Joint of Affidavit of Arrest
We, SPOI Denis R Arpon and POII Jenrio A Sarmiento, all of legal age, married and single and
residents of Brgy Burabod, Biliran, Biliran, and Sitio Tubod, Brgy Smo. Rosario, Naval, Biliran,
respectively, under oath avers:
1. That we are all members of Naval Police Station, Naval, Biliran designated as Intel PNCO
and Subpoena/warrant server PNCO, respectively;
2. That at about 1:50 o’ clock in the afternoon of October 10, 2012 our attention were called
when our confidential asset came and informed us regarding the occurrence of illegal gambling activity
commonly known as Tong-Its in an open shed near the shoreline of Brgy. Sto Niño, Naval, Biliran;
3. That at around 1:55 o’clock in the afternoon of same date we move to the disclosed place
of occurrence after being directed by our Chief of Police PCI RODERICO S LEPASANA to verify the
veracity of the information and effect arrest if evidence warrant;
4. That at about 2:00 o’clock of same afternoon we indeed saw in plain view male persons
actually engaged in illegal gambling commonly known as Tong-Its in an open shed near the shoreline of
Brgy Sto. Niño, Naval, Biliran;
5. That we immediately approached them and confiscated their playing card (Baraha), one
piece fifty peso bill with serial number RB988201, two pieces twenty peso bill with serial numbers;
HY546391 and TS802242, fifteen pieces five peso coins and four pieces one peso coins with a total bet
amount of Php 169.00;
6. That we introduced ourselves as Police Officers, informed them the nature of their offense
and appraised them their Constitutional rights embodied under the New Constitution of the Republic of
the Philippines;
7. That we later identified them as Jerry Meala y Maraya, 31 years old, single, pedicab driver,
Jose IV R Perdugas, 15 years old, Student of Naval National High School and a certain Gilbert Vicera, of
legal age who eluded arrest, all a residents of Brgy Sto. Niño, Naval, Biliran;
8. That we are executing this affidavit of arrest to attest the foregoing facts freely and
voluntarily.

COMPLAINT AFFIDAVIT
I, Crisanta Palapar y Oplijeda, 51 years old, widow, Filipino, resident of Sitio Tondo, Brgy.
Lucsoon, Naval, Biliran after having duly sworn to in accordance with the law do hereby depose
and state:
1. That I am the lawful wife of the late Elpedio Palapar who met his untimely death on
the eve of July 3, 2012;
3. That as per investigation conducted by the Naval Police Station surrounding the
death of my late husband and as per testimony of a witness, it was Marcelino Cahayagan who
was the one who hacked to death my late husband.
4. That I am executing this affidavit to attest to the foregoing facts and to file a formal
complaint against Marcelino Cahayagan for killing my late husband with treachery.

3. That sometimes on August 22, 2012 at around 8:00 o’clock A.M. my mother Juana
Monto was hit and bumped while crossing to other side of the highway of Brgy Catmon, Naval,
Biliran by a motorcycle driven by Arnel Piad Lucero of Brgy Haguikhikan, Naval, Biliran;
4. That after being hit and bumped she she fell off into the pavement and she suffered
serious Physical injuries on her head and subsequently died while undergoing treatment at
Biliran Provincial Hospital, Naval, Biliran;
5. That I know all the facts and circumstances of the incident thru the information one
of my witnesses, William Dacallos, who personally observed the incident;
6. That I am executing this affidavit to attest to the foregoing facts and to file a formal
complaint against Arnel Piad Lucero, a resident of Brgy Haguilhikan, Naval, Biliran.

AFFIDAVIT
1. That I am a resident of Brgy Catmon, Naval, Biliran for almost six years. Formerly
I am residing at Brgy Haguikhikan, Naval, Biliran being a native of said place;
2. That sometimes on August 22, 2012 at around 8:00 o’clock in the morning, I was
besides the highway of Brgy Catmon, Naval, Biliran, that time I am on my way to cross to the
other side of the highway/eastward bound;
3. That while crossing the highway, I noticed one Mrs Juana Monto who was also
crossing the highway, she was on my right side more or less two arms distance;
4. That while Juana Monto was walking towards the other side of the highway and
before reaching the center line of the road, she was hit and bumped by a motorcycle, Honda
XRM, painted red driven by Arnel Piad Lucero;
5. That after she was hit on the right portion of her body, she had twisted, turned
around then fell off into the pavement likewise the motorcycle skid and fell off into the
pavement;
7. That I personally identified the driver as Arnel Piad Lucero a resident of Brgy
Haguikhikan, Naval, Biliran;

