Complete Tablet Protection - Terms and Conditions

The following are the terms and conditions for the Complete Tablet Protection program
(hereinafter referred to as “Plan” / “CTP”) operated by Jeeves Consumer Services Private
Limited, hereinafter referred to as "Jeeves", incorporated under the Companies Act, 1956
and having its Corporate office at Buildings Alyssa, Begonia & Clove Embassy Tech
Village, Outer Ring Road, Devarabeesanahalli Village, Bengaluru, 560103, Karnataka.
The Plan is operated on the platform (www.flipkart.com)/ Flipkart Mobile App/ Flipkart
Lite Platform (“Platform”).

What issues are covered under this Plan?


1. Warranty and accidental and liquid damage ( ADLD)
a. Any manufacturing defects as per manufacturer's warranty
b. Accidental Damage
c. Liquid Damage

Plan Period – 1 year from the invoice date

Eligibility Criteria – Customer to be 18 years of age at the time of purchase of the Plan

Qualified Products – Tablet of selected brands and models purchased from Flipkart
Platform along with the Plan(“Covered Product”)

You can raise only the below the type of requests with us under this Plan:

Salient points covered under this Plan:


1. Cost of pick & drop service
2. Customers are entitled to raise any number of manufacturing defects covered by
the brand as per the manufacturer’s warranty duration.
3. Customers will be allotted benefits (sum assured) at the time of purchase of the
policy as per the table below to claim any number of repairs. All sum assured
amounts for service features will be reduced by the repair value post completion
of each claim.
4. Overall benefit to the customer will be capped as per the Remaining Sum
Assured for each service feature, sum assured values at the purchase of policy
will be as per below table :

For Example: If a customer claims an Accidental/Liquid Damage repair of value 20% of


the purchase price, all sum assured amounts will be reduced by 20%. Remaining sum
assured to customers will be as below

5. If repair is not possible, Customer will be entitled to a refund capped as per
remaining sum assured benefits at the time of the claim.
6. In case of a refund, the defective Covered Product shall be handed over by the
customer to the service provider (as may have been appointed by Jeeves). The
ownership of the defective Covered Product shall be transferred to Jeeves/service
provider. All benefits of CTP will cease to exist post handover of defective
Covered Product and refund to the customer.

Warranty and accidental and liquid damage ( ADLD) Terms and Conditions

The terms and conditions for Warranty offering in Complete Tablet Protection,
hereinafter referred to as “CTP” shall be fully binding on the customer for the Tablet
covered, herein referred to as "Covered Product"

B) Defined Terms:

The following terms, when capitalized, if not defined elsewhere in these T&Cs shall have
the meanings assigned to each such term below:
1. Purchase Price: is the purchase price of the Covered Product paid by the
customer at the time of purchase on Flipkart platform post all promotional
discounts
2. CTP Coverage Start Date: is the date of the invoice of the Covered Product
3. CTP Coverage Term: is 12 months from the CTP Coverage Start Date subject to
these T&Cs.
4. Sum Assured /Coverage Amount: This is the total amount allocated per service
feature in the policy that can be spent on repair/refund when the customer is
filing a claim
5. Remaining Sum Assured: At any point of time within CTP Coverage Term, is the
Sum Assured minus the sum of the previous claim amounts
6. SLA: SLA (Service Level Agreement) is defined as the total time elapsed
between Covered product pickup and first attempt of delivery
7. The promised SLA of Jeeves under these Terms and Conditions are subject to
restrictions based on local, State and Central Government's notification on
operation of the Jeeves from time to time and unavoidable circumstances, force
majeure events and in other emergencies. You agree and confirm that Jeeves
shall not be liable for any breach of the SLA arising out of such local, State and
Central Government's restrictions on movement, lockdowns, unavoidable
circumstances, force majeure events and in other emergencies.
8. The SLA period for Jeeves under these Terms and Conditions shall be calculated
from the day lockdown/restrictions are lifted or the emergency ends at the
respective locations.
9. Part Payment: is calculated as repair estimate minus Remaining Sum Assured
10. Invoice: The original invoice that has been issued to you by the retailer for
purchase of the Covered Product
11. Business Days: excludes weekends, national & regional holidays

C) What is covered?
1. Pick and drop service based on pincode serviceability
2. Cost of parts
3. Accidental and Liquid Damage
4. Any manufacturing defects as per manufacturer's warranty terms

*All benefits mentioned above are capped as per Remaining Sum Assured.

