 REORGANIZATION OF THE BARANGAY COUNCIL FOR THE PROTECTION OF CHILDREN
(BCPC)

WHEREAS, Article 86-87 of PD 603, otherwise known as the child and Youth Welfare
code and DILG mc 94-14 dated January 24, 1994 mandates the organization of the Barangay
Council for the Protection of Children;

WHEREAS, its objective is to formulate plans and implement programs, development

and services for the children and youth;

WHERAS, the Council is to formulate plans and implement programs, development and
participation and serve as an institution in the implementation and monitoring of projects;

NOW THEREFORE, I ROMAN F. TAGACAY II Punong Barangay of Barangay DEL PILAR

Of ZARAGOZA, NUEVA ECIJA, by virtue of the powers vested in me by law, do hereby order;

Section 1. Reorganization and Composition of the Barangay Council for the Protection
of Children. Pursuant to PD 603 and DILG MC 94-14, there is hereby reorganized a “Barangay
Council for the Protection of Children” to be composed of the following:

Section 2. Duties and Functions of the Barangay Council for the Protection of Children,
the BCPC shall have the following duties and responsibilities:

1. Foster education of every child in the barangay;

2. Encourage the proper performance of the duties of parents and provide learning
opportunities in the adequate rearing of children and on positive parent child relationship;

3. Protect and assist abandoned, maltreated and abuse children and monitor cases filed
against child abuses and report the same;

4. Protect working children from abuse and exploitation;

5. Take steps to prevent juvenile delinquency and assist parents and children with
behavior problems so that they can get expert advices;

6. Adopt measures for the health and nutrition status of children;

7. Promote the opening and maintenance of playgrounds and day care centers and
other services that are necessary for child and youth welfare;

8. Coordinate the activities of organization devoted for the welfare of children and
secure their cooperation;

9. Promote wholesome entertainment in the community especially in movie houses;

10. Assist parents whenever necessary in securing expert guidance counseling from the
proper government or private welfare agencies;

11. Advocate for the passage of barangay and municipal ordinance in response to child-
related issues and concerns;

 12. Prepare the barangay plan of actions for children which addresses the needs of the
children in the community and ensure its integration into the Barangay Development Plan and
implementation by the municipality; and

13. Submit quarterly Barangay Accomplishment Report on the implementation of the

plan to the MCPC.

Section 3. Meeting . The BCPC shall meet at least once in every two (2) months or as
often as may be necessary.

Section 3. This Order shall take effect immediately.

WHEREAS, the Barangay of Del Pilar, Zaragoza, Nueva Ecija is advocacy in “Clean and Green
Campaign” must be fully implemented and enforced;

WHEREAS, the efforts of the LGU alone is nor sufficient enough in providing and maintaining
clean streets and sidewalks in the barangay without the help of the residents and dwellers;

WHEREAS, the dwellers and residents cooperation is needed to discourage and stop the
dumping of garbage outside their residences and establishments premises;

WHEREAS, the cleanliness of a barangay not only should encourage and attrack local or foreign
businesses and investors but promote healthy sanitation within the barangay;

WHEREAS, in compliance with the Local Govewrnment Code Section 447a; 4ii) Require that
buildings and the premises therof and any land within the Barangay and Municipality be kept
and maintained in a sanitarycondition; impose penalties for any violation thereof, or upon
failure to comply with said requirement, have the work done and require the owner,
administrator or tenant concerned to pay the expenses of the same, or require the filling up of
any land or premises to a grade necessary for proper sanitation,

NOW, THEREFORE, on motion of Sangguniang Barangay Member MYLENE S. MALLARE. and

Sangguniang Kabataan Chairperson LEAH MARRI L. FERRER, duly seconded by Sangguniang
Barangay Members NIKKO V. PADUNAN and WALFREDO G. ARANCES, be it –

RESOLVED, as it is hereby resolved, to enact this ordinance.

ORDINANCE NO. 03
SERIES OF 2018

AN ORDINANCE REQUIRING ALL RESIDENTIAL AND COMMERCIAL ESTABLISHMENTS WITHIN

THE BARANGAY OF DEL PILAR, ZARAGOZA, NUEVA ECIJA TO CLEAN THE SIDEWALKS FRONTING
THEIR HOMES AND/OR ESTABLISHMENTS OTHERWISE KNOWN AS “TAPAT KO, LINIS KO
ORDINANCE” OF BARANGAY DEL PILAR, ZARAGOZA, NUEVA ECIJA.

