The accused admitted committing the crimes “as a necessary means”, “in
connection and in furtherance of the rebellion”. The prosecution failed to
charge that the Appellant was impelled by private motives for the acts
committed. Wherefore, such overt acts must be taken as essential
ingredients of the single crime of rebellion, and the accused pleaded guilty
to this crime alone. Hence, there being no complex crime, the Appellant
can only be sentenced for the lone crime of rebellion.