D) What is not covered?

Not covered under the Accidental & Liquid Damage:


1. Loss or damage to the Covered Product due to mysterious circumstances or
unexplained reasons.
2. Loss or damage to Covered Product resulting from or caused by theft, or
attempted theft from unlocked rooms.
3. Fraud or criminal activity on the part of the End Customer.
4. Loss arising due to any unlawful act or illegal activities including criminal acts or
acts of war or the product is used with permission of the Bonafide Customer
having knowledge of such acts.
5. Consequential loss of any kind or description.
6. Liability to any party of any nature including but not limited to liability of
Authorized Service Centre to other parties.
7. Loss or damage caused by incorrect storage, poor maintenance, willful
negligence, incorrect installation, incorrect set-up, unless the authorized Service
Centre representative would confirm otherwise with due substantiation.
8. Loss or damage as a result of attack by unauthorized software/virus, software
faults and manufacturing defect owing to which a Covered Product fails to
operate.
9. Loss or damage that is covered by a supplier, dealer or factory warranty.
10. Any loss if the ownership of the Covered Product is transferred.
11. Any consequence arising from War, War lime operations (whether War declared
or not) , Act of Foreign Enemy, Hostilities, Civil War, Rebellion, Insurrection,
Civil Commotion, Military usurped power, Seizure, Capture, Confiscation, Arrest.
Restraints and or Detainment by order of any Government or any other Authority.
12. Any liability whatsoever nature directly or indirectly caused by or contributed to
by or arising from ionizing radioactive or contamination by radioactivity from any
nuclear waste from combustion of nuclear fuel. For the purpose of this exclusion
only combustion shall include any self-sustaining process of nuclear fission.
13. Any loss, destruction, damage or legal liability directly or indirectly caused by or
contributed to by or arising from nuclear weapon materials, Wear and tear, moth,
vermin or gradual deterioration, inherent defect or from any process of cleaning or
repairing or renovating or maintenance.
14. Any type of self-repair or attempted self-repair.
15. Penalties of delay or detention or in connection with guarantees of performance or
efficiency.
16. Intentional overloading of the instrument. Loss or damage due to any experiments
or tests and/or alterations resulting into any abnormal conditions.
17. Cost of Replacement of Battery unless caused by an accidental or liquid damage
to the Covered Product.
18. Any damage or loss occasioned from any water borne craft, unless such damage is
caused by the accidental ingress of liquid/water, and if the Customer has taken
reasonable care to protect the Covered Product from damage.
19. Any manufacturing defect which is covered under Manufacturer's warranty
Covered Product defects whether latent / inherent or not.
20. Loss or damage to accessories or parts that are not integral to functioning of the
Covered Product.
21. Internal leakage of the battery, unless caused by an insured peril.
22. Any loss the Customers may suffer or cost to the Customer for:
23. Theft or burglary
24. Any Damage or Theft caused by any deliberate act or negligence by the Customer
their employees or any person using the Tablet with their permission;
25. costs or charges when replacing accessories which can no longer be used with the
Covered Product;
26. Costs involved in returning the Covered Product for repair, or collecting the
Covered Product once it has been repaired;
27. Costs caused by the Covered Product being routinely serviced, inspected, adjusted
or cleaned;
28. Any loss related to indemnification for the Value-added services
29. Jeeves shall not be liable for any loss or damage claim due to the inability of the
Customer to submit claim documents required for processing the Claim
30. The policy shall not be liable for any claim if information has intentionally been
withheld or incorrect information or misrepresentations have been intentionally
given that are of significance to the assessment of the claim
31. Improper handling, dismantling, fitting adjustment, repair alteration or
modification not approved by the makers/manufacturers and / or the agents of
makers/manufacturers or use of such property country to the directives of the
makers/manufacturers and/or this agent.
32. Scratching, denting. Cracking is excluded unless caused by accidental external
means unless it affects functionality of Covered Product.
33. Loss or damage directly or indirectly, occasioned by or happening through or in
consequence of volcanic eruption or other similar convulsion of nature and
atmospheric disturbance
34. Loss or damage to the property insured directly caused by:
35. An act of terrorism committed by a person or persons acting on behalf of or in
connection with any organization
36. The action of any lawfully constituted authority in suppressing or attempting to
suppress any such act referred to in (i) above or in minimizing the consequence
thereof.
E) Buying Complete Tablet Protection and availing services
1. Complete Tablet Protection can be purchased from Flipkart website at the time of
Covered Product purchase.
2. Information on CTP, registration of a breakdown call, changing of registered
address or other customer / product details can be obtained from: Toll-free
number 1800 425 365 365
3. Service - Monday to Saturday except public holidays. Working hours – 9:30 am
to 6:00 pm. Appointments for home visits will be fixed as per mutual
convenience

