Contract of Lease
-WITNESSETH-
1. The terms of this lease shall be for a period of One (1) Year commencing from
_________________________ and ending on _________________________, renewable
for a period of One (1) year with Ten (10%) Percent increase after the first year.
2. The LESSEE shall pay unto the LESSOR a monthly rent for the leased premises the
amount of _______________________________, payable in advance on the 18th day of
each and every given month by depositing it to _____________________ under the
Account Name of __________________________ with Account Number
____________________________________ UPON DEPOSIT OF MONTHLY
RENTALS, THE LESSEE IS REQUIRED TO NOTIFY THE LESSOR THRU
TEXT MESSAGE __________________________________ OF HIS/HER
PAYMENTS INORDER TO VERIFY SAID BANK TRANSACTION. Failure to
settle rent as agreed upon shall be subjected to penalty amounting to One Hundred
Pesos per day of delay.
3. Aside from the aforesaid rentals, the LESSEE shall make a deposit in favor of the
LESSOR the sum of ___________________________________________ which amount
shall be answerable for whatever damages that may be sustained in the leased premises
due to the fault of the LESSEE. These shall be paid in full prior to move-in date of
September 18, 2021
4. Delays in rent shall be subjected to penalty in the amount of One Hundred (Php100.00)
Pesos per day of delay.
5. In the event that the LESSEE desires to renew the lease contract after its expiration,
he/she shall notify the LESSOR in writing Thirty (30) days prior to the expiration of
the lease contract. All deposits shall be forfeited in case of pre-termination.
6. At the end of the Lease Contract, the security deposit will be given back to the LESSEE
after all utilities had been settled and no damages were incurred in the unit. FAILURE TO
TURN OVER THE UNIT FREE FROM GARBAGE AND PERSONAL BELONGINGS
SHALL INCUR CHARGES FOR DISPOSAL AND CLEANING FEE OF Php1,000.00.
THIS WILL BE DEDUCTED TO THE SECURITY DEPOSIT.
7. The LESSEE shall use the leased premises exclusively as his/her private dwelling only;
only FOUR (4) People is allowed to occupy the unit. NO TRANSIENT IS ALLOWED.
No one is allowed to held parties or drinking (liquor) session along common areas.
8. The LESSEE shall not assign or subleased premises or any portion hereof without the
written consent of the LESSOR.
9. The LESSEE shall keep the leased premises in good and habitable condition at all times.
10. All repair and maintenance works below Six (Php 600.00) Hundred Pesos shall be to the
account of the LESSEE.
11. For major repair beyond the responsibility of the LESSEE, the lessee shall provide access
to workers designated by the Lessor to do the repair works from 8am to 5pm Monday to
Saturday. It would be the responsibility of the lessee to grant said access during the said
time/day in order to do repair works.
12. The LESSEE shall not be allowed to make any alteration and improvement on the
premises without the written consent of the LESSOR. Any improvements allowed by the
LESSOR to the leased premises shall automatically become the property of the LESSOR
at the expiration or termination of this lease without obligation on the part of the LESSOR
to reimburse the LESSEE for whatever expenses incurred for such improvement;
13. Water and Electricity consumptions are sub-metered and shall be billed separately.
14. The LESSOR or their agent are hereby authorized and permitted to enter and view the
condition of the premises at reasonable hours of any day in a convenient manner.
15. Should the LESSEE fail to pay the rent more than 15days, the LESSOR shall have the
right to eject the LESSEE from the leased premises and to collect and recover all accrued
rents and forfeit all deposits.
16. It is agreed that the LESSEE shall be responsible for all acts and omissions of her guest
and all other persons that she allowed access to the leased premises.
19. At the expiration or termination of this contract, the LESSEE binds and agrees to
surrender and return peacefully the possession of the leased premises unto the LESSOR
clean, free from any occupants, and personal effects.
20. All unpaid utilities beyond the due date for payment shall be subject to a 10% interest per
month until all amounts are settled.
21. The LESSEE hereby assumes full responsibility for any damage which may be caused to
the person or property of third person/s while remaining either casually or on business in
any part of the premises leased. LESSEE further binds itself to hold the LESSOR harmless
and free from any claim for such injury or damage.
22. Disturbance or discontinuance of possession of the LESSEE due to “force majeure” shall
confer nor right of any kind to the LESSEE as against the LESSOR, by reason of
inconvenience, annoyance or injury arising out of the necessity of repairing any portion of
the leased premises.
23. Failure of the LESSOR to enforce strict performance by the LESSEE of any of the terms,
conditions and covenants of this agreement shall not be construed as waiver of any right or
remedy that the LESSOR may have, nor shall it be deemed as a waiver of any subsequent
breach of the terms, conditions, and covenants contained therein. No waiver by the
LESSOR of its rights hereunder shall be deemed to have been made unless expressed in
writing and signed by the LESSOR.
24. At the termination/rescission of the term of this lease or cancellation thereof, as herein
provided, the LESSEE will promptly deliver to the LESSOR the leased premises with all
corresponding keys and in as good and tenantable condition as the same is now, ordinary
wear and tear excepted, devoid of all occupants, movable furniture, articles and effects of
any kind. Non-compliance with the terms of this clause by the LESSEE will give the
LESSOR the right, at latter’s option, to refuse to accept the delivery of the premises and to
compel the LESSEE to pay therefrom at the same rate as herein provided plus an
additional sum equal to Twenty Five (25%) percent thereof as penalty until the LESSEE
shall have complied with terms hereof. The same penalty shall, likewise, be imposed in
case the LESSEE shall refuse to leave the leased premises after the expiration of this
Contract of Lease or the termination for any reason whatsoever. Should the lease be
terminated/rescinded by the LESSOR due to the fault of the LESSEE, the latter shall be
liable to pay the LESSOR penalty charges in an amount corresponding to one half of the
total rentals due for the remaining unexpired term of this lease computed from the time of
such termination/rescission.
26. The LESSEE shall be held liable to any damages cause by fire due to the negligence of
the LESSEE.
27. Door Locks, Toilet Fixtures, Lighting and Water Fixture shall be in working condition
upon turn over by both the LESSEE and LESSOR.
