Family Session Agreement

Terms & Conditions

This agreement is between Marzur Photography represented by María Zuñiga (hereafter reffered to as
“PHOTOGRAPHER”) and Ana Dobrenov (hereafter reffered to as “CLIENT”).

This agreement is for services and products related to a Family Session to take place at the following
time and place. Photographer and Client are to arrive for the SHOOT at 17:15 at Minnipi Parkland
(Stanton Road, Tingalpa) at Sunday 7 February 2021

Photographer agrees to provide no fewer than 50 photos for CLIENT and is not required to provide more
than this number of images. Photographer will perform basic post-processing or digital image editing
services on these photos where artistically necessary.

Retainer & Payment

In consideration for the photography services provided by PHOTOGRAPHER, CLIENT agrees to pay the
sum of $250. A retainer fee of $50 of the selected photography package is due at the time of booking to
reserve your session. The retainer fee is non-refundable. Upon payment, the photographer will reserve
the time and date agreed upon by both parties. Prices are non-negotiable and only guaranteed once the
retainer has been paid. The photographer reserves the right to offer your session date to another client
after 48 hours if your retainer fee has not been paid in full. The remaining balance is due prior to or at
your scheduled session. Payment can be made via cash or transfer.

Shoots requiring extensive travel will incur a $50 travel fee for Mooloolaba Beach, Shelly Beach,
Woorim, The Spit Beach, Currumbin Beach and Tamborine Mountain and $150 for North Stradbroke
Island.

Refunds

If your digital images are damaged or lost prior to viewing your gallery for any reason by the
photographer, only then will your retainer fee will be refunded in full. No refunds will be given for
dissatisfaction with your images. Print products may not be returned for any reason other than damage
or error on the part of the photographer at time of delivery. If your product is damaged on the part of
the photographer, it will be exchanged and re-ordered for the same product, undam- aged. If your
product includes error by the photographer, your product will be exchanged and re-ordered for the
same product, error free. There are no refunds or exchanges on any digital products. The Photographer
cannot guarantee a specific number of images, no lower than 50, provided to the client, and no refund
will be given due to lack of subject cooperation.

Social Media

The Client may share Facebook albums and gallery links through use of "share" functions on social
media sites or by using direct links provided by the photographer. The Client agrees to tag María Zúñiga
on Instagram and Facebook by using either of the examples -

The client releases and authorizes Marzur Photography and its contracted representative photographer
to use the client’s photographic images and likenesses for advertisements, self- promotions, web site,
web blog, social media sites such as Facebook and Pinterest, portfolios, contests, editorial purposes or
art exhibits.

Regarding Viewing & Printing Images

Please note that all images produced by Marzur Photography have been done so with the use of color
callibrated monitors. Monitors used by the Photographer have been callibrated to meet printing
standards, thus color changes may occur when images are viewed on non-callibrated monitors. Also
note that images viewed in non-professional editing programs will appear less sharp than if the same
images are viewed using a professional program. Printed images will be correct in color, sharpness and
other variables that may be affected by non-callibrated monitor and non-professional programs, that is,
if the printed images have been produced by a professional imaging lab. In order for printed images to
meet the quality of the original digital files, they must be printed on high-quality photographic paper or
on other professional photographic mediums, and done so by a professional lab. It is highly
recommended that the Client order printed images from a reputable, professional lab to ensure that the
quality of his or her digital images is met. Marzur Photography is not liable for the quality of images
printed by any imaging lab, both professional and non

Tardiness

Tardiness on the client's part may result in reduced shooting time, which may result in less images
presented by the photographer. The photographer cannot guarantee a time extension on sessions and
will not cut into the shooting time of another session to make-up for lost time.

Weather Policy

In the event of bad weather conditions, it will be at the photographer's discretion to cancel the
scheduled photography session. The photographer will contact the client if necessary, and the session
will be rescheduled for another date. If a client selects to proceed with the scheduled session and rain,
etc. limits the time and/or images that were able to be captured, Client understands the photographer
will deliver all usable images and will not be liable for refund of money.

Cancellation

If client requests to reschedule or cancel this agreement 8 or more calendar days before the session
date, the retainer shall be applied to a mutually agreed upon rescheduled date. Cancellation within 7
days or less of the scheduled session or failure to show-up at a scheduled session will result in the
retainer being forfeited.

Limitation of Liability

The Photographer's entire liability to the Client, above named models, or other companions for claim,
loss, or injury arising from the photographer’s performance or negligence is limited to a refund to the
Client in the amount paid for services. If the Photographer is unable to perform this agreement due to
illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer,
the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is
unable to be agreed upon, Photographer shall return the retainer to the client and shall have no further
liability. Further, if the Photographer is unable to deliver photographic materials due to technological
malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without
fault of the Photographer, liability shall be limited. The Photographer reserves the right to cancel this
contract for any reason, including conflict of interest.
