SYNOPSIS
By this Writ petition the petitioners pray for issuance of
appropriate writ/writs directing the respondents and other
concerned authorities to extend an continue the contractual
services of the petitioners and absorb thern in regular posts.
This petition prays fuither that the pet itioners be given
weightage in future appointment against regular vacancies on
account of their excellent work during COVID-l9 pandemic
and they not be replaced by another Set of contractual
employees. The petitioners are qualified health workers (ANM
and GNM) appointed during COVID-l9 pandemic and who
were terminated from service arbitrarlly frorn 26-7 -2021 by the
Civil Surgeon-cum-Chief Medical Officer, Vaishali by its
memo no. 1567 dated 24-7 -2021. All the petitioners were
terminated from service by the abovementioned single order.
The petitioners have now been re-employed on daily wages on
lessor wages of Rupees 450 per day instead of Rupees 1000 per
day which was being paid to them earlier.
 Relevant Facts with Dates:---
27 -4-2021: Principal Secretary, He&lth Department,
Government of Bihar issued memo no.329(11) and authorized
concerned authorities to procure medical equipments and
services of health workers to meet the challenges of CovID-
19 Pandemic.
05'5-2021: officer on Special Duty (establishment), Health
Department, Government of Bihar issued letter no. 345(11) by
which detailed instructions were given regar ding remuneration
to be paid to the health workers in the light of the
abovementioned direction of the Health Secretary.
27-5-2021: Civil Surgeon-cum-Chief Medical Officer,
Vaishali at Hajipur issued memo no. 105 1 appointing
altogether 62 health workers including the petitioners on the
post of ANM to cope with the challenges of COVID-l9
Pandemic . (Annexure-I)
20-7-2021: Civil Surgeon-cum-Chief Medical Officer,
Vaishali at Hajipur addressed letter no. 1 522 to Officer on
Special duty, Health Depaftment, Bihar Patna requesting
therein to extend the services of A.N.M (Petitioners) for further
two months. (Annexure-Il)
24-7-2021: Civil Surgeon-cum-Chief Medical Officer,
Vaishali at Hajipur issued memo no. I 567 W which services of
the petitioners were terminated from 26-7*2021. (Annexure-
rrr)
27 -7 -2021: The petitioners submitted a memorandum to
Principal Secreteary, Health Department, Government of
Bihar, Patna requesting therein to extend contract and
reglularize their services. (Annexure-IV)
Hence this Writ Application.

right in employing the petitioners on contr;rct for about three

services during such a medical emergency and after arbrtrarrly
terminating their services on flimsy grounds re-employing
them on lessor pay than that of paid to them earlier?

(ii) Whether employing petitioners on contract by the

respondents and its authorities for short periods and after using
their services either throwing them out of selvices arbitrarily or
re-employing them again on contract for ancther shorter period
on lessor pay than the standard one amounts to their
exploitation?
(iii)whether the Government of Bihar is right in replacing
one set of contractual employees with anothe r set of cottractual
employees?
(iv) Whether COVID-l9 pandemic is really over and in
these modern days of pandemics and medicrrl emergencies the
goveffrment as a model healthcare provider does not need the
petitioners who are excellent health workers!

(v) Whether these health workers who are qualified ANM can
be given weightage in future appointme nt against regular
vacancies to similar posts keeping in viev, of their excellent
services during COVID-l9 pandemic on humanitarian
grounds?

(vi) Whetherin the facts and circumslances of the case

judicial intervention by an appropriate direction to the
respondents and other conceffired authorities directing them to
continue the petitioners in service and after giving weightage

in regular posts is imperative in the ends ofjustice?

3. That the petitioners are citizens of India and reside within

the territorial jurisdiction of this Hon'ble Court.

4. That the petitioners have based the instant writ petition on

official documents, orders which arc parl of official records and
which are in public domain and also on newspaper reports.

5. That during second wave of COVID-l9 pandemic The

Government of Bihar urgently sought paramedical staff and
health workers to control the situation and save the lives of the
people from the deadly viral disease.

6. That on the basis of letter no. 329(11) dated 27-4-2021

issued by the Principal Secretary, He alth Department,
Government of Bihar and letter no. 345(11) dated 05-5-2021
issued by Officer on Special Duty (estatrlishment), Health
Department, Government of Bihar the petitioners were
appointed on the post of ANMs and GNlvIs on contractual
basis.

