The Governor of Punjab, in exercise of the powers conferred upon


him under section 4 of “The Lotteries (Regulations) Act 1998” read with rule 3 of
“The Lotteries (Regulations) Rules 2010” and all other powers enabling him in
this behalf , is pleased to promulgate the following scheme to conduct a Bumper
lottery scheme in the State viz:
1. THE NAME OF THE SCHEME AND THE LOTTERY
The Scheme shall be called the “Punjab State Rakhi Bumper 2019” and the
lotteries under this scheme shall be marketed in the State of Punjab only.

2 NUMBER OF TICKETS
The scheme shall have Twenty Lakh lottery tickets with series A and B, series
numbering from 000000 to 999999 each.

3. TICKET PRICE
The MRP of a single ticket shall be Rs 200/-.( Rupees Two hundred only) (MRP
shall be Inclusive of all taxes).

4 PRIZE STRUCTURE OF THE SCHEME


The detail of Prizes for Winners and Promoter Prizes for Agents, Sub-agents and
Sellers shall be as under:-

5 METHOD OF DRAW
The following prizes shall be given on the basis of the draw, to be conducted by
Directorate of Punjab State Lotteries in accordance with the method prescribed
against each prize.
1st Prize 2 Rs.One Two complete numbers shall be drawn

un-sold ticket, the machine shall be re-
operated till the prize is drawn from sold
tickets.
2nd 5 Rs. Ten lakh Five numbers of six digit shall be drawn
each with series.
3rd 10 Rs. Five Lac Ten numbers of six digit shall be drawn
each . with series.
4th 20 Rs. One lakh Ten numbers of six digit shall be drawn
each without series. (Common to both series).
5th 20 Rs. Fifty Ten numbers of six digit shall be drawn

