A PETITION FOR DIVORCE U/S 13 OF HINDU MARRIAGE ACT, read with
Sec.7 (2) (a) of the Family Court Act,1984

The humble petition for Divorce U/S 13 of Hindu Marriage act,
read with Sec. 7 (2) (a) of the Family Court Act, 1984 on behalf
of the petitioner above named most respectfully.
SHOWETH: -
1. That this is a petition filed on behalf of the above-named petitioner for Divorce U/S 13
Of Hindu Marriage Act.
2. That no such petition has never been filed by the petitioner above named either in this
court or any other court nor any such petition is pending disposal.
3. That there is no collusion in between the parties and the petition is being filed without a
threat, coercion or undue influence.
4. That the petitioner was married to the O.P. on 06.07.2018, according to the Hindu rites and
customs in the presence of their family members, relatives and friends of both parties at Pune
city.
5. That after 3 years of marriage, the couple as not able to conceive child.
6. The petitioner came to know after medical reports were confirmed that the O.P. was infertile.
7. The petitioner did not ever hurt or blame the O.P. for the said medical problem.
8. The medical problem consumed the O.P. by guilt and self-pity leading to being irritated,
angry, depressed along with negative thoughts which impacted the petitioner mentally.
9. The O.P. also lost her job due to company staff cut down and this led for the petitioner to
work extra hours to support the family.
10. This also amounted to the withering of marital bond, they stayed in the same house but hardly
communicated with each other.
11. The O.P. decided to travel places for her new work purpose and did not find it very important
to be with the petitioner, she also decided to stay maximum time out station mostly at Manali
resorts.
12. The petitioner requested the O.P. to stay together, asked her to return and stay as a family, but
O.P denied it ass she was happy alone and earning good.
13. After 3 months of separation from the petitioner, O.P.’s video went viral and unfortunately it
was along with another man who was over friendly with the O.P.
14. The petitioner decided to pay a visit to the O.P at Manali Resort and to his surprise leant that
O.P was sharing the room with the man in the video.
15. The O.P. was triggering the victim the petitioner and this led to a small quarrel.
16. The petitioner was made a scapegoat and was instigated to hurt the man in the video with no
intentions to harm but just to threaten being legally wedded to the O.P.
17. Further to this the O.P. did not consider the plight of the petitioner but raged at him, slapped
him hard amounting to cruelty and told him to leave and not show his face again, this incident
further triggered the petitioner amounting to self-defence he hurled a vase at the O.P
unintentionally without the intention to hurt her, just to threaten her but unfortunately it hit
her head and medical aid was called for, and she recuperated.
18. That the proper court fee of Rs 250/- is being paid.
The Petitioner seeks the following reliefs: -
(A) The Learned Court be pleased to summon the Opposite Party and
after hearing both the parties pass a decree od Divorce in favour of the
Petitioner and against the Opposite Party.
(B) The Petitioner be granted any other relief or reliefs with the learned court
deems fit and proper.
And for this the petitioners shall ever pray.

I, Raj Singh husband of Simran Singh aged about 33 years, resident of Pune city, District- Maval,
State – Maharashtra, presently residing at the same, do hereby verify that the contents of this petition
are true and correct to the best of my knowledge.

AFFIDAVIT

I, Raj Singh husband of Simran Raj Singh aged about 33 years, resident of Pune city, District –
Maval,
State – Maharashtra, presently residing at the same hereby solemnly affirm and declare as follows: -
1. That I am the petitioner in this petition.
2. That I am well acquainted with the facts and circumstances of this case.
3. That the statements made in this petition are true to my knowledge.
4. That the statements made in this affidavit are true to my knowledge.
Hence this affidavit.
3. Difference between batil and fasid marriage in Sunni Muslims
In Islam, marriage is a legal contract between two people. Both bride and groom are consent to the
marriage of their own free wills. A formal, binding contract – verbal or on paper is considered integral
to a religiously valid Islam marriage, and the outlines the right and responsibilities of the groom and
bride.
1. Batil is Void Marriage and Fasid is Invalid Marriage.
2. Batil marriages cannot be converted, whereas Fasid marriages van be converted as Sahi
marriages by removing the impediment or irregularities.
3. Batil is bad in its foundation and one which is completely void agreement, whereas Fasid is
irregular, its foundation is good, but unlawful in its attributes.
