CHANDIGARH. Respected Sir, 1. That I am a VICTIM, named SANJAY VERMA S/O SH.
PREM SAGAR VERMA R/O 2A, EKTA VIHAR, MANGWAL, DISTT. SANGRUR have
been cheated and dishonestly deceived by the above mentioned persons for a whooping
amount of Rs. 2,00,00,000/- Two Crores) and the interest @12% per annum as per the
assured scheme as per the agreement. 2. That through this complaint I hereby, submit the
details of the instances and facts, how had I been trapped in their malicious intentions of
cheating me. was contacted by the Mr. Anupam Gupta of M/s Gupta Builders Promoters, in
2016.They offered me lucrative proposals for their upcoming project situated at Mouja
Ramgarh Budha, Zirakpur by the name of Tower Meadows at ATHENS-1. 3. That During
the meeting they placed some presentations before me and explained that they are coming
with this Commercial Spaces Project and are selling Commercial Studios with 12% Assured
Return Schemes till the possession of the unit is given.4 That they convinced me that the
Developer namely, M/s Gupta Builder Promoters Pvt. Ltd. and their Managing Director
namely, Mr. Satish Gupta, Director, Pradeep Kumar Director, Anupam Gupta are lawfully
entitled to sell the said commercial spaces and this land is earmarked i.e. designated for the
purpose of developing Commercial Spaces. 5. That the Developer, M/s Gupta Builders
Promoters Pvt. Ltd. assured me that the title of the said property upon that this Commercial
Project is being raised has CLEAR OWNERSAIP TITLE. That the Developer assured me
that they are having all the necessary planning and constructions permissions is nothing but
Deception. The accused must be punished under Section 420 IPC, 1860. The Section 420
IPC,1860 is reproduced below for ready reference:- 420. Cheating and dishonestly inducing
delivery of propertyWhoever cheats and thereby dishonestly induces the person deceived to
deliver any property to any person, or to make, alter or destroy the whole or any part of a
valuable security, or anything which is signed or seale and which s capable of being converted
into a valuable security, shall be punished with imprisonment of either description for a term
which many extend to seven years, and shall also be liable to fine 6. That on affirm assurances
and guarantee given by Mr. Satsh Gupta, Managing Director, Mr, Pradeep Kumar Mr.
Anupam Gupta, Directors of GBP, 1, Sanjay Vema got influenced by their offers for a secured
life time income and agreed to buy three flats no. 1105, 1012, 1013 in their upcoming Tower
Meadows project ATHENS-1 situated at Mouja Ramgarh Budha, Zirakpur,7. That on
18.03.2016, 12.04.2018, 20.03.2019 05.09.2020, M/s Gupta Builders Promoters Pvt. Ltd.
through ite Managing Director, Satish Gupta, Directors, Pradeep Kumar ANupam Gupta
entered into agreement for sale with me that SANJAY VERMA S/O SH. PREM SAGAR
VERMA R/O 2A, EKTA VIHAR, MANGWAL, DISTT. SANGRUR is buying Flat no. 1105
on 11 floor Flats no. 1012, 1013 on 4 floor in the Tower Meadowws Project at ATHENS-1
Situuted at Mouja Ramgarh Budha, Zirakpur. The Agreement was duly signed by me and the
Authorized the Signatory of the company as parties to the Agreement. That the as per the
first agreement dated 18.03.2016, the assured return was assured to be given @24% per
annum to me by them. Further, the rate of assured returns @2.3% per month in the 2 and 3
agreements dated 12.04.2018 20.03.2019 and they allured and trapped me to do huge
investments. In the final agreement dated 05.09.2020, the rate of interest was slashed down to
12% per annum and I had no other choice except to enter into it as a huge amount of mine
was at stake, and T had to accept each and every condition imposed upon me by them. 8.
That I had paid a whooping amount of Rs. 2,00,00,000/- to M/s Gupta Builders Promoters
Pvt. Ltd. as full and final consideration on the pretext of falsified project falsified Assured
Return Scheme. The details of the payments made by me to GBP are as below:1) Rupees
5,00,000/- vide Cheque No. 000027 dated 01.04.2017 (admitted by the other party).2) Rupees
5,00,000/- vide Cheque No. 000028 dated 01.04.2017 (admitted by the other party).3) Rupees
5,00,000/- vide Cheque No. 000029 dated 01.04.2017 (admitted by the other party).4) Rupees
5,00,000/- vide Cheque No. 000030 dated 01.04.2017 (admitted by the other party).5) Rupees
83,00,000/- vide Cheque No. 458077 dated 15.03.2018 (admitted by the other party)6) Rupees
26,00,000/- vide Cheque No. 061284 dated 15.03.2018 (admitted by the other party).7) Rupees

year 2020, I came to know from the reliable sources that M/s Gupta Builders Promoters Pvt.
Ltd. has not got the clear title of the land on which the project is located as a huge loan was
taken which has not been repaid by the Promoter Company. They do not possess any
approval from the Chief Town Planner, whatsoever as per the Revenue Record.10. That as
per the Agreement of Sale dated 05.09.2020, the payments of Assured Returns by way of
interest @12% were to be made on monthly basis. That those were given in the shape of
advanced security cheques, and these cheques were not presented for clearing as per the
instructions of the Promoter Company due to insufficient funds in their account, the details of
the cheques are given in the agreement by the promoter company.11. That the construction of
the project started in the year 2016 only, and as per the latest construction update as shown in
the photographs uploaded by the Promoter Company on their official Facebook handle when
compared with the Stage of the Project as shown in their brochure, clearly shows that thee
completion of the Project is a far distant dream and it will take at least another 5 yearS for
completion in all aspects. The large amount of money has been grabbed by the accused from
innocent people by the way of false promises of delivering units without doing any
development work and large amount has been grabbed by way of taking L0ans from the
banks. 12. That Promoter Company without having any legitimate right on the said land
provided false information to the people to mislead and cheat them with mala-fide intentions
to grab loot the hard earned money, in fact it is illegal exaction of money.13. That I was
shocked to know these facts and was mentally perturbed. perurbed. I tried to contact the Mr.
Anupam Gupta, one of the Directors of the promoter Company but to no avail and to my
utter dismay. I repeatedly went to ther offices but they kept on making one or the other lame
excuses and started avoiding me and the person present in the office told me that their
directors are not available in the city. 14. That this is a clear case of fraud, cheat, loot,
criminal breach of trust and dishonest inducement to deceive to grab the hard earned money.
That a large amount of money has been grabbed by the accused from the innocent people by
way of false assurances that they have ample investment options. The Accused have
misappropriated the hard earned money entrusted by me and many more innocent people for
their own use and purpose. It is therefore, humbly requested that Directions may be issued
to the officer in charge of the concerned police station to register FIR against the accused
mentioned under sections 120-B, 403, 406, 420, 418, 467, 468, 471 of INDIAN PENAL CODE
1860 AS WELL AS OTHER RELEVANT SECTIONS in the interest of justice, equity and
fair play. It is further requested that the directions may be issued to the concerned police
