.
