ANSWER

COMES NOW, defendant TEMY CALE SUPETER, through the


undersigned counsel, unto this Honorable Court most respectfully
state THAT:

1. The allegations made under paragraphs 1, 2, 3, 4, 5 and


6 are admitted;

2. The allegations made in paragraph 7 with regard to the


repeated calls are denied. Plaintiff only texted me on June 2, 2022,
and after June 10, 2022, I did not receive phone calls from the
Plaintiff.

3. The allegations made in paragraph 8 are denied the truth


being that, I did not receive the first summon on June 10, 2022. In
addition, there was no service of summon made to me by the
authorized official of Barangay Sambag 1 on June 14, 2022. Lastly, I
did not also receive the summon for the third hearing. Thus, being the
case, I truthfully did not have a personal knowledge that there was a
summon served to me in order for me to appear in the hearing held in
Barangay Sambag 1.

4. The allegation in paragraph 9 with regard to the obligation of


TWENTY THOUSAND PESOS (Php 20,000.00) that is due and
demandable is admitted. But the legal interest is not stipulated in the
agreement, hence, denied.
WHEREFORE, it is most respectfully prayed of this Honorable
Court that judgment be rendered DISMISSING plaintiff’s complaint for
failure to state a cause of action.

Other reliefs and remedies that are just and equitable in this
instant case are likewise prayed for.
