APPEAL

The Appellant, PAMELA B. CAYAPAS, Principal I, through the undersigned


counsel, unto this Honorable Office most respectfully states the following:

TIMELINESS OF FILING

1. On February 13, 2020, the DepEd Schools Division of Palawan received the
disapproval of the appellant’s appointment for the position of Principal I.
She has personally received the same on February 19, 2020. The
appointment was disapproved for Violation of Sec. 97, Rule IX of the 2017
Omnibus Rules on Appointment and Other Human Resource Actions (ORA-
OHRA) Revised 2018 (Prohibition of promotion of more than three-salary
grade). Copies of Disapproved Appointment are hereto attached as “Annex 1
and 1-A”.

2. The appellant has 15 days from receipt within which to file an appeal,
hence, the timeliness of this appeal.

ANTECEDENT FACTS

3. The appellant is a resident of Barangay Poblacion, Araceli, Palawan. She


graduated with a degree of Bachelor of Arts from Palawan State University. She
took 18 education units from the same school to qualify for the Licensure
Examination for Teachers. She took and passed the said examination on May
27, 2000. Copy of her examination result is attached as “Annex 2”.

4. Prior to being appointed as School Principal I, the appellant has a


permanent appointment position for the position of Teacher II since January
10, 2013. She got into the teaching profession as Secondary School Teacher on
July 16, 1998. Copy of her appointment for Teacher II is hereto attached as
“Annex 3”. In support thereof, copy of her Personal Data Sheet is attached as
“Annex 4 and service record as “Annex 4-A”.

5. She began her teaching profession as Secondary School Teacher of Bohol


National High School, Dumaran, Palawan, and became the Teacher-In-Charge
of the same for the period of six years and five months. She worked with local
officials to declare the school from Bohol Barangay High School to what it is
known today as Bohol National High School. Copy of certification and
designation for the same is attached as “Annex 5 and 6”.

6. For personal and professional development, she enrolled in the graduate


school of Palawan State University and Western Philippines University where
she incurred 39 units of Master of Arts in Teaching. Copy of her TOR is hereto
attached as “Annex 7”.

7. On December 9, 2017, she took the Principal’s Test and passed the said
examination (copy of her certificate of rating for Principal’s Test is hereto
attached as “annex 8”). She was qualified to take the examination because of
her excellent relevant work experience as Teacher-In-Charge for six years,
which is one of the required experiences provided for by DepEd Order No. 42,
s. of 2007 to qualify to take the Principal’s Test. Certificate of Eligibility to take
the Principal’s test is attached as “Annex 9”.

8. Being a Teacher-In-Charge for several years prior to her transfer to Araceli


National High School, she had relevant trainings and seminars as school
administrator or manager. To further enhance her capacity as School Head,
she completed the School Heads Development Program (SHDP) Foundation
Course. She participated as well in workshops conducted by the Department of
Budget and Management.

9. In January 2019, vacancies for the position of Principal I and Assistant


School Principal II were announced by the DepEd Schools Division of Palawan.
It was published and posted from January 4, 2019 to January 15, 2019.

10. The appellant applied for the position of Principal I and upon screening and
deliberation by the Personnel Selection Board (PSB) of the DepEd Schools
Division of Palawan conducted on January 28, 2019, she was ranked and
appointed for the position. A copy of the results of Ranking for Principal I is
attached as “Annex 9” and her assignment order as “Annex 10”.

11. The appellant has a consistent rating of Very Satisfactory in her IPCR
Forms. Copy of her IPCR from 2016 to 2019 are attached as “Annex 11 to
Annex 13”.

