SB 307, as amended, Ashby. Middle Class Scholarship Program:
community colleges: current and former foster youth.
Existing law establishes the Middle Class Scholarship Program
(MCSP) under the administration of the Student Aid Commission.
Existing law makes an undergraduate student eligible for a scholarship
award under the MCSP if the student is enrolled at the University of
California or the California State University, or enrolled in upper
division coursework in a community college baccalaureate program,
and meets certain eligibility requirements.
This bill would extend awards under the MCSP to community college
students who are current or former foster youth pursuing transfer to a
4-year postsecondary educational institution, an associate degree, an
associate degree for transfer, or a community college career technical
education certificate and meet other MCSP requirements, as provided.

The bill would require the commission to summarize the provisions of


the MCSP that apply to these current or former foster youth and title
those provisions as “The Fostering Futures Program” on a page on its
internet website.

The people of the State of California do enact as follows:

line 1 SECTION 1. Section 70022 of the Education Code is amended


line 2 to read:
line 3 70022. (a)  (1)  Subject to an available and sufficient
line 4 appropriation, an undergraduate student enrolled in the California
line 5 State University or the University of California, a community
line 6 college student enrolled in upper division coursework of a
line 7 community college baccalaureate program, described in Article 3
line 8 (commencing with Section 78040) of Chapter 1 of Part 48 of
line 9 Division 7, or a current or former foster youth, as defined in
line 10 paragraph (2) of subdivision (e) of Section 69433.6, who is a
line 11 community college student pursuing transfer to a four-year
line 12 postsecondary educational institution, an associate degree, an
line 13 associate degree for transfer, or a community college career
line 14 technical education certificate, who meets the requirements of
line 15 paragraph (3) is eligible for a scholarship award as described in
line 16 paragraph (2).
line 17 (2)  (A)  For the 2013–14 to the 2021–22 academic year,
line 18 inclusive, except as provided in paragraphs (4) and (5), an eligible
line 19 student shall receive a scholarship award in an amount that,
line 20 combined with other federal, state, or institutionally administered
line 21 student grants or fee waivers received by an eligible student, is up
line 22 to 40 percent of the amount charged to that student in that academic
line 23 year for mandatory systemwide tuition and fees, or for an eligible
line 24 community college student, up to 40 percent of the amount charged
line 25 to that student in upper division fees for a community college
line 26 baccalaureate degree program, if all of the requirements in
line 27 paragraph (3) are met, to the satisfaction of the commission, each
line 28 academic year.
line 29 (B)  Commencing with the 2022–23 academic year, except as
line 30 provided in paragraph (5), an eligible student, except for a current
line 31 or former foster youth described in paragraph (1), shall receive a

line 1 scholarship award in an amount that equals the difference between


line 2 their cost of attendance as determined by the commission and the
line 3 sum of the following amounts:
line 4 (i)  Other federal, state, and institutionally administered student
line 5 scholarships, grants, or fee waivers, and the amount of private
line 6 scholarships awarded to the student in excess of the sum of the
line 7 amounts in clauses (ii) and (iii).
line 8 (ii)  Seven thousand eight hundred ninety-eight dollars ($7,898),
line 9 reflecting an expected student contribution toward cost of
line 10 attendance from work earnings or other resources. Commencing
line 11 with the 2024–25 award year, the commission shall annually adjust
line 12 this amount based on the percentage change in the minimum wage,
line 13 pursuant to paragraph (1) of subdivision (c) of Section 1182.12 of
line 14 the Labor Code.
line 15 (iii)  Notwithstanding Section 69506, for dependent students
line 16 with an annual household income exceeding one hundred thousand
line 17 dollars ($100,000), 33 percent of the parents’ contribution from
line 18 adjusted available income, as determined using the federal
line 19 methodology established by Title IV of the federal Higher
line 20 Education Act of 1965, as amended (20 U.S.C. Sec. 1087mm et
line 21 seq.), and applicable rules and regulations adopted by the
line 22 commission.
line 23 (C)  Commencing with the 2024–25 academic year, a current or
line 24 former foster youth described in paragraph (1) shall receive a
line 25 scholarship award in an amount that equals the difference between
line 26 their cost of attendance as determined by the commission and the
line 27 sum of the amounts in clauses (i) and (iii) of subparagraph (B).
line 28 (3)  (A)  A student shall be eligible to receive an award if all of
line 29 the following requirements are met, to the satisfaction of the
line 30 commission, each academic year:
line 31 (B)  (i)  For each academic year from 2013–14 to 2021–22,
line 32 inclusive, the student’s annual household income does not exceed
line 33 one hundred fifty thousand dollars ($150,000). For awards
line 34 distributed for the 2016–17 academic year and subsequent
line 35 academic years, the commission shall annually adjust the maximum
line 36 income level set under this clause in accordance with the
line 37 percentage changes in the cost of living within the meaning of
line 38 paragraph (1) of subdivision (e) of Section 8 of Article XIII B of
line 39 the California Constitution. For purposes of this article, annual
line 40 household income shall be calculated in a manner that is consistent

