D. Estimated performance of the plant

Approximate Generation 1650000/- Kwp / MW / per annum for the first year of operation on a
maximum scale with related appropriate radiation available and with an annual degradation of 0.6%
to 0.75% per annum on year on year basis shall be applicable. For the plant life of 25 years based on
the current DNI levels for location as per detailed calculations.

E. Land requirement

2 Acre of clear and shadow free area required for 500kW (AC).

F. Force Majeure

If at any stage during the period of the contracts, the performance of any obligations under the
contract is prevented or delayed wholly or partly be reasons of war, hostility, fire, floods, lightning,
epidemics sabotages, quarantine restrictions or other acts of God, Government or Law (herein after
referred to as eventuates) then a notice of the happening of any such eventuality. In such case
neither party shall, by reasons of such eventuality, be entitled to terminate this contract, nor shall
any claim be made for damages against the order in respect of such nonperformance or delay and
the performance and deliveries of the contract will be resumed as soon as practicable after such
eventuality has come to an end or ceased to exist.

H. Jurisdictions / Arbitration

All order placed on H&S Infrastructure shall be subject of Jurisdiction of Rajkot Courts.
If at any question, dispute or difference what so ever shall arise between the H&S Infrastructure and
the purchaser upon or in relation to, or in connection with the purchase order / contract the same
may be referred to arbitration as per Indian Arbitration Act. The venue of arbitration shall be Rajkot
only.

I. Insurance

Project insurance up to commissioning in scope of company. After commissioning in the scope of

owner.

J. Validity

Our offer will remain valid for acceptance for 30 days from the date of offer. Further extension will
be subject to our written confirmation.