F) Terms of coverage
1. The CTP is applicable for a period of 12 months from the date of invoice.
2. This CTP only applies to items purchased as new. There is no cover for items
described as ‘used’, ‘second hand’ or ‘refurbished’ product.
3. You must be at least 18 years old on the date of purchase of this CTP.
4. This CTP is limited to products with Manufacturer’s Warranty that is purchased
in select cities within defined geographic boundary of the Republic of India.
Information on whether CTP services are available in your city will be provided
at the point of purchase of the CTP.
5. The CTP shall become effective once Jeeves, at its sole discretion, accepts the
application of the customer and shall continue to remain in force for the period as
applicable, unless terminated earlier as per terms herein.

6. At point of service, Customer is required to show


o proof of purchase (either – 1. Covered Product purchase invoice
AND/OR 2. Original Manufacturer’s Warranty certificate/card) of
Covered Product.
o Images of the device against which policy is purchased as required by
the service provider appointed by Jeeves
o Any other document as may be required by the service provider or
Insurer appointed by Jeeves
7. Jeeves reserves the right to deny service and cancel the Complete Tablet
Protection, without any refund whatsoever if the customer fails to produce the
above information.
8. In case of Accidental & liquid damage and extended warranty, a processing fee
will be charged. The total liability of the Plan would be up to sum assured.
However the Customer can request for repair by paying the remaining repair cost
provided that remaining sum assured is more than zero.
9. In case of replacement, it must be issued by brand under manufacturer warranty.
It will be as per availability of the replacement products with the brand.
10. If an event occurs that may give rise to a claim under this Policy, or there are
circumstances that are likely to give rise to a claim, Customer must inform
Jeeves immediately, and, in any case by way of written intimation or by
registered post not later than 7 days from the occurrence of the loss or the event
giving rise to the claim

G) Scope of coverage
1. This CTP covers the cost of parts and pick & drop service within the
city/municipal limits of the Service partner Network Centers as defined by
Service Partner.
2. During the validity of the CTP, Service Partner will attend to the defects reported
by the customer, including replacement of the defective components that are
required to be replaced to make the Covered Product functional. This is subject
to the condition, the breakdown of the Covered Product being due to normal
usage.
3. All defective components replaced by Jeeves with a new component or
component equivalent to new in performance when used, shall become the
property of Jeeves and Customer shall not claim any right to the same.
4. In case the cost of repair exceeds the sum assured or the Covered Product cannot
be repaired or for reasons beyond its control, Jeeves shall have the discretion to
refund the Remaining Sum Assured. This discretion of which lies solely with
Jeeves and shall be binding on the Customer.
5. In case a refund is made, defective device shall be handed over by the customer
to the service provider and CTP for the Covered Product will be terminated.
6. In case replacement is offered by the brand under the manufacturer's warranty,
CTP shall be transferred to the new product with remaining available benefits.
Customer shall intimate Jeeves and provide proof of replacement in order to avail
the benefits.
7. The maximum liability under this Contract shall be the Sum Assured.