1 with the requirements applicable to the
line 2 Ortiz-Pacheco-Poochigian-Vasconcellos Cal Grant Program
line 3 (Chapter 1.7 (commencing with Section 69430)) and Section
line 4 69506.
line 5 (ii)  Commencing with the 2022–23 academic year, the student’s
line 6 annual household income does not exceed the following amounts:
line 7 (I)  Two hundred one thousand dollars ($201,000) if the student
line 8 is a dependent student or an independent student with dependents
line 9 other than a spouse.
line 10 (II)  One hundred thirty-three thousand dollars ($133,000) if the
line 11 student is a married independent student with no dependents other
line 12 than a spouse.
line 13 (III)  One hundred sixteen thousand dollars ($116,000) if the
line 14 student is a single independent student with no dependents.
line 15 (iii)  For awards distributed for the 2023–24 academic year and
line 16 subsequent academic years, the commission shall annually adjust
line 17 the maximum income levels set under clause (ii) in accordance
line 18 with the percentage changes in the cost of living within the
line 19 meaning of paragraph (1) of subdivision (e) of Section 8 of Article
line 20 XIII B of the California Constitution. For purposes of this article,
line 21 annual household income shall be calculated in a manner that is
line22 consistent with the requirements applicable to the
line 23 Ortiz-Pacheco-Poochigian-Vasconcellos Cal Grant Program
line 24 (Chapter 1.7 (commencing with Section 69430)) and Section
line 25 69506.
line 26 (C)  (i)  For each academic year from 2015–16 to 2021–22,
line 27 inclusive, the student’s household asset level shall not exceed one
line 28 hundred fifty thousand dollars ($150,000). For awards distributed
line 29 in the 2016–17 academic year and subsequent academic years, the
line 30 commission shall annually adjust the maximum household asset
line 31 level set under this clause in accordance with the percentage
line 32 changes in the cost of living within the meaning of paragraph (1)
line 33 of subdivision (e) of Section 8 of Article XIII B of the California
line 34 Constitution. For purposes of this article, student’s household asset
line 35 level shall be calculated in a manner that is consistent with the
line

