CLERK OF COURT: For Arraignment, Criminal Case No. 63624 : People of the Philippines versus Klent
Bringuer for the violation of Republic Act 8353 under Article 266-A, par. 1(a), of the Revised Penal Code.
Appearances for prosecution and defense.
Public Prosecutor: Good morning, Your Honor. I am Atty. Anna Lei L. Mazaredo and I am Atty. John Ed
Millapre, entering our appearance as a public prosecutor.
Court Interpreter: Criminal case No. 63624. People of the Philippines vs. Klent Bringuer.
Accused Klent Bringuer commits the crime of RAPE, defined and penalized under Article 266-A,
par. 1(a), of the Revised Penal Code under R.A. 8353, as amended, committed as follows:
That on or about the 15th day of February 2023, in the City of Tanauan, Bartangas Philippines,
and within the jurisdiction of this Honorable Court, the above- named accused, did then and there,
willfully, unlawfully and feloniously by means of force, violence and intimidation, raped the person of
Kayecee Enumerable, by inserting his penis into the complainant's vagina, with the use of force and
threatening the said victim with a knife, which he was holding at the time that she do not agree to
submit herself to his criminal designs.
Contrary to law.
Court Interpreter: The accused pleaded not guilty your honor. Accused, please be seated.
Judge: Let it be on the record that the accused pleaded not guilty for the crime of rape, pursuant to
Article 266-A, par. 1(a), of R.A.8353. The information was read to him in English, a language known and
understood by the accused.
Also, Atty._____________________, the defense counsel of the accused assisted him in this
arraignment.
Prosecutor: Your honor, we would like to set the case for pre-trial today, June 10, 2023 at 5pm.

Judge: In today's trial, the arraignment of Klent Bringuer (accused) In Criminal Case No. 63624 is
conducted. The information is read to him in English a language known and understood by him. Defense
counsel Atty.________________ and Atty _________________ assisted the accused.
The accused pleaded not guilty for the crime charged against him.
No objections both for prosecution and defense, the case is set for pre-trial on June 10, 2023.

JUDGE: Now, will the distinguished counsel of the accused admit the following facts as appearing in the
pre-trial brief of the prosecution:
Prosecutor: The theory of the prosecution is as stated in the information, Your honor.
Prosecutor: We propose that the accused was in Barangay Bagbag Tanauan City Batangas at around
1:45pm - 6:00 in the evening.
Defense: Yes your Honor.
Prosecution: Does the accused admit the time, date place of the incident?
Defense: Yes, Your Honor.
Q: Will the defense admit that there is force and threatening to the complainant by the accused?
DEFENSE: Denied, your Honor.

PROSECUTION: No, your Honor.
JUDGE: Now we proceed to the evidences and witnesses to be presented by both parties. Prosecution
counsel may start.
PROSECUTION: We ask then for the marking of the following exhibits your honor, I have here with me
documentary and object evidences which I move to be marked as Exhibit 1 to Exhibit 5. Your honor,
exhibit 1 is the Screenshot from the messenger of the complainant proving that the accused indeed
threatened her.
JUDGE: Mark it.
PROSECUTION: Exhibit 2, your Honor is the Police Record specifically a sworn statement of the
complainant at Tanauan City Police Station dated May 12, 2023.
JUDGE: Mark it.
PROSECUTION: I will now proceed with Exhibit 3, your Honor which is the Medical Certificate of the
complainant issued by National Bureau of Investigation Batangas after conducting a medical
examination of the victim.
JUDGE: Have it marked
PROSECUTION: For Exhibit 4, your Honor, is the information. This is a sworn, written accusation of a
crime to prove the facts of the raped incident that transpired at Brgy.Bagbag Tanauan City Batangas.
JUDGE: Have It marked.
Prosecution: For Exhibit 5a is the Judicial Affidavit of our first witness, the private complainant herself to
tell what really happened on the day of February 15, 2023.
JUDGE: Have It marked.
PROSECUTION: Another Judicial Affidavit taken from doctor who examine the complainant, Dr. Mark
Lourenz Garcia who is our second witness and is being presented as Exhibit 5b, your Honor to testify on
the Medico legal he issued for the victim in this case. Your Honor, we also respectfully request that the
name and signature of Dr. Mark Lourenz Garcia appearing on the last page of the document be marked
as our "Exhibit 5b".
JUDGE: Have it marked.
PROSECUTION: Exhibit 5C, your Honor is the Judicial Affidavit of our 3rd and last witness, Axcel Pita to
prove that prior to the incident private complainant and three others are at the place of the commission
of crime. Your Honor, we also respectfully request that the name and signature of Axcel Pita appearing
on the last page of the document be marked as our "Exhibit 5c".
3. Dr. Mark Lourenz Garcia he will identify to the court the medical certificate submitted by the
complainant.
DEFENSE: Your Honor, we would like to manifest our reservation for the cross-examinations of the
private complainant and the three witnesses.