H) CTP Covered Product usage


1. Covered Product is used only for domestic & personal and not for commercial
purposes. Commercial usage of Covered Product as defined forth - Commercial
usage means products used in an industrial or commercial setting for purpose of
generating profit. An industrial or commercial setting is defined as non-
residential, multi user, communal or industrial use.
2. Covered Product is used as per the manufacturer's guidelines and as specified in
the user manual supplied along with the Covered Product.
3. For scenarios, where your address gets changed post-purchase of this Plan,
‘repair’ facility option would only be applicable if the New Address falls under
"Serviceable Addresses". In case, New Address does not fall under "Serviceable
Addresses", You will not be able to avail any benefits under this Plan.
4. Covered Product is used in the location as per the address was given by the
Customer to Jeeves at the time of purchase. Address change, if any, should be
notified within 7 days in advance by the customer by calling toll free number
1800 425 365 365.

I) CTP stands void if


1. The serial number of Covered Product has been altered, defaced or removed or
have been modified to alter their functionality or capability without the written
permission of manufacturer

The Covered Product which has been transferred by Customer to any other person. J)
Representation and Responsibilities of Customer
1. To avail service, Customer must produce to Jeeves, at the time of registration of
complaint and at point of service - proof of purchase of this CTP and Covered
Product purchase invoice.
2. Customer shall provide a representative of Jeeves, complete access to Covered
Product in order to effect necessary adjustments and/or repairs.
K) Charges and payments
1. Charges payable by Customer are inclusive of taxes, duties or levies unless
explicitly stated
2. Upon prima facie confirmation on the applicability of Plan, customer is required
to pay a processing fee as communicated to you over your registered email id and
mobile number

L) Other terms & conditions


1. While Jeeves promises to attend the defects for the Covered Product covered
under CTP on priority, Jeeves shall not be responsible for delays in service and
consequential loss if any to the customer. The maximum liability of the Jeeves
shall be limited to refund of the CTP cost paid by the customer less taxes.
2. In case the Covered Product under CTP is sold/transferred to another party or the
Covered Product is not available at the registered address/location, the CTP shall
get automatically terminated and no refund shall be applicable.
3. In case of part payment, time period between the time of intimation about the
part payment to the customer and the time till the payment is paid by the
customer is excluded from the Service Level Agreement.

M) Cancellation of CTP

1. Notwithstanding any of the above, Jeeves shall be entitled to cancel or change


the scope of services without any notice in any of the following events:
o If the Customer is in breach of CTP
o If the Customer is declared insolvent or bankrupt
o If a trustee is appointed to take over the assets of Customer
o If the original manufacturer refunds the price of Covered Product to the
Customer
o The conditions of Force Majeure continue for such a length of time that
further performance of Services would be commercially frustrating
o If Customer fails to adhere to the requirements as prescribed by Jeeves
2. Customer shall have the option to cancel the CTP within 10 days of delivery of
the Covered Covered Product, subject to not availing any service under the
Flipkart CTP terms. For cancellation of the Flipkart CTP and arranging refund,
customer will be required to cancel the order in the "My Orders" section or by
contacting Flipkart customer care.
3. In the event of cancellation for any reason whatsoever, Jeeves shall be entitled to
recover all outstanding payments due and payable by the Customer. Jeeves shall,
under no circumstances be responsible for refunding any amounts to the
Customer including without limitation due to cancellation of the CTP by
Customer or by Jeeves.

N) Revalidation of CTP
1. Jeeves only offers transfer of CTP services from one location to another, if the
new address is serviceable by our service provider ( as may be appointed by
Jeeves from time to time) . Customer can intimate to Jeeves by calling Jeeves on
1800 425 365 365 of the new address and obtain the validation of the CTP at the
changed location. In the absence of such validation or if Jeeves does not have
service facility at the changed location, Jeeves shall have the discretion to reject
the claim/benefits and no refund shall be applicable.
2. In case the Manufacturer replaces the Covered Product during the warranty
period, Customer is to intimate the same to Jeeves and submit a copy of the
replacement note given by the Manufacturer for revalidation of the CTP for the
replaced product having different serial number/IMEI number.

