PARTICULAR INSTRUCTIONS TO THE BIDDER – KPCHPC TENDERS FOR


SUBMISSION IN THE TENDER BOX

LABORATORY ANALYSIS FOR SOIL REMEDIATION AREAS- SEED

This document shall be read in conjunction with all other parts of the Tender Documents.
This document takes precedence over the General Instructions to the Bidder.

1. INTRODUCTION

Kuwait Petroleum Corporation – High Procurement Committee “KPC-HPC” invites


bidders to participate in KOC tender for Laboratory Analysis for Soil Remediation.

The tender documents can be accessed on KOC e-Business Portal by clicking on the
following link https://ebusiness.kockw.com > RFP – 2054844.

Note:

 Bidder can access the tender documents only if the Bidder is already registered as KOC
Business Partner with approved e-Business Account.
 If the Bidder is not registered as KOC Business Partner and does not have e-Business
Account, Bidder may apply on-line for e-Business Account.
 Tender information such as Bid Bond Value, Pre-Bid Meeting Date and Bid Closing Date
are published on the portal. Bidder must comply with the published information.

The bidder is requested NOT to apply online.

4. REQUIRED EMAIL

Invited bidders must send an email to [email protected] and


[email protected] copied to [email protected] Team Leader Contracts V
referring to the invitation and bearing the RFP number and Title. The Company will use
the transmitted email address and/or e-business announcement to notify the bidder of all
the information related to the tender.
5. VISIT PORTAL (e-Business)

Bidders are strongly advised to check from time to time the e-Business portal for
any new notices or revisions related to the tender.

6. FORM OF TENDER AND ATTACHMENTS TO THE FORM OF TENDER

6.1 The bidder shall quote on the Form of Tender the Contract Price in the form of a Not-to-
Exceed Value, and shall detail this price on Attachment No. 1 to the Form of Tender.

6.2 In Attachment No. 2 to the Form of Tender, the bidder shall submit the preliminary HSE
Plan.

6.3 In Attachment No. 3 to the Form of Tender, the bidder shall provide the analysis methods
he will be adopting on the Services as prescribed in the Technical Specifications Part II –
Specification.

6.4 In attachment No. 4 to the Form of Tender, the bidder shall submit the List of Products
from National Industries/Local Suppliers and List of Local Contractors:
Bidder shall confirm in its bid that it is in compliance with the provisions of Public
Tender Law No. 49/2016 and shall provide the following:

C: List of Services which bidder proposes to Subcontract to Local Contractors as per


Clause 5.7 of General Conditions of Contract.

6.5 In Attachment No. 5 to the Form of Tender, the bidder shall submit the certificates of
ownership of its firm as required. This is required from local bidders or agents of foreign
bidders (if applicable) but not of the foreign bidders themselves.

6.6 In Attachment No. 6 to the Form of Tender, the bidder shall submit the required
declaration of commissions.

6.7 In Attachment No. 7 to the Form of Tender, the bidder shall submit the required
certificate related to the employment of Kuwaitis in its organization. This is applicable to
Kuwaiti bidders only and to Kuwaiti agents of foreign bidders (if applicable) but not to
the foreign bidders themselves.

6.8 In Attachment No. 8 to the Form of Tender, the bidder shall submit its bank details as
required.

7. TENDER DOCUMENTS AND BID SUBMITTAL

Bidders shall download the tender documents from the e-Business portal and shall fill
theForm of Tender and its Attachments and submit the Form of Tender and its
attachments only at the Contracts Teams Building in a special envelope.

Bids shall be accepted in a special envelope issued by KOC for Bid submission. The
special envelope shall be available at the reception of KOC, B1 Building, Ahmadi.

It is the responsibility of the Bidder to collect the special envelope and submit the bid in
the same.
8. QUESTIONS

The bidder shall direct questions (if any) regarding the tender by email to
[email protected] and [email protected] copied to
[email protected] using the form contained in Appendix 2 of Particular
Instructions to the Bidder (Bidder’s Query Form). The ‘Tender Data’ tab on the e-
Business portal shows the question closing date.

9. PRE-BID MEETING

With reference to paragraph 9 of the General Instructions to the Bidder, the pre-bid
meeting shall take place at the Marrat Conference Room # 101167, Building B-1
ground floor, New Office Complex, Ahmadi, at 0900 hours on the date specified in the
“Tender Data” on the e-Business portal.

Bidder who purchased the tender documents or his representative is permitted to attend
the pre-bid meeting. The attendee must bring the proof of purchase of tender documents
for attending the pre-bid meeting.
10. SITE VISIT

With reference to paragraph 12 of the General Instructions to the Bidder, there shall be no
Site visit.

11. The ‘Tender data’ tab on the e-Business portal shows the bid closing date. However,
Bidder may submit Bid on bid closing date or one day prior to it in between 08.00 to
13.00 hours.

12. BID BOND


With reference to paragraph 20 of the General Instructions, the bidder shall submit a Bid
Bond of Kuwaiti Dinars Fifteen Thousand (KWD 15,000/-) valid for ninety (90) days
from the bid closing date worded generally in accordance with the specimen wording
contained in Appendix 1 (Specimen of Bid Bond) hereto. The Bid Bond shall be in
favour of Kuwait Oil Company in the form of an unconditional bank guarantee issued by
a bank licensed to carry out banking business in Kuwait.

The bid shall not be considered in the event of failure to submit a Bid Bond. The
Company may request the bidder to extend the validity of the Bid Bond at no extra cost
to the Company. The Bid Bond of the unsuccessful bidder shall be returned after the
Company has entered into a contract with the successful bidder.

13. PERFORMANCE BOND

With reference to paragraph 21 of the General Instructions to the Bidder, the Performance
Bond (refer specimen provided in Appendix 3) required to be submitted by the successful
bidder shall be in the value of ten percent (10%) of the Not-to-Exceed Value.

14. The provisions of Law No. 49/2016 governing Public Tenders and Executive Regulations
30/2017 and any amendments thereto shall form an integral part of the Tender Document
and shall be construed as supplementary to all terms and conditions contained therein as
appropriate.

15. The successful bidder shall provide the Performance Bond within 10 days of being
informed. In case of non-submission of Performance Bond, the bidder may be deemed to
have withdrawn their bid and the Company may call and draw down upon the full
amount of the Bid Bond.

16. In case, the successful bidder does not sign a contract with the Company within thirty
(30) days after submission of Performance Bond, the bidder may be deemed to have
withdrawn their bid and the Company may call and draw down upon the full amount of
the Performance Bond.

17. TENDER FEE

17.1 The Bidder must pay a non-refundable fee as follows:

Important: Kuwait Oil Company will NOT accept a bank draft for Tender Fee.

17.2 The bidder must pay any bank charges required by the transmitting bank and by the
receiving bank so that KOC account will be credited with the FULL tender fee.

17.3 The bidder shall submit, with the Bid Bond referred to in paragraph 12 above, the receipt
referred to in paragraph 17.1 marked with the RFP number & title and the name of the
bidder.

Foreign Bidders may choose to courier their bids to above address. Bidders shall ensure
that their bids are delivered/dropped in the Tender Box before bid closing date and time,
Company shall not be responsible for any late delivery, non-delivery and damaged
envelops of the Bid.
