“TOTONG AVILA Y ALECANTE, G.R. NO. 201584, 15
JUNE 2016

FACTS OF THE CASE:

a woman named janjoy dagnato vasquez was the victim of two men named apolonio
avila Y alecante, and another man without identity. but they certainly killed the victim by
shooting her in the abdomen and head.

ISSUE:

but there are different versions of the real incident, and the suspect denies that he
committed the crime and that he was at his home at that time.

RULLING:
but the court still found him guilty of murder and sentenced him to reclusion perpetua. and was
ordered to pay the victim's heirs worth (213,412.18PHP).

CONCLUSION:

he should only be found guilty of his crime because the evidence and testimony of the witness

against him is strong .

CONSTANTINO Y BACUNGAY, ERNESTO BERRY Y
BACUNGAY, G.R. NO. 206226, 04 APRIL 2016

FACTS OF THE CASE:


on the day of march, 10 2001 a woman we hide under the alias "AAA" was raped and killed by
two men named "constancio" and "berry".

ISSUE:
and on the day of their custodial investigation "berry" gave his extra judicial confession which
can be considered as "sworn statement", but later he also withdrew it and insisted and claimed
that he was coerced into signing the same, just like constancio who do not admit to the crime they
committed

RULLING:
on january 23 2007, in rtc of parañaque city, branch 258 "contancio" and "berry were found
guilty of rape with homecide, and sentenced to suffer reclusion perpetua.

CONCLUSION:
perhaps they only deserve to be punished and convicted guilty because the evidence proving that
they are truly guilty can never lie.
PEOPLE OF THE PHILIPPINES v. ADEL
TUANGCO,NESON PINEDA JR AND SONNY
TUANGCO, G.R. NO. 130331, 20 NOVEMBER 2000
FACTS OF THE CASE:
on the day of january, 3 1995, in the town of jalan baka, branggay sulipan apalit probinsya
pampanga. adel tuangco Y dizon, nelson pineda jr and sonny tuangco Y dizon. went to the house
of the victim aureia eugenio and worked together to rape and kill the victim, mixed with the
desire to steal its equipment and money including watches, rings, cameras and money worth three
thousand pesos.

ISSUE:
all accused at the height of their arraignment filed that they were not guilty of the charges against
them and the witness who could prove that they were guilty was a deaf mute person.

RULLING:
and because the court said that the deaf mute witness could still be a qualified witness because he
could still tell what he actually saw, the accused were found guilty in the case of theft and rape
with homecide.

CONCLUSION:
they were found guilty with the help of a deaf mute witness, because for the law as long as you
are able to tell the story. and you have all the qualifications as a qualified witness you can give
your statement in court against the accused