line 1 (ii)  Commencing with the 2022–23 academic year, the student’s


line 2 household asset level does not exceed the following amounts:
line 3 (I)  Two hundred one thousand dollars ($201,000) if the student
line 4 is a dependent student or an independent student with dependents
line 5 other than a spouse.
line 6 (II)  Ninety-six thousand dollars ($96,000) if the student is a
line 7 single independent student with no dependents or a married
line 8 independent student with no dependents other than a spouse.
line 9 (iii)  For awards distributed in the 2023–24 academic year and
line 10 subsequent academic years, the commission shall annually adjust
line 11 the maximum household asset level set under clause (ii) in
line 12 accordance with the percentage changes in the cost of living within
line 13 the meaning of paragraph (1) of subdivision (e) of Section 8 of
line 14 Article XIIIB of the California Constitution. For purposes of this
line 15 article, a student’s household asset level shall be calculated in a
line 16 manner that is consistent with the requirements applicable to the
line 17 Ortiz-Pacheco-Poochigian-Vasconcellos Cal Grant Program
line 18 (Chapter 1.7 (commencing with Section 69430)) and Section
line 19 69506.
line 20 (D)  The student satisfies the eligibility requirements for a Cal
line 21 Grant award pursuant to Section 69433.9, except that a student
line 22 who is exempt from nonresident tuition under Section 68130.5
line 23 shall not be required to satisfy the requirements of subdivision (a)
line 24 of Section 69433.9.
line 25 (E)  The student is exempt from paying nonresident tuition.
line 26 (F)  (i)  The student completes and submits a Free Application
line 27 for Federal Student Aid (FAFSA) or a California Dream Act
line 28 application. The FAFSA or California Dream Act application must
line 29 be submitted or postmarked by no later than March 2.
line 30 (ii)  Notwithstanding clause (i), the FAFSA or California Dream
line 31 Act application of a current or former foster youth described in
line 32 paragraph (1) of subdivision (a) must be submitted or postmarked
line 33 by no later than September 2.
line 34 (G)  The student makes a timely application or applications for
line 35 all other federal, state, or institutionally administered grants or fee
line 36 waivers for which the student is eligible.
line 37 (H)  (i)  The student maintains satisfactory academic progress
line 38 in a manner that is consistent with the requirements applicable to
line 39 the Ortiz-Pacheco-Poochigian-Vasconcellos Cal Grant Program
line 40 pursuant to subdivision (m) of Section 69432.7.

line 1 (ii)  Notwithstanding clause (i), for a student who is a current or


line 2 former foster youth described in paragraph (1) of subdivision (a)
line 3 only, the student maintains satisfactory academic progress in a
line 4 manner that is consistent with the requirements applicable to the
line 5 Chafee Educational and Training Vouchers Program pursuant to
line 6 subdivisions (h) and (i) of Section 69519.
line 7 (I)  The student is pursuing the student’s first undergraduate
line 8 baccalaureate degree or has completed a baccalaureate degree and
line 9 has been admitted to, and is enrolled in, a program of professional
line 10 teacher preparation at an institution approved by the Commission
line 11 on Teacher Credentialing. This subparagraph shall not apply to a
line 12 current or former foster youth described in paragraph (1) of
line 13 subdivision (a).
line 14 (J)  The student is enrolled at least part time.
line 15 (4)  (A)  For each academic year from 2013–14 to 2021–22,
line 16 inclusive, the percentages specified in paragraph (2) shall be
line 17 reduced by 0.6-percent increments per one thousand dollars
line 18 ($1,000) of annual household income in excess of one hundred
line 19 thousand dollars ($100,000), to a minimum 10 percent, provided
line 20 that no scholarship award shall be provided to a student with an
line 21 annual household income exceeding one hundred fifty thousand
line 22 dollars ($150,000). Beginning with award calculations for the
line 23 2016–17 academic year, and for subsequent academic years, the
line 24 commission shall annually adjust the income levels specified in
line 25 this subparagraph by the percentage change in the cost of living
line 26 within the meaning of paragraph (1) of subdivision (e) of Section
line 27 8 of Article XIII B of the California Constitution and shall adjust
line 28 the incremental reduction accordingly to ensure that a minimum
line 29 of 10 percent of mandatory systemwide tuition and fees for an
line 30 academic year are awarded. This reduction shall be in addition to
line 31 any reduction required by Section 70023.
line 32 (B)  Notwithstanding subparagraph (A), for each academic year
line 33 from 2013–14 to 2021–22, inclusive, for any student who qualifies
line 34 for a scholarship award of at least one dollar ($1), the minimum
line 35 annual scholarship amount for full-time enrollment is ninety dollars
line 36 ($90).
line 37 (5)  (A)  For the 2014–15, 2015–16, and 2016–17 academic
line 38 years, the maximum amount of a student’s scholarship award shall
line 39 be 35 percent, 50 percent, and 75 percent, respectively, of the total

