duties. Explain the operation these duties with reference to relevant statutes and common law.

2. In order to distinguish an employee from an independent contractor or an agency worker,


the law uses several tests. Explain these tests with reference to case law.

3. Exclusion Clauses may be used to limit or exclude liability in contracts. Explain how such
clauses may be controlled by common law and statutes.

4. Compare and contrast the main defences to the tort of Negligence using relevant case law.

5. Distinguish between fixed charges and floating charges and explain the stages taken to
register these charges.

6. What is the tort of negligence? Explain the elements which a claimant must satisfy for a
successful claim under the tort of Negligence.
