MEMORANDUM OF AGREEMENT FOR SUPPORT OF RELIEF GOODS

AND OTHER SUPPLIES DURING DISASTERS, CALAMITIES AND
COMPLEX EMERGENCIES

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement is entered into and executed by and between:

M.A. BENIGNO GROCERY a duly existing business establishment under

and by the virtue of the Philippine laws with business address at Brgy. #1 San
Roque, Vintar, Ilocos Norte represented by its proprietor, Ms. Marjie Agbayani
herein after referred to as the “GROCERY”.

-and-

The Barangay Council of Abkir, a barangay of the Republic of the

Philippines acting as a barangay government unit with address at Brgy. #18 Abkir
Vintar, Ilocos Norte, represented by its Punong Barangay, HON. ROGELIO A.
VIERNES, herein referred to as “BGU”.

WITNESSETH:

WHEREAS, the GROCERY is engaged in goods and other basic supply

business in Vintar, Ilocos Norte and has enough stocks of supplies which can be
utilize in case of disaster, calamities and other emergencies;

WHEREAS, the BGU in times of disaster, calamities and other

emergencies is in need of such groceries and other basic supplies for the
subsidence of the people affected;

NOW THEREFORE, for in consideration of the foregoing premises and the

covenants hereinafter contained, the parties agree as follows:

ARTICLE I

RESPONSIBILITIES OF THE GROCERY

 1. The GROCERY shall ensure the availability of groceries and other
basic necessities at all times;
2. The GROCERY shall give priority to the BGU the disposal of such
commodities upon being informed by the impending disaster,
calamity and other emergencies;
3. The GROCERY immediately being informed of the impending
disaster shall prepare the necessary groceries and other basic
necessities as determined by the BGU.
4. The goods shall be delivered by the GROCERY in a specific place
determined by the BGU.

ARTICLE II

RESPONSIBILITIES OF THE BGU

1. The BGU shall immediately inform the GROCERY of the

impending calamity; the information maybe in a form of verbal,
text message, email or by phone.
2. At the option of the BGU, the goods may be pickup from the
GROCERY.
3. The BGU shall pay the cost of goods within a reasonable time
after the calamity.
4. The BGU reserves the right to return the unconsumed goods
provided that such goods are under their original state upon
delivery and receipt.

ARTICLE III

This Memorandum of Agreement shall start to commence on January

1, 2017 and expires on December 31, 2017. All provisions stipulated herein
shall be valid and binding between the contracting parties; No extension or
renewal of this agreement shall take effect without the written consent of
both parties.

IN WITNESS WHEREOF, the parties hereto through their

authorized representatives have affixed their respective signatures this 1st day of
January, 2017 at Vintar, Ilocos Norte.

A RESOLUTION GRANTING AUTHORITY TO THE PUNONG BARANGAY OF BARANGAY

#18 ABKIR VINTAR, ILOCOS NORTE, THE HONORABLE ROGELIO A. VIERNES TO
ENTER INTO AND SIGN A MEMORANDUM OF AGREEMENT FOR AND IN BEHALF OF
THE BARANGAY COUNCIL OF ABKIR WITH M.A. BENIGNO STORE REPRESENTED BY
IT’S OWNER MANAGER MARJIE AGBAYANI FOR THE PURCHASE OF GOODS AND
RICE DURING CALAMITY

WHEREAS, the M.A. Benigno Store has perennially offered a loan of goods/groceries and rice to
various barangay government units all over the Municipality in support to their relief distribution in times
of calamities or disasters;

WHEREAS, this program is geared to mitigate the effects of various calamities and it guaranties
that barangay government have a ready and sufficient supply of goods and rice from the M.A. Benigno
Store for immediate relief distribution to affected families and communities;

WHEREAS, the Barangay Council has continuously availed this program as this greatly benefits
the whole community and its citizenry, hence the renewal of the agreement is highly imperative;

NOW THEREFORE, on motion of Kagawad Jonathan Ricardo C. Cumlat seconded by Kagawad

Estelita A. Cumlat, the body;

RESOLVED AS IT IS HEREBY RESOLVED, to grant authority to the Punong Barangay of

Barangay #18 Abkir Vintar, Ilocos Norte to enter into and sign a Memorandum of Agreement for and in
behalf of the Barangay Council with M.A. Benigno Store represented by its owner manager Marjie
Agbayani for the purchase of goods and rice on credit for its relief operation during calamity.

RESOLVED FINALLY, to furnish a copy of this resolution to the Punong Barangay Rogelio A.
Viernes for information and reference.

referred to as the ”SARI SARI STORE”.

The Barangay Council of Abkir, a barangay of the Republic of the

Philippines acting as a barangay government unit with address at Brgy. #18 Abkir
Vintar, Ilocos Norte, represented by its Punong Barangay, HON. ROGELIO A.
VIERNES, herein referred to as “BGU”.

WITNESSETH:

WHEREAS, the SARI SARI STORE is engaged in goods and other basic
supply business in Brgy. #18 Abkir Vintar, Ilocos Norte and has enough stocks of
