Billing Authorization

I represent and warrant that if I am purchasing something or paying for a service from this facility or from
other merchants through this facility that (i) any credit card or bank account draft (ACH Draft) information I
supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or
financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any
applicable taxes, fees, and penalties.

I hereby authorize (if online payment is made or autopay information is provided) this facility to charge my
ACH draft, or credit card account. I understand that a 30 day written notice is required to terminate billing
and I am responsible for payment whether or not my student attends classes until I notify this
facility in writing to drop my student from class(es).

Should I dispute a charge through my financial institution this will constitute a breach of contract possibly
resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any
and/or all current and future services.

Release Waiver

DISCLAIMER: Texas Crush Athletics Inc.,(“Texas Crush Athletics Inc.”) is not responsible for any injury (or
loss of property) to any person while practicing, training, taking class, competing, participating in open gym,
special events, demonstrations or shows, or in any other way involved in gymnastics, cheerleading, or
teams (the “activity”) at Texas Crush Athletics Inc. for any reason whatsoever, including ordinary negligence
on the part of Texas Crush Athletics Inc., its members, managers, agents, or employees.

CONSENT: I consent to my/minor’s participation in the activity and acknowledge that I fully understand
my/minor’s participation may involve risk of serious injury, illness, or death, including losses which may
result not only from my/minor’s own actions, inactions or negligence, but also from the actions, inactions, or
negligence of others, the condition of the facilities, equipment, or areas where the activity is being
conducted, and/or the rules of play of this type of activity. I understand that if I have any risk concerns, I
shall discuss them completely with the staff before I sign this agreement and before my/minor’s participation
in the activity begins.

Knowing and understanding the risks involved with participation in the activity, I hereby voluntarily and
willingly assume full and complete responsibility for all losses and damages, including injury, illness, and
death, resulting from my/minor’s participation in the activity, including transportation to and from the activity.
I agree I am financially responsible for any losses and damages resulting from my/minor’s participation in
the activity.

WAIVER: In consideration for my/minor’s participation in the activity, I hereby waive all claims or causes of

action, including ordinary negligence, against Texas Crush Athletics Inc., its managers and members, and
any of their employees, teachers, coaches, or agents, arising out of my/minor’s participation in the activity
wherever, whenever or however the same may occur.

I understand that this waiver is intended to be as broad and as inclusive as permitted by the laws of the
State of Texas and agree that if any portion is held invalid, the remainder of the waiver will continue in full
legal force and effect. I further agree that the venue for any legal proceedings shall be within the State of
Texas. I have read this form and fully understand that by signing this form, I am giving up legal rights and or
remedies which may be available to me/minor for the ordinary negligence of Texas Crush Athletics Inc. or
any person listed above.

PHOTO & VIDEO RELEASE: I grant consent for my/minor’s picture to be taken or to be filmed while
participating in activities at Texas Crush Athletics Inc.. I authorize Texas Crush Athletics Inc. to use and
publish images, photographs, pictures, portraits, and audio, video and/or film footage of me/minor in all
forms of media and in all manner for publication including, but not limited to, advertising and marketing
campaigns, press releases, periodicals, and website use. I hereby waive any right I may have to review,
inspect, edit or approve such publication and I release Texas Crush Athletics Inc. from any claims I may
have against it for use of such images, photographs, pictures, portraits, and audio, video and/or film footage
of me.

I affirm that I am of legal age and am freely signing this agreement.

Rules, Terms and Conditions

ANNIVERSARY FEE
All Students will be charged an anniversary fee. This fee is good for one year or until you drop out of the
program.

ENROLLMENT: Enrollment is ongoing. You may enroll as you wish and un-enroll by the 24th of each
month, make-ups do not carry over once you have un-enrolled. You may make changes to
day/time/program anytime through the front desk.

You may enroll up to 10 days prior to your desired start date. We are unable to hold spots in advance. You
are financially responsible for your class enrollment(s) UNTIL YOU FORMALLY UN-ENROLL.

UNEROLLMENT: Must be submitted by email [email protected] or via the parent portal.


Please include the student's name, program, your desired last class date and any feedback.