6 DATE TIME AND VENUE OF THE DRAW
The draw shall be held on 03rd September - 2019 (Tuesday) at Ludhiana. In
exceptional circumstance with the prior approval of the Department the said
date of draw and venue can be changed. The Director Lotteries shall decide the
time and venue of the draw.
7 COMMISSION /INCENTIVES TO BE PAID IN SALE OF TICKETS
(a) Commission of Rs. 37.00 (Rs. Thirty Seven Only) per ticket shall be given
to the agent on the ticket sold. Any commission due shall be paid to the
distributor(s) or selling agents out of the money so deposited in the Public
Ledger Account or in the Consolidated Fund of the State other depositing 100%
payment of the sale proceeds i.e (MRP-GST) through Bank draft/Cyber Treasury
Portal (CTP). TDS etc. shall be deducted at source while making payment of
commission etc.
(b) Presently the Central Govt. has introduced GST on lotteries and the same
shall be paid by the Distributor on reverse charge basis as per Notifications
issued by Govt. of India. As per Notification Number 11/2017-Central Tax-(Rate)
dated 28th June 2017 issued by the Government of India, Ministry of Finance
(Department of Revenue) the GST will be calculated on face value or price
notified by State whichever is higher as that price includes the amount of GST.
(c) Further any other tax on lotteries imposed by the Central Government/
State Government from time to time shall be borne by the distributor/ selling
agent as decided.
(d) There shall be a promoter coupon worth Rs. 300/- each in bundle of 20
tickets. The sellers shall be given Rs. 300/- on sale of 20 tickets on surrendering /
submitting of the Promoter Coupon. However, this amount of Rs. 300/- shall not
be given / available, if the seller is getting promoter incentive amount on the
basis of a prize winning tickets from that bundle. If there are more than one prize
on one Prize Winning Ticket then the seller shall only be entitled the highest
available incentive.
(e) Similarly in case of Agents and Sub Agents, if there is more than one prize
on one Prize Winning Ticket then the Agents and Sub Agents shall only be
entitled the highest available incentive.
8 PROCEDURE FOR ISSUE OF TICKETS AND DEPOSIT OF SALE
PROCEEDS.
Government has signed the Agreement with Following
Distributors/ Agents to sell the lottery Tickets of this scheme:
1) Skill Loto Solutions Pvt. Ltd, Ludhiana,1554, Sant Dass Street,
Clock Tower Ludhioana-141008.
2) M/s Teesta Distributors 1322, Rajinder Nagar, Near Kailash
Cinema Chowk, Civil Lines, Ludhiana-141001.
i) Any Distributor(s)/Selling Agent(s) for this Lottery scheme shall be
appointed subject to the condition that they shall have to ensure the sale of at
least 3,50,000 (Three lakh fifty thousand only ) tickets in first instance , in case
there is a single Distributor/ Selling Agent. If there are two agents the limit of
minimum tickets for each Distributor/agent shall be 1,75,000( One lakh eventy
five thousand only) tickets in first instance and in case there are more than two
distributors/agents the minimum limit of lifting the ticket shall be 1,20,000 (one
lakh twenty thousand) tickets in first instance for each distributor/agent.
The department may also appoint more Distributors/ Agents, who shall
be required to sell at least one lac twenty thousand tickets in the first instance or
as decided by the Department. An agreement shall be executed by the
Directorate of Lotteries with the Distributor/Selling Agent and the department
shall obtain an agreement signing fee of Rs 10 lac (Rupees Ten lacs) from the
distributor/selling agent in the shape of D.D. in favour of Director, Punjab State
Lotteries payable at Chandigarh, which shall be adjusted at the time of lifting of
tickets by them and in case the distributor/selling agent fails to lift tickets, this
amount of Rs. 10 lac shall be forfeited.
However, considering the market situation and in the best interest of the
state and to increase the sale of tickets, the Department may, if deemed
appropriate, may increase or decrease this minimum limit of tickets. In order to
promote the sale of tickets and in Public Interest, the Department can work out
distribution and sale of tickets directly or through District Small Saving Officer,
District Small Saving agents or Post Offices in Punjab or any other Department,
Semi Government entity, Corporation or Board etc., by offering different rate of
commission /promoter coupons and specifying different minimum limits (if
any) for lifting of tickets and other suitable terms, to be decided by the
Department. The delivery of tickets shall be given at Ludhiana. The expenditure
on sending tickets by post/courier service if demanded by any Agent shall have
to be borne by the concerned distributor/agent.

ii) The Distributor/Selling Agent shell get delivery of tickets by making 100%
payment for the value of issued tickets in shape of Bank Draft i.e Rs. 178.57 (
MRP- GST) and shall also submit the receipt for amount deposited as GST for
sold tickets within 7 days of depositing the GST on Punjab State Lottery Scheme.

Or
The distributor/selling agents shall get delivery of tickets on following
payment terms: -
a. Payment of at least 25% of the value of issued tickets @ Rs 178.57 (MRP-
GST) in shape of Bank Drafts; and
b. 75% by furnishing security in the shape of Bank Guarantee / FDR etc.
mortgaged/ pledged in favor of the Director, Punjab State Lotteries,
Chandigarh. Validity of the bank Guarantee / FDRs should remain valid
for sufficient period.
However the balance payment of 75% value of sold tickets subject to
minimum specified limit as per clause 8(i), as on the date of draw, if any, has to
be paid on or before the date of draw, itself through Demand Draft.
Distributor/Selling Agent has to submit the receipt for amount deposited
as GST in the Office of Directorate Punjab State Lotteries within 7 days of
depositing the GST on Punjab State Lottery Scheme.
(iii) The tickets shall not be issued to the Distributor/Selling Agents if they fail to
settle the accounts of any previous lottery scheme within stipulated period.
(iv) The request for sending the ticket by post as received in Directorate of Punjab
State Lotteries shall not be entertained and the tickets shall not be dispatched to
the individual customer from Directorate of Punjab State Lotteries.

