CONTRACT OF LEASE

NOW ALL MEN BY THESE PRESENTS:

This LEASE AGREEMENT is made by and between:

 STAR EXPRESS PLACEMENT AND PROMOTION


INCORPORATED represented by ROLANDO
CABUSAO VALERIO, Filipino, of legal age, widow,
and a resident of 67 Vista Real Avenue, Vista Real
Executive Village, Batasan Hills, Quezon City
hereinafter referred to as the LESSOR;

- and -

 RENATOR ROQUE, Filipino, of legal age, and with


business address at #139 Matahimik Street, Brgy.
Central UP Diliman, Quezon City hereinafter
referred to as the LEASEE;

-Witnesseth-

Whereas, the lessor is the registered owner of Rochelle


Apartelle located at #139 Matahimik Street, Brgy. Central
UP Diliman, Quezon City and covered by Transfer
Certificate of Title T-327546;

Whereas, the LESSOR agreed to lease the penthouse


and a portion of the above described property for his
restaurant/canteen business;

NOW THEREFORE, for and in consideration of the


foregoing premises, the LESSOR leases unto the LEASEE
and the LEASEE hereby accepts from the LESSOR the
LEASED property subject to the following conditions:

1.RENTAL RATE: That the monthly rental for the


penthouse shall be FIFTEEN THOUSAND PESOS (Php
15,000.00) which shall be paid in cash every 21 st day of
the month and THIRTY THOUSAND PESOS (Php

30,000.00) for the restaurant which shall be paid in cash
every 16th day of the month;
2.PERIOD: That the period of this agreement shall be
two (2) years and shall commence on January 22, 2019
and shall expire on January 22,2022 and may be
extended upon mutual agreement of the parties;

3. DEPOSIT: That upon the commencement of the


lease agreement the LEASEE shall give two months
advance and two months deposit amounting to ONE
HUNDRED TWENTY THOUSAND PESOS
(120,000.00);

4. PURPOSE:

The penthouse shall be used exclusively by the


LESSEE and his family members and for residential
purposes only. While the restaurant shall be used
exclusively by the LESSEE for business purposes
and the said leased property shall not be diverted to
any other use. It is hereby agreed upon that if any
time the premises are used for other purposes, the
LESSOR shall have the right to rescind this contract
without prejudice to its rights under the law;

5. DEFAULT PAYMENT:

In case of default by the LEASEE in payment of the


rent the lessor shall have the option to terminate
the agreement and eject the LEASEE. The LESSOR
has the right to padlock the premises when the
LEASEE is in default of payment and may forfeit the
rental deposits and advance given by the LEESEE;

6. SUB LEASE:

The LEASEE shall not directly or indirectly sublet,


allow or permit the leased property to be occupied in
whole or in part by any other person, form or
corporation, neither shall the LESSEE assign its
rights hereunder to any other person or entity and

no right of interest thereto shall be vested in anyone
by the LEASEE without the LESSOR’S written
consent and approval;

7. LESSOR’S RIGHT OF ENTRY:

The LESSOR or its authorized agent shall have the


right to enter the premises except to the penthouse
which requires prior notice and approval by the
LEASEE;

8. PUBLIC UTILITIES:

The LEASEE shall pay for its telephone, electricity,


cable tv, water, and internet;

9. FORCE MAJEURE: If whole or any part of the


leased premises shall be damaged or destroyed by
fire, flood, lighting, typhoon, earthquake, or any
other unforeseen events or acts of God as to render
the leased premises during the term substantially
unfit for used and occupation of the leased then this
lease contract maybe terminated without any
compensation by the LESSOR or by LEASEEs
subject to notice in writing to the other;

10. EXPIRATION OF THE LEASE:

At the expiration of the term of this lease or


cancellation thereof as herein provided the LEASEE
will promptly deliver to the LESSOR the leased and
tenable condition as the same is now;

11. JUDICIAL RELIEF:

Should any one of the parties herein be compelled


to seek judicial relief against the other, the losing
party shall pay the attorney’s fees, and any other
litigation fees;

This contract of lease shall be valid and
binding between the parties their successors and
interest and assigns.

IN WITNESS WHEREOF, we have hereunto set our


hands, this ___ September 2020 at Quezon City.