Be it ordained by this Sangguniang Barangay of Del Pilar, Zaragoza, Nueva Ecija that :

Section 1. It shall be the responsibility of the owner and/or dweller, lessee, occupant of a
residential or commercial establishmentto maintain the cleanliness of the sidewalk and streets
fronting their residence or establishment;

Section 2. It shall be the duty of the above-mentioned persons to dispose of their garbage and
litters in a sanitary manner and kept inside the residence premises or establishment premises
until the garbage collector collects them.

Section 3 All persons violating this Ordinance shall be penalized as follows:

Warning
Second and subsequent Offense
Fine of Php 500.00

Section 4. The Barangay of Del Pilar, Zaragoza, Nueva Ecija shall strictly implement this
Ordinance and provide for other Implementing Rules and Regulation it deems necessary for the
full implementation of this Ordinance.

Section 5. This Ordinance shall take effect sixty (60) days after posting at conspicuous places
and disseminating of information in various areas, puroks and communities within the
barangay.

on November 15, 2018.

(c) No minor is allowed to buyor smoke any cigarette or tobacco product or to buy or drink any
liquor or intoxicating drink, However, if the minor buys any of these product only on errand, the
person who sent him on errand is the one liable as provided for in the next paragraph hereof.
Also , no minor shallsell any kind of cigarette or tobacco product or liquor or intoxicating drink.
However, if the sale by minor of any such product is in line of his job assigned to him by his
employer, it is thelatter who is liable under paragraph (f)of this section;

(d) No person shall command/request a minor on errand to buy any cigarette or any other
tobacco product or liquor or intoxicating drink;

(e) No owner/operator of department stores, sari-sari stores shall assign their minor
employees to deliver to customers any kind of cigarette or tobacco product or liquor or
intoxicating drink;

(f) all owners/operator of department stores, or sari-sari stores that sell any kind of cigarette or
tobacco product or liquor or intoxicating drink shall post on a conspicuous place of their
establishment/stores a notice to the effect that tobacco cigarettes or any tobacco product or
liquor or intoxicating drinks are not for sale to minors and indicating in that notice the number
of this ordinance;

Section 3. Penalty Clause. – Any person who violates any of the provisions of this Ordinance
shall,upon conviction by final judgement , be punished one (1) year imprisonment or a fine of
not less than one thousand pesos ( P 1,000.00), but not more than five thousand pesos
(P5,000.00) at the discretion of the court; Provided that the minor under nine (9) years of age is
exempt from this penalty.Instead, he should be brought to the Department of Social Welfare
and Development for proper counseling for one (1) hour.

Section 4. Repealing Clause. – All ordinances, resolutions, orders, memoranda and other
issuances not consistent with this ordinance are hereby repealed.

Section 5. – Separability Clause. – If for certainreasons some provisions of this ordinance are
found to be invalid or unconstitutional, all other provisions thereof not affected threby shall
remain to be in full force and effect.

Section 6. Effectivity Clause. – This Ordinance shall take effect after fifteen (15) days following
the completion of its full publication in general circulation within the Barangay of Del Pilar,
Zaragoza, Nueva Ecija.

held on October 31, 2018.

Section 2. Definition of terms.

CURFEW – a fixed time during which no citizen may remain outdoors, particularly in
Public places.

MINOR – a person not having reached the full legal age of 18 years

Section 3. Statutory Provisions:

1. The hours of 10:00 o’clock in the evening to 4:00 o’clock in the morning the
Following day is hereby declared as “CURFEW HOURS” for any person below 18 years
Of age

2. During curfew hours, no minor shall be allowed outside his residence except:

a) When accompanied by either parent, or any other member of the family of legal
age;

b) When running lawful errands during emergencies such as buying medicines for
the sick or using telecommunications facilities for emergency purposes and the
like ;

 c) During the celebration of New Year( January 1 – 6 ); Barangay Fiesta and
Municipal Town Fiesta; Holy Week; All Saints & All Souls Day (November l-2)
Christmas ( December 16-31) and all other occasions including local , special and
National holidays like attending birthdays, weddings, debut, and school activities
Attending J.S. Prom, Graduation Day, Foundation Day, and Coronation Night,
Provided, that they are covered by a pass issued by the Barangay Officials where
they come from subject, however, to provision of of Section 6 hereof.

d) When enrolled at night schools or attending school activities provided ,they can
show proof of their status or show a duly signed pass issued by school authorities
3. Minors failling under category c and d of sub-section 2 shall secure a Certification
From the Punong Barangay exempting them from the coverage of this ordinance,
or present document or identification providing his qualification.