O) Data protection

The details you provide to make your CTP purchase will be stored and used by the
Administrator – Jeeves Consumer Services Pvt. Ltd. This information may be shared with
third parties for the purpose of handling claims and repairs. Your data will, at all times, be
held securely and handled with the utmost care in accordance with all principles as
defined by the Data Protection Laws of India.

P) Service Recovery policy for CTP, at Covered Product level

General Terms and Conditions for Complete Tablet Protection Plan

● This Plan is valid only in India. The minimum age of the


customer to participate in the Plan is 18 years.

● This Plan is open to only end customers and not resellers.

● The Original Tablet and Tablet should be bought on the


platform.

● This document is an electronic record in terms of


Information Technology Act, 2000, and the Rules thereunder
as applicable and the amended provisions pertaining to
electronic records in various statutes as amended by the
Information Technology Act, 2000. This electronic record is
generated by a computer system and does not require any
physical or digital signatures.

● The customer releases and holds harmless Flipkart and


Jeeves, its agents, affiliates, and employees from and
against any claims, damages, or liability of any kind,
including personal injuries, death, or property damage, or
any direct, indirect, consequential, incidental or other
damages, which the Customer or anyone else may suffer as a
result of participation in this Plan.

● The Plan is valid only on a limited inventory and is valid


only for a limited period of time.
● The customer agrees that his contact details can be shared
by Flipkart with Jeeves. Flipkart Order ID and contact
details of the Customer will be shared by Flipkart with
Jeeves for verification purposes. The usage of personal data
is subject to Jeeves’s privacy policy and Flipkart's privacy
policy here: http://www.flipkart.com/s/privacypolicy. By participating in the Plan,
customers agree to the collection and usage of their personal information by Jeeves and
acknowledge that they have read and accepted Jeeves’s and Flipkart's privacy policy.
Further, the Customer hereby agrees that his personal information may be transferred by
Jeeves or any other entity involved in the management of the Plan.

● The operation of the Plan is subject to force majeure


events and on the occurrence of such an event, the Plan may
be withdrawn at the sole discretion of Jeeves and Jeeves
shall not liable for damages under any circumstances.

● Flipkart hereby excludes and disclaims all liabilities,


whether direct or indirect, that may arise due to the Plan,
including but not limited to postponement or cancellation of
the Plan. The customer shall contact Jeeves for any
disputes/issues related to the Plan and Flipkart shall not
be held liable for any such disputes/issues. Further, the
Customer agrees that for any defects regarding the Covered
Product, the Customer shall have direct recourse against the seller of the Covered Product
and Flipkart shall not be held liable.

● Jeeves shall be solely responsible for fulfilling the


terms of this Plan. Flipkart shall not be liable for any
loss, injury or any other liability arising to the customers
as a result of the Jeeves failure to honour its obligations
with respect to the customer. Any claims made by the
customer owing to any act or omission by Jeeves with regard
to the Plan shall be the sole liability of Jeeves, and
Flipkart shall not be liable in this regard.

● Customer understands that the Plan is run by Jeeves and/or


through the participating sellers on the Flipkart Platform
and Flipkart shall not be liable towards the quality of the
product/device and/or fulfilment of the Offer and/or
warranty claims and/or after sales services of any product.
Any claim or dispute in relation to the same must be
directed towards Jeeves, seller and/or the manufacturer of
the product.
● The Plan is subject to applicable laws and regulations and
is void where prohibited by law. In the event that the
operation, security, or administration of the Plan is
impaired in any way for any reason, including, but not
limited to fraud, virus, or other technical problem, Jeeves
may, in its sole discretion, either

○ cancel the Plan and refund the Price

○ suspend the Plan to address the impairment and then resume


the Plan in a manner that best conforms to the spirit of
these laws.

