Sir,
LEGAL NOTICE
My client Mr. Kiran, S/o. Mallesha, aged about 26 years, R/at # 56/1, 8th Cross Road, Shivapura,
Bangalore-58, has requested me to issue this notice to you with following instructions.
My client states that you both had entered into an agreement of lease/rental agreement dated
23/1/2017 under which you had accepted my client as your tenant on payment of monthly rents in
respect of the immovable residential property bearing # 142, 7th Cross Road, Gangondanahalli Main
Road, Doddabidarakallu, Nagasandra Post, Indiranagar, Bangalore – 73. The refundable security deposit
amount had been fixed at Rs.1.50 Lakhs and the same has been paid by my client during the
commencement of tenancy. You have acknowledged the refundable security deposit of Rs.1.50 Lakhs in
presence of below mentioned witnesses.
In this regard, my client states that he expressed his wish to vacate and handover physical possession of
the above said property in which he was a tenant and he requested you to arrange for refund of security
deposit amount. My client states that he expressed his urgency and need of vacating and handing over
physical vacant possession. Whereas, you expressed your inability to mobilize refundable security
deposit amount in time due to which reason my client was forced to vacate the house by causing delay
of further 3 months. In this regard, it is pertinent to note that my client could not able to withstand
anymore without vacating the premises due to his dire need.
Hence, you requested my client to vacate and handover physical vacant possession of the said property
by assuring that you would refund the security deposit amount within a month from the date of vacating
the premises. My client believed your version in good faith and accordingly he vacated and handed over
the said property to your possession and custody. My client has also handed over the key of the
premises with expectation of getting back of security deposit amount within a month.
But, my client very much regrets to state that he has not got the amount till today. Now, he is in need of
money for some legal necessities which cannot be prolonged. Your attention is hereby drawn to
understand that you had assured to repay the refundable security deposit amount within a month from
the date of vacating the premises and you have so assured in presence of witnesses before whom the
key has handed over to you.
Therefore, you are hereby instructed to refund the security deposit amount within a week from the date
of this notice failing which you will be liable to pay the same with interest @ 18% per annum and you
will be liable to face the legal consequences.
