purchase the Goods;
“the Quotation” refers to the quotation addressed to the Buyer by Linde;
“the Goods” means any item of goods or services of whatsoever nature, which
is to be sold by Linde to the Buyer

Price The price for the delivery items are on Ex Works Pune Basis

Currency All prices mentioned in the Quotation are in INR on FOR basis.

Validity of Offer 31st December on 2020.

Payment 30% advance against PO and 70% against PI before delivery of truck at site

Reservation of Title : Linde reserves ownership of the Goods until all payments as agreed in the
payment terms are made.

Warranty Period : Linde provides warranty against any defective materials and defective
workmanship from the date of delivery for a period of 12 months or 2000
hours of operation whichever comes first, subject to the condition that the
Goods are maintained in accordance to Linde’s recommended schedule
maintenance carried out by Linde trained Service Engineers or its authorised
service providers utilising Linde’s genuine parts.

Scope of Warranty : The Buyer shall notify Linde in writing of any alleged defects within 10 days of its
discovery. Linde will make good any such defect by repair or replacement
free of cost to the buyer for materials and labour subject to the condition that such defect is not due
to that stated in Linde’s Limitation of Liablity of warranty
 Limitation of Liability: Linde does not warranty for material defects which were caused by
- effects of force
- improper use
- repairs carried out by personnel not authorised or trained by Linde
- the use of oil and operating material with unstuaible specification and parts not supplied by Linde .
for parts subject to wear and for damage resulting for natural wear

2) Any dispute arising out of or in connection with the Contract shall be subject to jurisdiction of Pune Court.

3) Notwithstanding any other clause of the Contract, the Delivery of the goods to you or your Order, will be
subject to our Credit and Risk Assessment of your Company / Firm, and you may be requested to provide
us with an upfront payment for the value of the invoice, depending on the result of our Assessment.

4) Order Cancellation by the Customer will be treated as a Breach of Contract and will result
in forfeiture of the advance paid.

Installation & Commissioning: This Shall be carried out by Linde or any assigned representative free of cost

Training & Familiarisation: Linde or any assigned repersentative will carry out training to familarise the operator on the
proper use and maintenance of the equipment.

Delivery: Within 18 -20 weeks from the date of PO and advance payment

Unless otherwise stated in writing, by Linde, the date of delivery shall run from the date on which
acceptance of order for the Goods is provided to the Buyer.
