    AFFIDAVIT

    I, JOHN VICTORIANO D. VILLANUEVA III, Filipino, of legal age, with postal


    address at #74 Col. Lauro Dizon, Barangay 5-D, Lipa City, after having been duly sworn
    in accordance with law, hereby depose and state:

    That I am a regular employee of the Bureau of Customs, appointed as Assistant


    Customs Operations Officer (ACOO), and presently assigned at the Law Division, NAIA
    Collection District III, NAIA Customhouse, Pasay City;

    That I am at present the designated Records Custodian at the Law Division;

    That the District Collector, Port of NAIA, received from the Legal Service, this
    Bureau, a Subpoena dated 02 Septemeber, which was forwarded to the Law Division,
    with the instruction to submit documents pertaining to Warrant of Seizure and Detention
    docketed as Seizure Identification No. 075-2020 ( Bureau of Customs vs. ANDREA
    CUEVAS);

    That being the Records Custodian, I prepared the documents required by the
    Legal Service, particularly the following:

    1. Incident Report dated July 23, 2020 of COO III Hope Raymar S. Nicomedes,
    COOIII Coral Therese M. Botengan, and COO III Jonathan Kit M. Gozos;
    2. Decision/Order dated July 30, 2020; and
    3. Notice of Decision dated August 3, 2020.

    That the original copies of the foregoing documents are among those documents
    on file in the case docket of S.I. No. 075-2020 kept at the Law Division;

    That only the photocopies of the herein-listed documents are available in the
    case folder, namely:

    1. Commercial Invoice;
    2. Inventory List;
    3. Airwaybill No. 42 8863 6391;
    4. Chemistry Report No. PDEA-NCR-20-0245; and
    5. Photographs of the subject goods;

    That I am executing this Affidavit to attest to the truth of the foregoing and for
    whatever legal purpose this may serve.

    IN WITNESS WHEREOF, I have signed this Affidavit on this 3rd day of


    September 2020 at the NAIA Customhouse, Pasay City.