ARGUMENTS & DISCUSSION

12. Section 97 of the 2007 Omnibus Rules on Appointment and other Human
Resource Actions provides that an employee may be promoted to a position
which is not more than three salary grades higher than the employee’s present
position. However, exceptions were provided by the same provision on the
mentioned limitation, one of which is when the candidate pass through a deep
selection process, taking into considerations the candidate’s superior
qualification in regard to:

- Educational Achievements
- Highly Specialized Trainings
- Relevant Work Experience
- Consistent High-Performance Rating/Ranking

13. The appellant falls within the purview of the above exception. She went
through the deep selection process provided for in the DepEd Order No. 42
series of 2007 and other guidelines issued for the Appointment of School
Heads. She has met all the requirements necessary for taking the Principal’s
Test which are as follows:

- Graduated Bachelor of Arts with 18 Education Units;


- Functioned as Teacher-In-Charge for six years;
- Completed necessary trainings and workshops (Copy of her
certificates of trainings and seminars are attached as “Annex 17 to
17-Q”).

14. She passed the Principal’s Test which enhanced her qualification for the
position of Principal I based on DepEd Order No. 42 series of 2007.

14. She earned 39 units of Master of Arts in Teaching as a Post Graduate


Studies and completed several trainings and workshops for School Heads. One
of which is the School Heads Development Program (SHDP) Foundation Course
(Attached as “Annex 17 to 17-Q).

15. Prior to her assignment in Araceli National High School as a classroom


teacher, she functioned already as a Teacher-In-Charge in Bohol National High
School for six years and caused the establishment of the same as Bohol
National High School. Her commendable performance was highly appreciated
by the students, parents and the whole community of Barangay Bohol,
Dumaran, Palawan. But she has to serve as well her local community in
Araceli, hence, her transfer to Araceli National High School.

16. At present, she is designated as Principal I of Araceli National High School


from January 2019. She has been performing commendably the duties and
responsibilities required by her office. Copy of plantilla of personnel is hereto
attached as “Annex 14”.

17. She has a consistent Very Satisfactory Rating in her IPCR. She is
committed to the teaching profession and to the furtherance of the desire of the
Department of Education to uplift the welfare of all Filipino students. She is
prompt in submitting all the necessary requirements and reports within her
control for the efficient management of the school despite the difficulty of
transportation and communication from the island municipality to the main
island of Palawan. And she has done that even when she was still in Bohol
National High School with limited resources.

18. The appellant submits that these meritorious reasons were taken into
consideration by the Personnel Selection Board of the DepEd Schools Division
of Palawan, thus, her appointment in the position of Principal I. Her
appointment was fully supported and prayed for by the Schools Division
Superintendent Natividad P. Bayubay. Copy of the letter from the Schools
Division Superintendent is attached as “Annex 15”.

19. The appellant has shown her capacity as a school head from the time of her
designation as such, and she has performed remarkably the functions of her
office like supervision and administration. Copy of position prescription is
hereto attached as annex 16.
PRAYER

WHEREFORE, premises considered, it is humbly prayed for in this


Honorable Office that the denial of the appointment of PAMELA B. CAYAPAS
for the position of School Principal I be reconsidered and instead, her
appointment for the said position be approved.

I, PAMELA B. CAYAPAS, Appellant in the above-captioned case, of legal age,


Filipino, after having been sworn, in accordance with law, hereby depose and
state that:
1. I am the Appellant in the above-captioned case;
2. I have read and understood the contents hereof of this Appeal, and the
facts herein alleged are true and correct of my own knowledge and based on
available verifiable records;
3. I heretofore have not commenced any other action or proceeding or any
claim, or filed any claim involving the same issues raised in the above-
captioned case, in this Honorable Supreme Court, in the Court of Appeals,
nor the different Divisions thereof, nor in any other court or tribunal or
agency and, to the best of my knowledge, no such other action or claim is
pending therein;
4. I hereby undertake to notify this Agency of such fact within five (5) days
from receipt of such knowledge, should I come to learn that the same or a
similar action or claim has been filed or pending in the Supreme Court,
Court of Appeals, the different Divisions thereof, or any other court or
tribunal or agency;
5. I am executing this sworn statement in compliance with Section 5, Rule 7
of the 1997 Rules of Court.