(v) The tickets shall be issued to the selling agents/distributor as per the procedure
laid down in condition 8(ii) above. Any amount paid less by the
distributor/agent, or any delay in submission of receipt of amount deposited as
GST shall be charged interest @18% p.a, for the delayed period.
9 UNSOLD TICKETS
The distributor/selling agent shall submit the list of unsold tickets, in
shape of hard copy and soft copy, subject to the minimum tickets prescribed [in
para 8(i)] here to be lifted in the first instance, in the office of Directorate of
Lotteries up to 12.00 noon on the date of draw and no list of unsold tickets would
be entertained by the office after scheduled time. The signed list of unsold tickets
can be sent through registered post or through special messenger or email but
this Department shall not be responsible for any postal delay.
10 PAYMENT OF PRIZES/ INCENTIVES TO PRIZE
WINNERS/DISTRIBUTOR/AGENTS
(i) All the prize winning tickets above Rs. 5,000/- should reach the office of the
Director, Punjab State Lotteries, Vit Te Yojna Bhawan , Plot No. 2-B , Sector 33 A,
Chandigarh-160020 on the prescribed form within 30 days from the date of
publication of the result in the Punjab State Government gazette either
personally or through a nationalized bank or by registered post or by insured
parcel.

(ii.) Sellers’ and Sub- Agents’ promoter incentive up to Rs. 1,000/- should be claimed
from the Distributor(s)/Selling Agent(s) within 30 days from the date of
publication of the result in the Punjab State Government Gazette and the
promoters prizes above Rs. 1,000/- should be claimed directly from the Director,
Punjab State Lotteries Vit Te Yojna Bhawan, Plot No. 2-B , Sector 33 A,
Chandigarh-160020 within 30 days from the date of publication of the result in
the Punjab State Government gazette. The Distributor/ Agent(s) promoter
incentive may be claimed from the Director Punjab State Lotteries directly. TDS
shall be deducted at source while making payment of such incentive(s).

(iii) In case the prize winners' claim does not reach this Directorate within 30 days,
the right of the winner to claim the prize/amount thereafter shall be
extinguished in accordance with the Punjab State Lotteries Rules 2015. The
Director or the State Government, as the case may be, may in exceptional
circumstances and on sufficient cause being shown, condone the delay in
submission of claim after the prescribed 30 days in accordance with the rules
ibid. Distributor/Agents are authorized to make the payment of
prizes/incentives below the aforesaid limit and seek reimbursement from office
within 90 days from the date of publication of the result in the Punjab State
Government gazette.

11 LEGAL JURISDICTION
The legal jurisdiction of this lottery shall be only at Chandigarh.
12 OTHER IMPORTANT CONDITIONS OF THE SCHEME
i.) The draw for the prizes shall be held out of the total scheme. However, the draw
of first prize(s) shall be out of sold tickets only.
ii.) Income Tax on prizes / incentive(s) to sellers etc., wherever applicable, shall be
deducted at source irrespective of the fact whether the prize goes to the winners,
distributor(s)/selling agent(s) or seller(s).
iii) Promotional publicity shall be done through the Directorate Public Relation
Department Punjab , Chandigarh on the DAVP/DPR rates through the mode of
T.V., Radio, newspapers, banners, hoardings etc. Therefore, a provision of Rs
50.00 lacs (Rupees Fifty lacs only) is made for advertising through T.V, Radio,
Newspapers and hoardings etc. and Rs. 15.00 lacs (Rupees fifteen lacs only) for
printing of tickets, coupons etc. Distributors/Agents may be allowed to make
publicity through banners and cassettes, the rates/criteria of which shall be
approved by the Designated Authority.
iv) GST imposed by the Government of India on Lotteries shall be borne by the
Distributor/ Selling Agent.
v) Distributor(s)/Selling Agent(s)/ Sub Agents and sellers are advised to check the
correctness of the printing and numbering of the tickets before selling and buyers
should also check the same before purchasing tickets. Defective tickets should
not be sold to the public, but should immediately be returned to the issuing
authority
vi). A ticket, which is forged, torn out, mutilated or tampered with shall not be
entertained.
vii). Prize shall be paid on the production of original tickets only.
viii) Prize winning tickets holders abroad shall be paid in Indian currency as per
scheme.
ix) One ticket/coupon shall be eligible to only one prize/incentive viz. The highest
prize/incentive drawn against it.
x). In case of any dispute, the decision of the Principal Secretary to the Government
of Punjab, department of Finance shall be final and binding.
xi) Before submitting the claim, results may be Checked with the Punjab State
Government Gazette.
xii) The request for sending the tickets by post as received in the office shall not be
entertained and the tickets shall not be dispatched to the individual customers
from office.
xiii) The provisions of ‘The Lotteries (Regulation) Act 1998‘ and ‘The Lotteries
(Regulations) Rules, 2010 and Punjab State Lotteries Rules 2015 shall be
applicable.
13 AMENDMENTS TO THE SCHEME
The Government of Punjab may at any time amended/ delete/ modify/ relax
any of the provisions of the Scheme under the orders of the Principal Secretary
Finance; Government of Punjab in exceptional circumstances without assigning
any reasons(s).

