Commissioner ( MOTORCADES AND CARAVANS, AND (5) MITING DE AVANCE UNDER THE NEW NORMAL IN CONNECTION WITH THE 09 MAY 2022 NATIONAL AND LOCAL ELECTIONS. x PROMULGATED : 16 March 202: RESOLUTION No.___—-10769__ WHEREAS, on 24 November 2021, the Commission on Elections promulgated Resolution No. 10732, entitled “GUIDELINES FOR THE CONDUCT OF: (1) IN-PERSON CAMPAIGN, (2) RALLIES, (3) CAUCUSES, MEETINGS, AND CONVENTIONS, (4) MOTORCADES AND CARAVANS, AND (5) MITING DE AVANCE UNDER THE NEW NORMAL IN CONNECTION WITH THE 09 MAY 2022 NATIONAL AND LOCAL ELECTIONS’; WHEREAS, the Guidelines classifies areas through a Category Level System for the purpose of regulating campaign activities while limiting the impact of COVID-19 at a minimum. The said Category Level System is based on pertinent resolutions, issuances, and guidelines of the IATF-MEID!; 1 Inter-Agency Task Force for the Management of Emerging Infectious Diseases. WHEREAS, Sections 4, 12(B), 16, and 20 of the said Guidelines read: SECTION 4. Requirements of Participants. — Subject to the prevailing JATF-MEID guidelines, all persons participating in election campaigns in whatever capacity are mandated to wear full-coverage face shields together with face masks (ear loop masks, indigenous, reusable, or do-it-yourself masks, or other facial protective equipment) and observe the minimum public health standards at all times during the period of the political activity. XXX SECTION 12. Allowable Election Campaign Activities under Category Level = the following thresholds shall be observed for each election campaign activities: XxX B. Only candidates, campaign leaders, and supporters belonging to the same household are allowed to be in the same vehicle. c. The following activities are strictly prohibited during Motorcades, in all Category Levels: el Stopovers, layovers, and other similar stoppages for the conduct of other election campaign activities; ©.2. Handshakes, hugs, kisses, going arm-in-arm, or any action that involves physical contact among the candidate, their companions, and the public; 3. Taking selfies, photographs and other similar activities that require close proximity between the candidate and their companions, and the public; and 4. Distribution of food and drink, and all other goods or items. xxx SECTION 20. Approval of the CCC. - No election campaign activity under this Guidelines shall be conducted without first obtaining the prior approval from the corresponding CCC. WHEREAS, on 27 February 2022, the IATF-MEID updated the Guidelines on the Nationwide Implementation of Alert Level System for COVID-19 Response; WHEREAS, the Commission may incorporate, amend, or adjust accordingly, the updated protocols and guidelines issued by the IATF-MEID in the Guidelines for campaign activities under the New Normal; NOW THEREFORE, pursuant to the powers vested in it by the 1987 Constitution, the Omnibus Election Code, Republic Act No. 9006 or the Fair Elections Act, and other related laws, the Commission RESOLVED, as it hereby RESOLVES, to AMEND Scctions 4, 12(B), 16, and 20 of Resolution No. 10732, to now read as follows: “SECTION 4. In all category levels, adequate air exchange and ventilation must be ensured at all times. c. For Category Levels 3, 4, and 5, only candidates, campaign leaders, and supporters belonging to the same household are allowed to be in the same vehicle. d. The following activities are strictly prohibited during Motorcades, in all Category Levels: 1. Stopovers, layovers, and other similar stoppages for the conduct of other election campaign activities; 4.2. Approval of the CCC. - Except for Category Levels 1 and 2, no election campaign activity under this Guidelines shall be conducted without first obtaining the prior approval from the corresponding CCC. In_all Category Levels, a permit duly issued by the local government unit shall be required, subject to the provisions of Batas Pambansa Blg. 880? and Sections 873 and 88* of Batas Let the respective COMELEC Campaign Committees and the Education and Information Department implement this Resolution. The Education and Information Department shall cause the publication of this Resolution in two (2) daily newspapers of general circulation in the Philippines, and to furnish with copies thereof the Department of Health, the Department of Interior and Local 2 The Public Assembly Act of 1985. 3 Section 87. Rallies, meetings and other political activities. - Subject to the requirements of local ordinances on the issuance of permits, any political party supporting official candidates or any candidate individually or jointly with other aspirants may hold peaceful political rallies, meetings, Gnd other similar activities during the campaign period: Provided, That all applications for permits to hold meetings, rallies and other similar political activities, receipt of which must be Ecknowledged in writing and which application shall be immediately posted in a conspicuous place in the city or municipal building, shall be acted upon in writing by local authorities Foncerned within three days after the filing thereof and any application not acted upon within Said period shall be deemed approved: and Provided, further, That denial of any application for ‘said permit shall be appealable to the provincial election supervisor or to the Commission whose decision shall be made within forty-eight hours and which shall be final and executory: Provided, finally, That one only justifiable ground for denial is a prior written application by any candidate or political party for the same purpose has been approved. + Section 88. Public rally. - Any political party or candidate shall notify the election registrar concerned of any public rally said political party or candidate intends to organize and hold in the city or municipality, and within seven working days thereafter submit to the election registrar a statement of expenses incurred in connection therewith. 10769 Government, the Philippine National Police, the Armed Forces of the Philippines, the Commission’s Regional Election Directors, Provincial Election Supervisors and Election Officers.
