TheUnitedStatesAttomey'sOfficefortheSouthem DistrictofFlorida(ttthisOffice'')and
Lontrell W illiamg, Jr.(hereinafter referred to as the tddefendant'')enter into the following
agreem ent:

'l'he defendantagreestoplead guilty to CountOne ofthe Superseding Indictment,which

chargesthedefendantwith Conspkacy to Possess Fireanus in Furtherance ofV iolentand Dnzg

TraffickingClimes,in violation ofTitle 18,UnitedStatesCode,Section 924(0).


2. The United States agrees to dismiss the remaining counts,as to this defendant,after

sentencing.

3. The defendantis aw are that the Court w ill impose the sentence after considering the

advisory Federal Sentencing Guidelines and Policy Statements (hereinafter ''Sentencing


Guidelines''). 'The defendantaclcnowledgesand understandsthattheCourtwillcompute an
advisory sentence under the Sentencing Guidelines and that the applicable guidelines w ill be

detel-minedby theCourtrelying inpartontheresultsofapre-sentenceinvestigation by theCourt'

probation office,w hich investigation w illcom m ence aftertheguilty plea hasbeen entered. The

defendantisalso aw arethat,undercertain circumstances,theCourtmay departfrom theadvisory

sentencing guideline range thatithas computed and may raise orlowerthatadvisoty sentence

underthe Sentencing G uidelines. The defendantisfurtheraw are and understandsthattheCourt

isrequked to considertheadvisory guidelinerange detenrined undertheSentencing Guidelines

butisnotbotmd to impose asentencew ithin thatadvisory range;theCourtispermitted totailor

the ultim ate sentence in light ofother statutory concenls,and such sentence m ay be eitherm ore

severe orless severe than the Sentencing Guidelines'advisory range. Knowingthese facts,the

defendantunderstandsand acknowledgesthattheCouèthasthe authority to imposeany sentence

within and up to thestatutorym aximum authorized by 1aw fortheoffenseidentified itzparagraph

1andthatthedefendantmaynotwithdraw thepleasolely asaresultofthe sentenceimposed.

4. 'lhe defendantalso understandsand acknow ledges thatas to Count 1,the Courtm ay

impose a statutoly maximlzm term ofimprisomnentofup to twentyyears'(20)imprisonment,


followed by a term ofsupervised release of up to three (3) years.In addition to a term of
implisonm ent and supervised release,theCourtm ay impose afineofup to $250,000.
The defendantfurther understands and acknow ledges that,in addition to any sentence

imposed under this agreement, special assessment of one hundred dollars ($100)
willbe imposed on the defendant. The defendantagrees thatany specialassesslnent imposed

shallbepaid atthe tim e ofsentencing. Ifthe defendantisfinancially unable topay the special

assessm ent,the defendantagreesto presentevidence to this Officeand the Courtatthetime of

sentencing as to the reasons forthe defendant'sfailureto pay.

This Officereserves the rightto inform the Courtand the probation office of a11facts

contained in thisagreem ent,thisOfficefurtherreservestherightto make any recommendation as

to the quality and quantity ofpunishm ent.

Court.The defendantunderstandsfurtherthatany recomm endation thatthisOfficemakesto the

Courtasto sentencing,whetherunderthisagreementor othezw ise,is notbinding on the Court,

and theCourtm ay disregard therecomm endation in itsentirety. The defendantunderstandsand

acknowledges, as previously acknow ledged in this agreement, that the defendantmay not

w ithdraw his plea based upon the Court's decision notto accepta sentencing recommendation

madeby thedefendant,thisOffice,orarecommendationmadejointly bythedefendantandthis


Office.

8. The parties agree to recolnm end, although not binding on the C ourt, a sentence not to

exceedninety-seven (97)months.
9. ThisO fficeagreesthatitwillreconlmend atsentencing thattheCourtreducebytw o levels

thesentencingguidelinelevelapplicabletothedefendant'soffense,pursuanttoSection 3E1.1(a)
ofthe Sentencing Guidelines,based upon the defendant'srecognition and affirm ative and tim ely

acceptance ofpersonalresponsibility.Ifatthetim eofsentencing thedefendant'soffenselevelis

detennined to be 16 orgreater,thisOfficewill file a m otion requesting an additionalone-level

decreasepursuanttoSection 3E1.1(b)oftheSentencingGuidelines,statingthatthedefendanthas
assisted autholitieshztheinvestigation orprosecution ofthedefendant'sow nm isconductby tim ely

potifying authorities ofthe defendant'sintention to enter a plea ofguilty,thereby permitting the

United Statesto avoidprepaling fortrialand permittingtheUnited Statesand theCourttoallocate

theirresom ces efficiently. This O ffice,how ever,w illnotbe requked to m ake thism otion ifthe

defendant:(1)failsorrefusestomakeafull,accurateand completedisclosure totheprobation


office of the circumgtances surrounding the relevant offense conduct;(2) is found to have
misrepresented factstotheUnited Statesbeforeentering intothispleaagreement;or(3)commits
any m isconduct afterenteling into thisplea agreem ent,including butnotlim ited to com m itting a

state or federal offense, violating any term of release, or m aking false statements or

misrepresentations toany govem mentalentity orofficial.

