Labor Laws

The Sindh Factories Act, 2015.

S.3: Reference to time of day.

● The Act refers to Standard Time which is 5 hours ahead of Greenwich Mean Time.
● The government can make rules for any area where Standard Time is usually observed.
● These rules can specify the area, define the local mean time observed there, and permit
such time to be observed in factories in the area.

Chapter IV : Restrictions on working hours of Adults.

S.54: Weekly hours.

● Adult workers in a factory cannot work for more than 48 hours per week.
● For seasonal factories, the limit is 50 hours per week.
● If a factory's technical requirements demand continuous work throughout the day, an
adult worker can work up to 56 hours in a week.

S.55: Weekly holiday.

● Adult workers cannot be required to work in a factory on a Sunday unless certain

conditions are met.
● These conditions include having a whole day off on one of the three days immediately
before or after that Sunday and a manager's notice delivered to the Inspector's office and
displayed in the factory.
● The substitution of days cannot result in a worker working for more than ten consecutive
days without a whole day off.
● Notice given under this section can be cancelled before the Sunday or holiday to be
cancelled, whichever is earlier.
● If a worker works on a Sunday in accordance with the provisions, that Sunday is included
in the preceding week's weekly hours of work for calculation purposes.
S.56: Compensatory holidays.

● If a factory or its workers are exempted under any provision of this act that mandates
weekly holidays, and a worker loses those holidays, they must be given an equal number
of compensatory holidays as soon as possible.
● The government can create rules to determine how these holidays should be granted.

S.57: Daily hours

● Adult workers in a factory can work up to 9 hours per day, including breaks.
● It is not allowed or required for them to work more than 9 hours.
● Male adult workers in seasonal factories may work up to 10 hours per day.

Chapter V : Holiday with Pay.

S.73: Annual holidays.

● Workers in factories who complete 12 months of continuous service are entitled to 14

consecutive days of holidays during the following 12 months.
● Unused holidays from the previous year can be carried forward, but the total number of
carried-over holidays cannot exceed 14.
● If a worker is discharged or quits before taking their entitled holidays, the employer must
pay them the amount payable under section 74.
● Interruptions due to sickness, accident, authorized leave (not exceeding 90 days), a
lock-out, a non-illegal strike, or intermittent periods of involuntary unemployment (not
exceeding 30 days) do not break a worker's 12-month period of continuous service.

S.74: Pay during annual holiday.

● Workers entitled to holidays under section 73 will be paid a rate equivalent to the daily
average of their wages for the days they actually worked during the preceding three
months, excluding any earnings from overtime.
● The worker's entitlement to holidays under section 55(1) is separate from this and is not
affected.
S.79: Casual leave and sick leave.

● Workers are entitled to 10 days of casual leave per year with full pay.
● Workers are entitled to 16 days of sick leave per year with full pay.
● Female workers are entitled to maternity leave as defined in the Maternity Benefits
Ordinance, 1958.

S.80: Festival Holidays.

1. Workers are entitled to holidays with pay on all days declared by the government or
federal government to be festival holidays.
2. If a worker is required to work on a festival holiday, they are entitled to one additional
compensatory holiday with full pay and a substitute holiday according to the provisions
of section 55.
