Special Power of Attorney - Estate For Foreign Heirs

Do hereby name, constitute and appoint [APPOINTEE], of legal age, [civil status] and
[address] to be true and lawful representatives or attorneys-in-fact, in our name place,
and stead to:
1. To do and perform all the things necessary or desirable for the settlement of the
estate of the late [DECEDENT] (the “Estate”) with the concerned government
agencies in the Philippines, such as, but not limited to, the Land Registration
Authority (LRA), Register of Deeds, Bureau of Internal Revenue (BIR), and the
concerned local government units;
2. To sign and execute any deed of extrajudicial settlement, or any similar document,
on the Estate on behalf of the Heirs;
3. To retrieve or register the Tax Identification Numbers (TIN) of [Heir 1], [Heir 2], [Heir
3], and [Heir 4] from or with the BIR;
4. To file the necessary returns, and pay any applicable estate tax liabilities, including
but not limited to estate tax, and documentary stamp tax, as well as to avail of any
applicable tax amnesty, due on the Estate with the BIR;
6. To file and pay any applicable transfer taxes, property taxes, and other applicable
taxes to the concerned local government unit;
7. To file an application for, coordinate with, and receive from the relevant Office of the
City Assessor the issuance of a new, amended and/or certified true copy of the Tax
Declaration of the Real Property covering any and all real properties in the name of
the Decedent;
8. To file an application, process and receive from the relevant Registry of Deeds a
certified true copy of the Transfer Certificate of Title (TCT) covering any and all real
properties of the Decedent, the relevant documents for the annotation or removal
of an annotation on the TCT of the relevant property, and the Owner’s Duplicate
Title in the name of the Heirs of the Decedent, and lawful owners of the relevant
property;
9. To ultimately transfer the titles and the tax declarations of the properties from the
Estate to the Heirs with the Register of Deeds, the concerned local government unit,
or any other applicable government agency;
10. To sign, execute, deliver and/or receive any documents, papers, instruments and
other similar writings to the relevant office, agent, or branch of government in
connection with the settlement of the Estate, and perform any and all acts necessary
for the fulfillment of the foregoing transactions;
HEREBY GIVING AND GRANTING unto said attorneys-in-fact and/or their designated lawyer
or person full power and authority to do and perform all and every act and thing
whatsoever requisite and necessary to be done in and about the premises, and hereby ratify
and confirm all that attorneys-in-fact and/or their designated officer or person shall lawfully
do, cause to be done, and have actually done by virtue of these presents.