Note : If any prize out of first six prizes falls from the sale made by concerned offices
then an incentive shall be paid to the concerned office , after deducting the tax as
applicable. Concerned Office shall file a claim for claiming the Incentive.

4 COMMISSION /INCENTIVES TO BE PAID IN SALE OF TICKETS

(a) Commission shall be given to the Department of Post / Department of


Governance Reforms or any other Government or Semi Government
Department to sell the tickets, on the basis of ticket sold as follows:

Single rate of Commission shall be paid on all the tickets sold @ as shown in
above table. Department of Post Office / Department of Governance Reforms
/any other Department shall pay taxes, levies, etc, as may be applicable from
time to time. Presently the Central Govt. has introduced GST on lotteries and
the same shall be paid by the Department of Post Office/ Department of
Governance Reforms/ any other Department as per Notifications issued by
Govt. of India. Further any other tax on Lotteries imposed by the Central
Government/ State Government from time to time shall be borne by the
Department of Post Office/Department of Governance Reforms/ any other
Department or as decided by the Government.

(b) There shall be no promoter coupon with the tickets issued to Department of Post
/ Department of Governance Reforms/ any other Department.

5 PROCEDURE FOR ISSUE OF TICKETS AND RETURN OF UNSOLD


TICKETS

i) The Directorate of Punjab State Lotteries shall deliver the tickets at its own cost at
the Head Post Offices within the State of Punjab. However the delivery of tickets
to Post/Sub Post / Branch Offices/Kendras under the Head Offices shall be
managed by the Department of Posts / Department of Governance Reforms/
any other Department at their own cost.
ii) Office of Chief Post Master General and Department of Governance Reforms or
any other Department shall work as a wing of Government and being as a
Central/State Government Organization, the Office of Chief Post Master General
and Department of Governance Reforms or any other Department shall deposit
the value of sold tickets @ [ value of ticket (178.57) - commission amount, as
shown in table 4(a) ] per ticket to the Directorate of Lotteries Punjab on or before
the date of draw in shape of Demand Draft/Cyber Treasury Portal. Office of
Chief Post Master General and Department of Governance Reforms or any other
Department will deposit the receipt of amount deposited as GST for the value
sold out tickets.

(iii) Directorate of Lotteries Punjab shall provide publicity material such as posters
and/or banners etc. to the post offices for the publicity of sale of tickets of
scheme through Post offices/Sewa Kendras / any other Department at their own
cost and distribute this material in post offices of Punjab. Promotional publicity
shall be got done through the Directorate Public Relation Department Punjab ,
Chandigarh on the DAVP/DPR rates through the mode of T.V., Radio,
newspapers, banners, hoardings etc. Therefore, an additional provision of Rs
10.00 lacs (Rupees Ten lakhs only) is made for publicity for sale of tickets
through post offices.
(iv) The Department of Post and Department of Governance Reforms/ any other
Department shall return the unsold tickets within one month from the date of
draw.