line 1 scholarship award amount that the student would otherwise be


line 2 eligible to receive.
line 3 (B)  Commencing with the 2022–23 academic year, except as
line 4 provided in subparagraph (D), the maximum amount of a student’s
line 5 scholarship award shall be determined by the percentage
line 6 determined pursuant to subparagraph (C) of the total scholarship
line 7 award amount that the student would otherwise be eligible to
line 8 receive.
line 9 (C)  The commission shall annually determine the percentage
line 10 required for purposes of subparagraph (B) by taking the amount
line 11 appropriated for the purposes of this program for the applicable
line 12 award year, less the amount necessary to fund subparagraph (D),
line 13 and dividing that by the sum of the projected amount computed
line 14 for all eligible students pursuant to subparagraph (B) of paragraph
line 15 (2) for the applicable award year.
line 16 (D)  Commencing with the 2024–25 academic year, a current
line 17 or former foster youth described in paragraph (1) of subdivision
line 18 (a) shall receive a scholarship award in the full amount determined
line 19 in subparagraph (C) of paragraph (2), as adjusted, if applicable,
line 20 in paragraph (2) of subdivision (d).
line 21 (b)  In order for students enrolled in their respective segments
line 22 to remain eligible to receive a scholarship award under this article,
line 23 the University of California and the California State University
line 24 shall not supplant their respective institutional need-based or
line 25 merit-based grants with the funds provided for scholarships under
line 26 this article. The University of California and the California State
line 27 University shall ensure that the amount of institutional student aid
line 28 provided in each academic year beginning with the 2022–23
line 29 academic year is adjusted annually to account for increases in
line 30 systemwide undergraduate enrollment, as applicable, such that the
line 31 proportion of institutional student aid relative to systemwide
line 32 undergraduate enrollment is maintained at a level at least equivalent
line 33 to the level maintained for undergraduate students during the
line 34 2021–22 academic year. The University of California and the
line 35 California State University shall also ensure that at least 33 percent
line 36 of the revenues of an increase to existing mandatory systemwide
line 37 fees charged to undergraduate students is set aside by the regents
line 38 or the trustees, as applicable, for institutional student aid to assist
line 39 resident undergraduate students, including those undergraduate
line 40 students exempt from nonresident tuition pursuant to Sections

line 1 68075.5 and 68130.5, and families in meeting the total cost of
line 2 education.
line 3 (c)  (1)  The University of California and the California State
line 4 University shall report on the implementation of this article as part
line 5 of the report made pursuant to Section 66021.1. At a minimum,
line 6 the report shall add the following information, by parental income
line 7 level or expected family contribution deciles, for the prior academic
line 8 year:
line 9 (A)  The number and percentage of students receiving an award
line 10 under this article and the average dollar amount of that award.
line 11 (B)  The number and percentage of students receiving a student
line 12 loan and the average amount borrowed.
line 13 (2)  The report shall also include the following information by
line 14 campus for the prior academic year:
line 15 (A)  The cost of attendance for undergraduates in each living
line 16 arrangement (on campus, off campus, or at home with parents).
line 17 (B)  The number and percentage of undergraduates in each living
line 18 arrangement (on campus, off campus, or at home with parents).
line 19 (d)  (1)  A Middle Class Scholarship Program award authorized
line 20 pursuant to this article shall be defined as a full-time equivalent
line 21 grant. An award to a part-time student shall be a fraction of a
line 22 full-time grant. For each academic year from 2013–14 to 2021–22,
line 23 inclusive, an award to a part-time student shall be determined by
line 24 the proportionate amount charged for systemwide tuition and fees.
line 25 A part-time student shall not be discriminated against in the
line 26 selection of Middle Class Scholarship Program awards. For
line 27 purposes of this section, “full-time student” and “part-time student”
line 28 have the same meaning as specified in subdivision (f) of Section
line 29 69432.7.
line 30 (2)  Commencing with the 2022–23 academic year, an award to
line 31 a student enrolled in six to eight semester units, inclusive, or the
line 32 equivalent shall be no more than one-half of the award the student
line 33 would have received had the student enrolled full time. An award
line 34 to a student enrolled in 9 to 11 semester units, inclusive, or the
line 35 equivalent shall be no more than three-quarters of the award the
line 36 student would have received had the student enrolled full time.
line 37 SEC. 2. Section 70022.5 of the Education Code is amended to
line 38 read:
line 39 70022.5. (a)  A scholarship award under this article may be
line 40 renewed for a total of the equivalent of four years of full-time

