EXTRAJUDICIAL SETTLEMENT OF ESTATE

KNOW ALL MEN BY THESE PRESENTS:

This Extrajudicial Settlement of the Intestate Estate of HADJI ESMAIL


PIDAYA BAGUINDA, is made and entered into this __________ day of
_______ 2023, in Manila, Philippines, by and between:

1. JALILAH MUSA BAGUINDA, of legal age, Filipino, Widow, residing


at Block 5 Lot 3, Green Villas 2, Barangay Buhay Na Tubig, Imus,
Cavite;

2. HONEYFAH MUSA BAGUINDA, of legal age, Filipino, married,


residing at Lumil 4118, Silang, Cavite;

3. ALMA BAGUINDA DEROGONGAN, of legal age, Filipino, married,


residing at Block 5 Lot3, Green Villas 2, Barangay Buhay Na Tubig,
Imus, Cavite;

4. BENJAMIN MUSA BAGUINDA, of legal age, Filipino, married,


residing at Decahomes Subdivision, Barangay Dumlog, Talisay City,
Cebu;

5. ABDUL YASSER MUSA BAGUINDA, of legal age, Filipino, married,


residing at Lumil 4118, Silang, Cavite;

6. YASMERAH MUSA BAGUINDA, of legal age, Filipino, Single,


residing at Block 5 Lot3, Green Villas 2, Barangay Buhay Na Tubig,
Imus, Cavite;

WITNESSETH:

1. That we are the legal heirs of the deceased HADJI ESMAIL PIDAYA
BAGUINDA who died on October 31, 2005 at Medical Center,
Parañaque;

2. That the said deceased died intestate, without will and testament, and
without any outstanding debt in favor of any person or entity;

3. That the deceased HADJI ESMAIL PIDAYA BAGUINDA, is the


absolute and registered owner of a parcel of land with Improvements,
located at 2263 South Super Hi-Way, Sta. Ana, Manila, particularly
described, to wit:

TRANSFER CERTIFICATE OF TITLE No. T-259316


A PARCEL OF LAND (Lot 8-B of the subdivision plan (LRC) Psd-9543,
(Sheet 2), being a portion of Lot 8, Sub-Block 8, SWO-6586, LRC (GLRO)
Cad. Record No. 327), situated in the District of Sta. Ana, City of Manila.
Bounded on the NE., along line 1-2 by Lot 8-A of the subdivision plan; on
the SE., along line 2-3 by Lot 10-B of the subdivision plan; on the SW.,
along line 3-4 by Lot 7, Sub-Block 8, SWO-6586; and on the NW., along line
4-1 by Lot 6-B of the subdivision plan. Beginning at a point marked “1” on
plan, being N. 19 deg. 50’W., 722.89 m. from C.B.M. No. 9, City of Manila;
thence S. 27 deg. 44’E., 10.01 m. to point 2; thence S. 64 deg. 32’W., 11.93
m. to point 3; thence N. 25 deg. 28’W., 10.00 m. to point 4; thence N. 64
deg. 32’E., 11.53 m. to the point of beginning; containing an area of ONE
HUNDRED SEVENTEED SQUARE METERS AND THIRTY TWO SQUARE
DECEMITERES (117.32). All points referred to are indicated on the plan
and are marked on the ground as follows: points 1 and 2 by PLS. Cyl. Conc.
Mons. 15 x 60 cm. and the rest by old points; bearing true; declination
____, date of original survey, October 11 to Dec. 22, 1920 and that of the
subdivision survey, Oct. 2 to Dec. 22, 1958.

4. That, in view of the above facts and circumstances, we are therefore co-
owners and to terminate co-ownership over the same, we hereby adjudicate
over the same in pro-indiviso sharing pursuant to Section 1, Rule 74 of the
Rules of Court of the Philippines, subject to the liabilities imposed by
Section 4, of the same rule.
5. That we hereby affirm that we have executed this instrument of our own
free will, without force, intimidation or violence upon our person, and that
we have hereby received our just and proper share and have no more claim

or demand against each other in connection with the adjudication of the
above property.