We, SPOI Joel N Palconit, POII Cesar Espada and POII Ramil Velasco, all of legal age, married and a
residents of Brgy Sangalang, Brgy Calumpang, Naval, Biliran and Burauen, Leyte, respectively, under oath avers:
1. That we are all regular members of Philippine National Police, presently assigned at Naval Police
Station, Naval, Biliran, designated as Investigator, Traffic Investigator and Station Driver, respectively;
2. That about 6:45 o’ clock in the morning of October 25, 2012 our attention were called when Chrispulo L
Perocho, Technician of JM Poultry and Live stock supply Inc, Naval Branch reported to Naval Police Office that JM
Poultry and Live stock supply INC was ransacked and perpetrated more or less 12 midnight of October 24 to 4:00
o’clock in the morning of October 25, 2012;
3. That during our follow up investigation we have truly observed that the roll up at the front portion of
the said establishment was destroyed, the drawer of the cashier’s table was forcibly open and documents were
scattered on the floor;
4. That during furthermore verification, Geraldine Gumayao, Manager of the said establishment
disclosed that nine (9) cellophane bags filled with assorted coins with a total of ten thousand pesos, representing
the proceeds of the store was taken away by the suspects;
5. That Walbert L. Yabo (Wife of Geraldine) voluntarily informed us that he was able to actually saw the
suspects while hastily coming out in the JM store during his inspection around 12:00 midnight of October 24, 2012
after he was directed by his wife Geraldine to check the store for possible intruders who will take advantage the
weather inclement;
6. That he positively identify one of the suspects as a vendor, a resident of sitio Laca, Brgy Smo. Rosario,
Naval, Biliran, his face, height and bodily pose was familiar to him through the clear illumination of his flash light;
7. That we later invited Ener Sabenorio y Zamora, 25 years old, vendor and a resident of sitio Laca, Brgy
Smo Rosario, Naval, Biliran to the Office but in the course of verification he was positively pinpointed by Walbert
Yabo to be the one of the suspects he actually saw while in a haste coming out from JM poultry and live stock
supply Inc with a red bag marked with JM;
8. That Ener Sabenorio later confided his companiontom us in intruding JM store as Christopher Cañada
y Castro and one Bernard, both a residents of Brgy Sto. Niño, Naval, Biliran and subsequently voluntarily turned
over to us three plastic bags filled with five hundred peso coins each with a total of one thousand five pesos (all
one peso coins) placed in a red bag marked JM;
9. That we later placed Ener sabenorio under warrantless arrest, informed him the nature of his
offense, his Constitutional rights under the New Constitution of the Republic of the Philippines;

I, Walbert L. Yabo, 31 years old, a native of Malaybalay City, Bukidnon and presently residing at
Sitio Tubod, Castin St, Brgy Smo. Rosario, Naval, Biliran, under oath avers:
1. That we are now living together with Geraldine Gumayao, the manager of JM Poultry and
live stock supply Inc, Naval, Branch as husband and wife without the benefit of wedding;
2. That being the live in partner of Geraldine, she usually requested me to check JM store
especially during weather inclement and during holy hours, the time when thieves take advantage and
affect their evil sought;
3. That about 12:00 o’clock past in the evening of October 25, 2012 while conducting
inspection at JM Poultry and live stock supply Inc, Naval Branch when I noticed the destruction of the
roll up at the front portion of the said establishment;
4. That while intensely observing the area, my attention was caught when I actually saw in
plain view three male persons hastily coming out from JM store and I just ignore them out of fear;
5. That I positively identify one of the suspects as a vendor, a resident of sitio Laca, Brgy Smo.
Rosario, Naval, Biliran, his face, height and bodily pose was familiar to me through the clear illumination
of my flash light;
6. That when I was invited by the Police Officers of Naval Police Station around 9:00 o’clock in
the morning of October 25, 2012, I noticed one of the suspects and I really positively pin pointed him to
be the of the suspects I actually saw while in a haste coming out from JM poultry and live stock supply
Inc with a red bag marked with JM during my inspection;
7. That I later identified him as Ener Sabenorio, a resident of Sitio Laca, Brgy Smo. Rosario,
Naval, Biliran who later on confided also his companions to the Police Officers in intruding JM store as
Christopher Cañada y Castro and one Bernard, both a residents of Brgy Sto. Niño, Naval, Biliran and
subsequently voluntarily turned over to them three plastic bags filled with five hundred peso coins each
with a total of one thousand five pesos (all one peso coins) placed in a red bag marked JM;
8. That all other details will be explained by me in a proper forum as maybe required;

I, Geraldine U. Gumayao, 26 years old, a native of Malaybalay City, Bukidnon and presently
residing at Sitio Tubod, Castin St, Brgy Smo. Rosario, Naval, Biliran, under oath avers:
1. That In behalf of my designation as the current Manager and at the same time cashier of JM
Poultry and live stock supply Inc, Naval Branch I am now representing as the Complainant of the
suspects in intruding and carting away the sales/proceeds of the store;
2. That in the evening of October 24, 2012, I requested my live in partner Walbert Yabo to
inspect JM poultry and live stock supply since I am out of fear that thieves will take advantage the
weather inclement;
3. That I was surprised when he returned and told me that the store was ransacked and he
actually saw three suspects while coming out from the said store and he could positively identify one of
them whenever he saw it again;
4. That in the morning of the following day, I truly noticed that the roll up at the front portion
of JM establishment was forcibly open prompting me to direct my technician to inform the Naval Police
Station, Naval, Biliran likewise the owner of JM store;
5. That during my inventory and verification, I found out that nine cellophane bags all filled
with five and one peso coins with a total of ten thousand pesos were gone;
6. That all other details will be explained by me in a proper forum as maybe required;