line 1 attendance in an undergraduate program or, for a community


line 2 college award recipient enrolled in upper division coursework of
line 3 a community college baccalaureate program, described in Article
line 4 3 (commencing with Section 78040) of Chapter 1 of Part 48 of
line 5 Division 7, the equivalent of two years of full-time upper division
line 6 coursework attendance in the community college baccalaureate
line 7 degree program. Commencing with the 2016–17 academic year,
line 8 the total number of years of eligibility for grants pursuant to this
line 9 article shall be based on the student’s educational level in the
line 10 student’s course of study as designated by the institution of
line 11 attendance when the recipient initially receives payment for a
line 12 grant.
line 13 (b)  For a student enrolled in an institutionally prescribed
line 14 five-year undergraduate program, a scholarship award under this
line 15 article may be renewed for a total of up to five academic years of
line 16 attendance as long as the student meets the requirements of Section
line 17 70022.
line 18 (c)  A recipient of a scholarship award under this article who
line 19 has completed a baccalaureate degree, and who has been admitted
line 20 to and is enrolled in a program of professional teacher preparation
line 21 at an institution approved by the Commission on Teacher
line 22 Credentialing, is eligible for, but not entitled to, renewal of the
line 23 scholarship award for an additional academic year of full-time
line 24 attendance as long as the student meets the requirements of Section
line 25 70022.
line 26 (d)  A scholarship award under this article for a current or former
line 27 foster youth may be renewed for a total of the equivalent of eight
line 28 years of full-time attendance in an undergraduate program at the
line 29 University of California, the California State University, or the
line 30 California Community Colleges.
line 31 SEC. 3. Section 70023 of the Education Code is amended to
line 32 read:
line 33 70023. (a)  For each academic year, the commission shall
line 34 determine an amount sufficient, when combined with other federal,
line 35 state, or institutionally administered student scholarships, grants,
line 36 or fee waivers received by eligible students from other sources, to
line 37 provide scholarships to eligible students in the amounts described
line 38 in paragraphs (2), (4), and (5) of subdivision (a) of Section 70022.
line 39 The University of California, the California State University, and
line 40 the office of the Chancellor of the California Community Colleges

line 1 shall provide the commission with any financial aid data that are
line 2 necessary for the determination of these amounts.
line 3 (b)  (1)  The commission shall annually determine if the amounts
line 4 appropriated under this section in each fiscal year are sufficient to
line 5 cover the costs of the scholarships as projected to be awarded
line 6 pursuant to the program. If those amounts are not sufficient for
line 7 this purpose, the scholarships shall be reduced proportionately by
line 8 an equal percentage for all recipients of scholarships under this
line 9 article.
line 10 (2)  Notwithstanding paragraph (1), commencing with the
line 11 2022–23 academic year, for any student who qualifies for a
line 12 scholarship award under this article of at least one dollar ($1), the
line 13 minimum annual scholarship amount for full-time enrollment shall
line 14 be ninety dollars ($90).
line 15 (3)  This paragraph subdivision shall not apply to a scholarship
line 16 award under this article for current or former foster youth described
line 17 in paragraph (1) of subdivision (a) of Section 70022.
line 18 (c)  The commission may adopt regulations necessary to carry
line 19 out the purposes of this article under subdivision (b) as emergency
line 20 regulations in accordance with Chapter 3.5 (commencing with
line 21 Section 11340) of Part 1 of Division 3 of Title 2 of the Government
line 22 Code. For purposes of the Administrative Procedure Act, including
line 23 Section 11349.6 of the Government Code, the adoption of those
line 24 regulations shall be deemed to be an emergency and necessary for
line 25 the immediate preservation of the public peace, health and safety,
line 26 or general welfare, notwithstanding subdivision (e) of Section
line 27 11346.1 of the Government Code. Notwithstanding subdivision
line 28 (e) of Section 11346.1 of the Government Code, any regulation
line 29 adopted pursuant to this section shall not remain in effect more
line 30 than 180 days unless the commission complies with all provisions
line 31 of Chapter 3.5 (commencing with Section 11340) of Part 1 of
line 32 Division 3 of Title 2 of the Government Code, as required by
line 33 subdivision (e) of Section 11346.1 of the Government Code.
line 34 (d)  The unencumbered balance, as of June 30 of each fiscal
line 35 year, of the amount appropriated from the Middle Class Scholarship
line 36 Fund pursuant to paragraph (1) of subdivision (e) shall revert to
line 37 the General Fund.
line 38 (e)  (1)  Upon order of the Director of Finance, the following
line 39 amounts shall be transferred from the General Fund to the Middle

