Mistreated in A Medical Setting?

File a Grievance!
Section 1557 of the Affordable Care Act prohibits discrimination

based on sex and disability, which includes gender identity,

transgender status, or sex stereotypes. This applies to hospitals,

health programs, and facilities receiving federal funding.

Why Is It Important to File a Grievance?


Having a written record will be helpful if you wish to pursue damages in

the future.

Having a record of every complaint against larger hospital systems can

help signal to them that they need to make a change.

Having those records, especially if you alert us when you make a

complaint, can give us and other community organizations leverage

to advocate for better policies and training.

It's important for them to see there's a problem, even if we as a

community already see it.

As soon as you can try to write down all of the details of the
experience that you can.
The name of each person you interacted with throughout your visit.

The times of each incident, to the best of your ability.

Direct quotes from the people you interacted with.

Keep records of any complaints.


Where Can You File a Grievance? (You can do all three)
1) If the incident was at one of the major healthcare/hospital systems,

they will have an internal grievance process.

2) Kentucky Commission on Human Rights, medical facilities will

be under the "Public Accommodations" category. This must be done

within 180 days from the incident.

3) Complaint with U.S. Department of Health and Human Services


Office for Civil Rights. This also must be done within 180 days from
the incident.
