CLARIFICATIONS: IOMCC 2023


CLARIFICATIONS FOR MOOT PROPOSITION :
1. The name of the petitioner is not provided in the given moot proposition. Kindly
provide petitioner's name.
In the aforesaid proposition in para 3 starting " A number of petitions filed....." So as there
is no mention of the name of the Petioners just no. of Petition filed is mentioned so the
present case is of Petioner v. Union of Bharat and Anr. Or we have to specify the Petioners
as (XYZ . etc)
Writ Petition nos. of other petitions that have been clubbed with the primary mentioned
petition.

Ans: Although there are a number of petitions, however the name of the primary petitioner
is Rajesh Bhandari. The writ petition number is W/P No. 12520/2020

2. Are EWS reservations invalid for excluding Scheduled Castes, Scheduled Tribes, Other
Backward Classes, and Socially and Economically Backward Classes from its scope?" Is
the word "Economically" correctly written in this issue?
Last clarification is in the moot proposition issue 3 talks about socially and economically
classes shouldn’t it be socially and educationally backward classes?

Ans : The word Economically to be read as Educationally.

3. As similar case has been already decided on 7th November 2022, so what will be the
locus standi of this case?

Ans: The case is listed on 27 th September 2022 as per the Moot Proposition.

GENERAL CLARIFICATIONS

1. Can we make the memorial in english and present in hindi?

Ans: Yes, that is allowed.

2. Since me and my co-team mates do not know hindi and if the opponent team does their
oral arguments in hindi how should we take over further arguments?

Ans: The draw of lots shall be done in a manner so that hindi speaking teams are kept
against each other. In case that does not happen, a translator shall be provided.

3. Is there quarter finals round or is it directly a semi finals from the preliminary rounds?

Ans: There is a Semi Finals round directly after Prelims.

4. It was mentioned that prelims will be based on pre-recorded videos. Is mail the
preferred method of submission? Can we send the videos in parts as there will be
uploading issues, or should we upload them in one part? Will there be an online session for
the semi-final round, or is it also based on the pre-recorded video sent for the prelims?
Detailed guidelines regarding the submission of the pre-recorded videos (with specific
guidelines for date of submission of video and the file type/format & size of the file
required for the same.
We are willing to know that in which platform the participants are asked to record the
video and where and how to send that pre-recorded video file? Furthermore, in the sub-
point 2 of the mentioned point, you stated, "Both the sides shall be allowed a maximum of

12 Minutes to present their Arguments." So, the pre-recorded video will be of 12 minutes
as we have been allotted the Petitioners Side, right?

Ans: The details capturing uploading of recorded videos shall be sent to all the teams
closer to the event. The semi finals and finals shall be live rounds. Yes, it will be 12
minutes per side.

5. As per the mail allotted side to our team is respondent that is for all rounds same
communicated to us via mail but in the moot court rules it is specifically mentioned that
before every rounds draw of lots will be conducted. So there is an ambiguity. I request to
clear this as well.
We have been allotted Petitioner's Side to prepare for the Memorials. So, we would like to
ask if we need to prepare for the Respondent's side as well? Will our side change in the
further rounds like in Quarterfinals or in the semi-finals if we get qualified or we will only
argue and prepare memorials from Petitioner's side only? There is no need to prepare from
the Respondent's side for the oral rounds as well as for the memorials and our side won't
change in further rounds of the moot, is this the case?

Ans: The allotted side shall continue till the end of the competition. The Memorial for the
other side is not to be prepared. We extend our apologies for this ambiguity.