● By entering into this Plan, the customer agrees to


indemnify and keep Flipkart harmless against all damages,
liabilities, costs, expenses, claims, suits and proceedings
(including reasonable attorney's fees) that may be suffered
by Flipkart as a consequence of (i) violation of the terms
of this Policy by the customer; (ii) violation of applicable
laws; (iii) any action or inaction resulting in willful
misconduct or negligence on the Customer's part.

● All taxes or liabilities payable to any regulatory


authority shall be borne by the customer and/or billed to
the account of the customer.

● The Plan and the Terms and Conditions herein shall be


governed by the laws of India and courts of Bangalore shall
have exclusive jurisdiction over any disputes arising out of
this terms and conditions.

● Jeeves will not be responsible for any loss of data stored


in the device. Customer's device may be formatted during the
repair process. Customer will be responsible to backup data
before handing over the device to the pickup agent.

● The customer is required to note that this Plan cannot be


availed along with any other product exchange offer being
run by Flipkart. If the Customer avails the Plan, these
terms and conditions shall be the entire terms and
conditions applicable to such Plan and no other terms and
conditions with respect to the exchange of the Covered Product
shall be applicable. Subject to the above, all the terms and conditions of the Plan as given
hereof and standard terms and conditions, user agreement, privacy policy (subject to
change) of www.flipkart.com shall be applicable on the Customer. In the case of any
conflict between the terms and conditions contained herein and the terms and conditions,
user agreement, terms of use and privacy policy of flipkart.com, the terms and conditions,
user agreement, terms of use and privacy policy on flipkart.com shall prevail

● In case of any discrepancy in modes of communication in


any of the terms between these Terms and Conditions’ and any
other mode of communication, the Terms & Conditions takes
precedence over all such source, the terms set forth in
these Terms and Conditions’ shall prevail.

Repair Claim Process:

In the event of Damage Claims,


● Upon prima facie confirmation on applicability of Plan, you are required to pay a
processing fee through an online payment link communicated to you over your
registered email-id and mobile number. While processing the Damage Claim, if
at any time, Jeeves determines that there has been any misrepresentation,
wrongful description, fraudulent activity or non-disclosure of any material fact
significant to the Damage Claim, then all benefits under this Planas well the
Processing fee shall be forfeited. The Planwill automatically stand terminated
vis-a-vis the Covered Product.
● Only upon receipt of Processing fee, Jeeves will start processing such Damage
Claim.
● If You choose to avail pickup and drop service, you shall pack the Covered
Product and keep the Covered Product ready for pickup as per the instructions
provided to You over your registered email Id and mobile number. Your device
will be picked within 72 hours of pick-up allocation. Pick and drop services will
be free of cost.
● Jeeves's logistics partner will pick up the packed Covered Product from the
Service Address and ship it to Brand's authorized repair center for either repair or
replacement, as determined by Jeeves at its sole discretion depending on the
factors including, but not limited to, cost of repair, availability of spares and time
to serve, or Jeeves's,will repair the same.
● In case, Jeeves decides to offer replacement/refund option (under the sole
discretion of Jeeves) of the Covered Product, You will be provided the choice to
either opt for replacement/refund or get back unrepaired Covered Product. If You
opt to get back the unrepaired Covered Product, Your Covered Product will be
delivered within the 10-15 business days SLA to your Service Address and the
processing fee paid shall be forfeited. If You opt for replacement of Covered
Product, the Covered Product will be replaced with a product containing similar
features and which is of an equivalent make, as per industry and market
standards. The replacement device [email protected] either be
a new or a device with equal or equivalent features. The make and model of the
new or refurbished replacement will be at the sole discretion of Jeeves. In case of
replacement, the Covered Product will be retained by Jeeves. Jeeves will provide
warranty service for the remainder of the PlanCoverage Term, on the replaced
device, terms and conditions of which will be communicated to You on Your
registered email.
● Once the Covered Product is repaired/ replaced, Jeeves’s logistics partners will
have the Covered Product/replacement device, as the case may be, shipped back
to Your Service Address in cases of pickup and drop service. In case of refund to
be issued by Jeeves, post submission of relevant documents, it will take 7
business days to process the refund.