(v) No advance / security shall be paid by the Department of Post and Department
of Governance Reforms and any other Department in lieu of tickets issued being
a Central/State Government Organization.

6 UNSOLD TICKETS

The Department of Post , Department of Governance Reforms and any other


Department shall submit the list of unsold tickets, in the office of Director,
Lotteries up-to 5.00 PM one day before the date of draw and no list of unsold
tickets would be entertained by the office after scheduled time. The signed
consolidated list of unsold tickets from all the post offices of Punjab shall be
obtained from Chief Post Master General Office both in hard copy and soft copy
or through email and similarly a signed consolidated list from Department of
Governance Reforms shall be obtained.

7 OTHER IMPORTANT CONDITIONS OF THE SCHEME

i.) The draw for the prizes shall be held out of the total scheme. However, the draw
of first prize(s) shall be out of sold tickets only.

ii.) The department of Post, Department of Governance Reforms and any other
Department shall make the payment of prizes up to Rs. 5,000/- on behalf of the
State Government within 30 days from the date of publication of the result in the
Punjab Government Gazette and seek reimbursement, if any, within a period of
ninety days from the date of draw, provided this time can be extended by the
Director , Punjab State Lotteries with the prior approval of the State Government.
All the prize winning tickets above Rs. 5,000/- should reach the office of the
Director, Punjab State Lotteries, Vit Te Yojna Bhawan , Plot No. 2-B , Sector 33 A,
Chandigarh 160020 on the prescribed form within 30 days from the date of
publication of the result in the Punjab State Government gazette either
personally or through a nationalized bank or by registered post or by insured
parcel. In case the prizewinners claim does not reach this Directorate within 30
days, the right of the winner to claim the prize/amount thereafter shall be
extinguished.
iii). Income Tax on prizes / incentive(s) to sellers etc., wherever applicable, shall be
deducted at source irrespective of the fact whether the prize goes to the winners,
distributor(s)/selling agent(s) or seller(s).
iv). A ticket, which is forged, torn out, mutilated or tampered with shall not be
entertained.

v) It is advised to check the correctness of printing and numbering of the tickets


before selling and buyer should also check the same before purchasing the ticket.
Defective tickets should not be sold to the public, but should immediately be
returned to the issuing authority.

v). Prize winning tickets holders abroad shall be paid in Indian currency.

vi). The legal jurisdiction of this lottery shall be only at Chandigarh.

vii). One ticket shall be eligible to only one incentive viz. The highest prize drawn
against it. In that case the number of prizes shall reduce accordingly.

viii) In case of any dispute, the decision of the Principal Secretary to the Government
of Punjab, department of Finance shall be final and binding.

ix). Results may be Check with the Punjab State Government Gazette.

x) For more details, please see the Lotteries (Regulation) Rules, 2010 of the
Government of India.

xi) Any of conditions of this scheme may be amended/ deleted/ modified/ relaxed
at any time by the Principal Secretary Finance to the Government of Punjab in
exceptional circumstances without assigning any reasons(s).

Notes:

i. Printing of tickets / promoter coupons will be got done from the


Security Printing Press on the panel of Reserve Bank of India or the
Indian bank Associations Mumbai, However, lottery
posters/banners will be got printed from the private printing press
which stands selected through open tenders at approved rates or as
decided by the Govt. keeping in view the prevailing circumstances.

ii) The expenditure for making payment to Prize winners/Selling


Agents/Distributors / Sellers/ Advertisers/ GSM checking
Institutions/ Laboratories/ Printers, Taxes/Charges (if any), Draw
Exp. etc. under this scheme shall be met from the Budget grant
provided in the budget by the State Government. The Director,
Punjab State Lotteries is authorized to sanction make all kinds of
payments mentioned above. Incentive to officers / officials will be
paid as per policy decision to be taken in this regard on a separate
file.