7. That the petitioners were selected on me ,rit by a committee

headed by Civil Surgeon-cum-Chief MediczLl Officer, Vaishali
atHajipur and were appointed as A.N.M. on contract on wages
of Rupees 1000 per day. They were posled at government
hospitals and primary health centres lo,;ated in Vaishali
District.

8. That after appointment of,the petitioners Vaishali district
performed well in coping with the situation during second wave
of the COVID-I9 pandemic. Had these casml health workers
not been appointed the situation could have been worst.

9. That on 20-7 -2021 Civil Surgeon-cum-Chief Medical

Officer, Vaishali at Hajipur addressed letter ro. 1 522 to Officer
on Special duty, Health Department, Bihat Patna requesting
therein to extend the services of these A.N M for further two
months.

10. That on 24-7-2021 Civil Surgeon-crrm-Chief Medical

Officer, Vaishali at Hajipur issued memo 1ro. 1567 by which
services of the petitioners were terminated arbitrarlly from26'
7 -2021 .

11 . That on 27 -7 -2021 the petition,:rs submitted a
memorandum to Principal Secretary, Hrtalth Department,
Govetnment of Bihar, Patna requesting therein to extend their
contract and regularize their services.

12. Thatit is pertinent to mention here that now the petitioners
have been hired on a lessor pay of Rupees 450 per day. Due to
unemployment and their poor financirrl condition the
petitioners are now forced to work on wages of Rupees 450 per
day instead of their earlier paid wages of Rupees 1000 per day.

13. That in Bihar the petitioners and other workers are

appointed on contract for shorter periods and after removal they
are appointed again for another shorter period. Thus the
workers including the petitioners are being exploited on the
threat of termination from service and are being paid on lessor
scale than the standardrate.

14.Thatthe State of Bihar and its authorities are exploiting the

petitioners. The NGO's like Urmila, Beltrrln, Cate India and
MS Enterprises started recruiting the health workers since June
2021 itself, i.e., exactly coinciding the removal of the
petitioners. In fact abovementioned NGO's recruit the health
workers for shorter periods so that they cannot claim
regularization and other consequential benef its in service. Thus
the health workers and other contractual staffs are being
exploited. This way instead of being welfAre state Bihar has
become exploitation state.

15. That it is submitted most humbly that The State of Bihar

lacks modern and up-to-date medical facilities. The people of
Bihar are left at the mercy of God during medical emergencies.
During second wave of the COVID-I9 pandemic Bihar has lost

millions of crtizens. If the petitioners are absorbed in regular
posts in government and its agencies th ey will get their
livelihood and on the other hand the people of Bihar will get
excellent healthcare during their medical needs and sufferings.

16. That the petitioners serVed the patients suffering from

highly contagious COVID-l9 disease risking their lives. It has
been inforrned that husband of a heal1h worker named
Abhilasha contacted corona ailment from her and died. These
health workers served the humanity well and they deserve
respectful treatment. And weightage in future recruitment to
similar posts may be a befitting reward by the Government of
Bihar to these poor petitioners.

17 .That the petitioners are qualified health workers and they

may be an asset to the Government of Bihar i f they are absorbed
in regular posts against the existing or future vacaneies. Several
posts of ANM, GNM and other health workers are yacant in the
health establishments of the government. Health Minister
Mangal Pandey had issued statement to news-papers informing
therein that about 30,000 health workers were to be appointed
till September 2021.
18. That recently Hon'ble Supreme (lourt of India has
expressed that fight against COVID-19 is & 'world war'. Our
Prime Minister Mr. Narendra Modi has called doctors and
health workers as Corona Worriers. Unforturrately Government
of Bihar is exploiting these health workers including the
petitioners and after arbitrarily terminating their services on
flimsy grounds has re-employed them on lessor pay than that
of paid to them earlier.

19. That in view of the circumstances mentioned it is submitted
most humbly that a direction from this Hon'ble Court alone can
redress the grievances of the petitioners and save them from
hardship and exploitation on the threat of losing their service
which is the only source of their livelihood.

20. That the petitioners have no other equally efficacious

alternative remedy than to move this Hon'ble Court for
redressal of their grievances.

21. That the petitioners have not moved this Hon'ble court
earlier either for the relief sought for in this writ application or
in respect of the contents thereof.

Itis, therefore, prayed that Your Lordships

may graciously be pleased to issue rule NISI
calling upon the respondents to show cause as
to why the prayer made by the petitioners in
paragraph no. I of this application be not
granted and after hearing the parties be
pleased further to make the rule absolute
against the respondents by allowing this writ
application and by granting the relief sought

Be pleased further to pass such order/orders