4. a) The Punong Barangay , members of the Barangay Council and duly appointed
Barangay Tanods, the Philippine National Police (PNP) and duly constitute
Authorities are hereby authorized to apprehend and bring violators to the
Barangay Hall or Holding Centers until 4:00 AM, the expiration time of curfew
Hours where a record of any apprehension is made or accomplished.

b) For a violator who is a resident of same barangay, the Punong Barangay , without
necessary delay, shall inform either the parents, relatives or guardian

6. An Offender, who si a vagrant, abandoned, neglected or has no known parent, relative

Or guardian residing in the municipality, shall be referred without unnecessary
Delay within six (6) hours or at the earliest office hours from the time of
Apprehension, whichever comes first, to the custody or care of the Municipal
Social Welfare Office.

Section 4 PENALTY CLAUSE.

1. Any person below 18 years of age who violates this ordinance shallbe penalized as

a. If an offender is twelve (12) years of age and below,the sanction shall consist
of :

1. FIRST OFFENSE – the parents, together with the offender, shall report

2. SECOND OFFENSE – a reprimand of the offender in the presence of

Parent or guardian.

b. If offender is 12 years above but below 18 years of age, the sanction or penalty
shall be :

 1. FIRST OFFENSE – Reprimand and to render four (4) hours of
Community service

2. SECOND OFFENSE – to render twelve (12) hours of community

Service.

3 THIRD AND SUBSEQUENT OFFENSES – to render twenty four (24)

Hours of cumulative community service.

Section 5. The Secretary fo the Barangay, shall keep and maintain a record of all cases brought
to them, including such information as to the name, address, date of birth, time and place of
apprehension , name of parents or guardians and furnish a copy of the apprehension Report
within 24-hours the Municipal Mayor,PNP AND DSWD.

Section 6. The Local Chief Executive , through administrative issuances may suspend the
implementation of this ordinance in any particular barangay , or other specific areas, for a length
of time as may be necessary.

Sesction 7. The Barangay Council and the PNP shall be the lead implementing and monitoring
agencies.

Section 8. REPEALING CLAUSE – Any municipal or Barangay Ordinance Inconsistent with

the spirit of this ordinance are hereby repealed or amended, as the case may be.

Section 9 EFFECTIVITY CLAUSE- This ordinance shall take effect 10 days from the day a
copy posted on the Bulletin Board at the entrance of the Barangay Hall and at least 2 copies
posted in 2 conspicious places in the Barangay are done.

RESOLVE FURTHER, that copies of this Resolution be forwarded to the Honorable Mayor
LOVELLA DG. BELMONTE ESPIRITU, and the Sangguniang Bayan thru HON. EFREN O.
NIEVES Vice-Mayor and Presiding Officer Municipality of Zaragoza, Nueva Ecija for their
information and appropriate action.

committee on Peace and Order tungkol sa ginagawa nilang pagmomonitor sa illegal na droga.At
sumagot naman ang hepe ng Barangay Tanodna si G. Esteban S. Belza, at sinabi niya na sa
kanilang pag-iikot sa mga Purok na nasasakupang ng Barangay ay mayroon pa ding mangilan
ngilang na gumagamit sa nasabing Drugs.

At ito nga ngayon ang kanilang pinagbubuti at sinusubaybayan. At sinabi din ni kagawad
Cresendo P. Benico, committee on Peace and Order na hindi pa din masugpo sugpo ang mga
gumagamit ng illegal na gamot. Dahil may mga pinanggagalingan pa din sa ibang lugar at
patagong ibinebenta sa mga users na ayaw pang tumigil sa paggamit nito. Kaya sinabi ng Punong
Barangay na pagbutihin nila ang pagbabantay upang masugpo ang mga gumagamit at
nagbeghenta nito.

Dahil wala ng iba pang pag-uusapan ay tinapos na ang pagpupulong, natapos ang pulong
ganap na ika-12 ng tanghali