Ihe defendantfurtheragreesto forfeitto theU nited Statesvoluntarily and im m ediately a11

property constituting,orderived from proceedsobtained,directly orindirectly,as aresult ofthe

violation and any property used,or intended to be used,in any m arm er or part,to com m it or

facilitatethecommission oftheviolations.

11.The defendantfurtheragreesto forfeitto the U nited Statesvoluntarily and im m ediately all

firean'
ns or alum tm ition involved in orused orintended to beused in the offense.

12.The defendantalso agrees to fully cooperate w ith the U nited States ilz a11 proceedings,

whetheradministrativeorjudicial,ilwolving theforfeituretotheUnitedStatesofa11rights,title,
and interest,regardless oftheirnature or fonn,in allassets,including realand personalproperty,

cash and other m onetary instnunents, w herever located,w hich the defendantor others to the

defendant'sknow ledge have accum ulated as a result of illegalactivities. Such assistance w ill

involvethedefendant'sagreelnenttotheentryofan orderenjoining thetransferorencumbrance


ofassetsthatmaybeidentifiedasbeingsubjecttoforfeiture. Additionally,thedefendantagreœ
toidentifyasbeingsubjecttoforfeiturea11such assetsandtoassistinthetransferofsuchproperty
to the U nited States by delivery to this Office upon this O ffice's request, all necessary and

appropriate docum entation concem ing said assets,including consents to forfeiture, quitclaim

deedsand a11otherdocum entsnecessary to deliver good and m arketable title to said property.

13.The defendantknowingly and voluntarily waives a1lconstitutional,legal,and equitable

defensestotheforfeitureoftheassetsin anyjudicialoradministrativeproceeding,including any


claim or defense under the Eighth A m endm ent to the U nited States Constitution;w aives any

applicable timelimits totheinitiation ofadministrative orjudicialproceedings,andwaivesany


rightto appealthe forfeiture.

14.The partiesagree thatthedefendantshallberesponsible forthepaymentofrestitution to

a1leligible victims oftheconspiracy charged in Count1.

15.The defendantfurtheragreesthatforfeiture isindependentofany assessm ents,fines,costs,

restitution orders,orany otherpenalty thatthe Courtm ay im pose.

16.'Thedefendantisaw arethatTitle 18,UnitedStatescode,Section3742 andTitle28,Unitd

StatesCode,Section 1291 afford the defendantthe lightto appealthe sentence imposed in this

case. A cknow ledging this,in exchange forthe undertakings m ade by the U nited States in this

plea agreem ent,the defendanthereby w aives a11 rights confen'ed by Sections 3742 and 1291 to

appealany sentence imposed,including any restitution order,or to appealhow the sentence w as

imposed,unless the sentence exceedsthe maximum penuitted by statute or is the result of an

upw ard departure or an upw ard variance from the advisory guideline range that the C ourt

establishesatsentencing. The defendantfurtherunderstandsthatnothingin thisagreementshall

affectthegovem ment'srightordutytoappealassetforth in Title 18,United StatesCode,Sçction

3742(b)andTitle28,UnitedStatesCode,Section 1291. However,iftheUnited Statesappeals


thedefendant'ssentencepursuantto Sections37421)and 1291,thedefendantshallbereleased
from the above w aiver of appellate rights. By signing this agreem ent, the defendant

aclcnow ledgesthatthedefendanthasdiscussed theappealwaiversetforth in thisagreem entwith

the defendant'sattom ey. The defendantfurtheragrees,togetherw ith this Office,to requestthat

the Courtenter a specific finding thatthe defendant'sw aiver of his right to appealthe sentence

imposed in thiscasew aslcnowing andvoluntary.

17.D efendant recognizes that pleading guilty m ay have consequences concem ing the
defendant'simlnigration statusifthedefendantisnotacitizen oftheUnited States. Underfederal

law ,many crim es are removable offenses,including the offenses to which the defendantis

pleading guilty.Removal and other im m igration consequences are the subjectofa separate

proceeding, however,and the defendantunderstands that no one,including the defendant'

attom ey orthe Cout't,can predictto a certainty the effectofthe defendant'sconviction on the

defendant'sim m igration status. D efendantneverthelessaffirm sthatthedefendantw antstoplead

guilty regardlessofany im migration consequencesthatthedefendant'spleam ay entail,evenifthe

consequenceisthedefendant'sautom aticremovalfrom theUnited States.

18.This isthe entke agreem ent and understanding between this Office and the defendant.

There are no otheragreem ents,prom ises,representations,or understandings.