line 1 Class Scholarship Fund, and are hereby appropriated to the


line 2 commission for allocation pursuant to this article:
line 3 (A)  For the 2014–15 fiscal year, one hundred seven million
line 4 dollars ($107,000,000).
line 5 (B)  For the 2015–16 fiscal year, eighty-two million dollars
line 6 ($82,000,000).
line 7 (C)  For the 2016–17 fiscal year, seventy-one million two
line 8 hundred forty-four thousand dollars ($71,244,000).
line 9 (D)  For the 2017–18 fiscal year, ninety-nine million nine
line 10 hundred thirty-eight thousand dollars ($99,938,000).
line 11 (E)  For the 2018–19 fiscal year, one hundred four million three
line 12 hundred forty-five thousand dollars ($104,345,000).
line 13 (F)  For the 2019–20 fiscal year, one hundred sixteen million
line 14 five hundred fifty-seven thousand dollars ($116,557,000).
line 15 (G)  For the 2020–21 fiscal year, one hundred fourteen million
line 16 one hundred seventy-one thousand dollars ($114,171,000).
line 17 (H)  For the 2021–22 fiscal year, one hundred nine million nine
line 18 hundred sixty-one thousand dollars ($109,961,000).
line 19 (2)  An annual appropriation to the commission is hereby
line 20 established in the amounts and for the fiscal years described in
line 21 paragraph (1) to carry out the purposes of this section and Section
line 22 70022.
line 23 (3)  Commencing with the 2022–23 fiscal year, the annual
line 24 appropriation to the commission to carry out the purposes of this
line 25 section and Section 70022 shall be determined in the annual Budget
line 26 Act.
line 27 (4)  It is the intent of the Legislature that any savings realized
line 28 from changes made to the allocations under this subdivision by a
line 29 bill providing for appropriations related to the Budget Bill for the
line 30 2015–16 fiscal year shall be used to support higher education.
line 31 (5)  The funds transferred and appropriated pursuant to paragraph
line 32 (1) shall only be available for encumbrance in the fiscal year in
line 33 which they are transferred, and the General Fund shall have no
line 34 liability or any obligation beyond the transfers explicitly authorized
line 35 in paragraph (1) unless a subsequent transfer or allocation is
line 36 required pursuant to statute.
line 37 (6)  In any fiscal year, additional appropriations may be enacted
line 38 pursuant to statute to carry out the purposes of this article.
line 39 (7)  (A)  Beginning with the Governor’s Budget proposal for the
line 40 2014–15 fiscal year, and in the Governor’s Budget for each fiscal

line 1 year thereafter, the Department of Finance shall include a fund


line 2 condition statement for the Middle Class Scholarship Fund for the
line 3 fiscal year of the proposed budget and the two immediately
line 4 preceding fiscal years prepared in accordance with existing law.
line 5 (B)  Upon order of the Director of Finance and for the 2013–14
line 6 to 2021–22 fiscal years, inclusive, if the May Revision projects a
line 7 budget deficit for the next fiscal year, the amount specified in

line 9 projected may be reduced by up to 33 percent.
line 10 (f)  Subject to an appropriation in the annual Budget Act for its
line 11 purposes, the commission may begin implementation of, and
line 12 establish outreach services relating to, this article.
line 13 SEC. 4. Section 70023.5 is added to the Education Code, to
line 14 read:
line 15 70023.5. The commission shall maintain a page on its internet
line 16 website that summarizes the provisions of the Middle Class
line 17 Scholarship Program that apply to current and foster youth
line 18 described in paragraph (1) of subdivision (a) of Section 70022 and
line 19 title these provisions on the internet webpage as “The Fostering
line 20 Futures Program.”