Please note: You are responsible for payment for your student's classes WHETHER OR NOT YOUR
STUDENT ATTENDS CLASS until the time you notify the staff VIA WRITTEN NOTICE. Please do not rely
on your student to verbally let us know that he/she will no longer be attending classes. If a student stops
coming to class without notification then that student's account will be charged for the additional 30 days.
This charge will be for holding the student's place in that class instead of offering that place to one of the
many on a waiting list.

We do not credit or refund for past missed classes.

Please un-enroll before the 24th of the month.

*Competitive Team Members are subject to terms of their individual team commitment forms and
competition fees. See your coach or team agreement for details.

TUITION: Tuition is prorated based on your start date. We accept all major credit and debit cards.
Participation requires that you create an online account with a card on file. Tuition is auto-debited on the
25th of every month preceding the activity. (example: tuition for March will be auto-debited on February
25th).

Customers have until the 5th day of each month to pay the balance due on their account via cash, check,
etc. All amounts remaining due on the 6th day of the month will be charged to the credit/debit card on file for
the account unless the 6th falls on a non-business day.

Then, the card on file will be charged on the next business day. Any accounts with a balance due after the
6th day of the month will automatically be charged a $25.00 late fee, and the athlete(s) associated with the
account may be withheld from participating in activities at “TCA”. This includes accounts in which the
credit/debit card transaction is declined. Tuition is auto-debited for as long as you are actively enrolled. IT
IS YOUR RESPONSIBILITY TO UN-ENROLL TO STOP THE AUTO-DEBITING PROCESS.

To avoid an auto-debit on your credit card, simply pay your tuition prior to the 25th of the month through
your parent portal account or at the front desk. WE APOLOGIZE, THERE ARE NO CREDITS OR
REFUNDS FOR MISSED CLASSES.

Tuition remains the same for every month of the year. Your tuition pays for an educational experience and not a specified number of classes. In any given year,
some months have four classes and some months have five classes. On occasion, there will be a month with three classes for one reason or another. Over a year,
typically the average is slightly over four classes per month. We make no distinction between long months and short months and we ask you to do the same.

TUITION DISCOUNTS:

Sibling Discount: Only ONE tuition in your family pays full price. All lesser tuition amounts in your family
are discounted a full 10%.

Multiple Class Discount: A student who is enrolled in more than one class will receive a $10 discount on
their 2nd class, $20 discount on their 3rd class and so fourth.

MAKE-UPS:

We seek to be liberal and offer make-ups whenever possible, however, we cannot guarantee make-ups in
all classes in all programs at all times of the year.

A STUDENT MUST BE ACTIVELY ENROLLED to be eligible for a make-up class.

You may request to schedule a make-up anytime within 7 days of your desired make-up date.

The eligibility for a make-up token expires 45 days after the missed class.

WE APOLOGIZE - THERE ARE NO CREDITS OR REFUNDS FOR MISSED CLASSES.

RECREATIONAL CLASS BREAKS AND OTHER CLOSURES: We will not hold instructional classes
during the below Instructional Break Weeks. All months average 4 weeks of classes. We do not charge
more or less for longer or shorter months. Months with 5 classes make up for months with 3 classes due to
Break Weeks.

NO MAKE-UPS OR CREDITS WILL BE ISSUED FOR BREAK WEEKS.

WHAT TO WEAR:
Boys or Girls may wear tucked in T-shirts and shorts OR Leotards for Girls. NO chewing gum or dangling

jewelry. Hair should be pulled neatly and securely away from the face so that is stays up for the entire
workout. Girls should not wear bows or other large hair ornaments that may cause discomfort during
activity. All students should have activity-appropriate footwear during class. Personal items should be left in
cubby holes. Jewelry should not be worn during classes. PLEASE LEAVE JEWELRY ARTICLES AT
HOME. This facility's staff will not be responsible for ANY items that may be lost or stolen. Be sure your
student's personal items are marked with their name.

ARRIVAL AND PICKUP:


Be sure your student arrives 5 minutes before (no earlier please) his/her scheduled class time. Please pick
up your student on time. Please inform us if you know you will be late picking up your student. Instruct your
student to wait inside the building and you should escort them from the building to your car. During peak
times the parking lot is crowded. Please take into consideration that our students may include young
children. Please drive slowly and carefully. Do not take a chance on your student running to and from your
car.
