ENVIRONMENTAL HEALTH AND SAFETY (EHS) REQUIREMENTS:

1. CONTRACTOR shall perform its services to OSPI CARMONA in compliance with all applicable laws, rules,
and regulations, including, but not limited to, Philippine laws such as Labor Code of the Philippines,
Occupational Safety and Health Standards.

2. CONTRACTOR shall ensure that its employees, agents, and invitees while at OSPI CARMONA premises,
comply with all applicable laws, rules and regulations.

3. CONTRACTOR shall comply with ON Semiconductor’s Environmental, Occupational Health and Safety
requirements and Safety Culture initiatives, Code of Business Conduct and OSPI CARMONA ’s Corporate
Social Responsibility (CSR) requirements and Responsible Business Alliance (RBA, formerly EICC),

4. CONTRACTOR shall take full responsibility for the safety of its employees, invitees or any person who enter
OSPI CARMONA premise for any purpose related to the fulfillment of its obligations.

5. CONTRACTOR shall take all reasonable measures and shall comply with OSPI CARMONA’s work and special
EHS permits as needed to prevent injury of any person or damage to any property within OSPI CARMONA or
in the vicinity thereof.

6. OSPI CARMONA shall be free from liability and CONTRACTOR shall indemnify OSPI CARMONA and hold
OSPI CARMONA, its affiliates and agents free and harmless from any suit or claim arising from
CONTRACTOR breach of performance with its obligations and warranties. OSPI CARMONA shall not be
responsible for any accident, injury or death that may be sustained by CONTRACTOR employees, invitees or
any personnel in connection with their services during their tour of duties, it being understood that they are
employees, invitees of CONTRACTOR and that all benefits that may be claimed by them or their heirs in
connection with their employment shall be borne by CONTRACTOR

7. CONTRACTOR shall allow OSPI CARMONA to conduct inspections and/or audits as part of the latter’s CSR
and/or EHS requirements.

8. Without prejudice to any other remedies either Party may have under this requirement or at law, OSPI
CARMONA shall have the right to immediately terminate any Order or Agreement by written notice to the
Contractor if the Contractor fails to observe and/or to perform any of its obligations under the Purchase
Order or Agreement (including but not limited to failure to comply with the aforesaid clauses, the safety
standards, Code of Business Conduct and all OSPI CARMONA policies), and where such failure is
requested by OSPI CARMONA to be rectified, does not rectify the failure within seven (7) days of written
notice from OSPI CARMONA .

9. Contractor shall provide its employees with safety training on hazards and risks, and job related work
instructions.

10. Contractor shall before the start of construction/demolition/project provide the following as part of
permitting requirement subject to review and approval by OSPI project in-charge and EHS:
- Job hazard analysis
- Job related work instructions including required PPE
- Safety certificates of equipment used for work if applicable
- Proof of contractor employee competency to carry out high risk work

11. Contractor shall provide all required personal protective equipment (PPE) for the job (e.g. safety shoes,
hard hat (with strap for working at heights), gloves, apron, face shield, safety glass/goggle, full body
harness with double lanyard, etc.)

12. Contractor engaged in above ceiling/interstitial activities shall provide platform ladder fiber glass type as
working platform and a-type fiber glass ladder for access only.

13. Contractor engaged in rigging and/or lifting works using lifting equipment (forklifts, cranes, pallet trucks,
etc.) shall provide valid load test certificate of the equipment to be used in the plant and valid certification
of the operator who will perform the lifting task for the day along with the inspection checklist performed
by the said operator prior start of activity.
14. Contractor engaged in hot work activities shall provide valid hydrotest certificate of the tanks (oxygen,
acetylene, argon, fire extinguisher, etc.) to be used. Contractor shall ensure all oxy-acetylene torch units to
be used are provided with flashback arrestor.

15. Contractor shall comply with OSPI CARMONA’s high risk work requirements. High risk work are as follows:
 Work at heights above 6 feet (1.8 meters) excluding routine work using ladders
 Welding or other work with an open flame
 Work in an explosive environment
 Building structural modifications
 Electrical work (no live work is allowed at ON Semiconductor)
 Non-routine (e.g., awkward loads, high-angle lifts, crane work, etc.) work with engine-driven mobile
equipment (forklifts, construction machines...)
 Work where a risk of frostbites or burns is present (low or high temperature)
 Non-routine (e.g., demolition) work with hazardous chemicals (new chemicals must be approved by
EHS personnel prior to bringing them onsite)
 Work performed close to public roads/highways
 Work on gas or liquid containers or distribution lines that are pressurized or contain hazardous
material
 Work when there is a risk of damaging gas or liquid containers or distribution lines
 Work in confined spaces that contain any hazards
 Excavation / Trenching work (deeper than 4 feet (1.2 meters)
 Other tasks where the subject matter expert or project manager believes there is an unusual risk.
16. Contractor shall provide a qualified safety supervisor for every high risk supervised work area at OSPI
CARMONA premises. Duties of the Safety Supervisor are as follows:
 Safety supervisor oversees conformance to all rules as defined in the job description or scope of work
and equipment safety compliance. The Safety supervisor stops the work in the case of deviations.
 Safety supervisor is present at construction supervised work areas in question continuously while high
risk job tasks are performed in line of sight.
 If safety supervisor leaves the supervised work area he or she must stop all high risk jobs and remove
employees from construction work areas.
 If safety supervisor must leave the supervised area for a short period of time he or she must assign
his/her role to an adequately instructed and competent substitute. The substitute acts as a safety
supervisor until the person in charge returns. While acting as a safety supervisor, the substitute must
cease all other activities.
17. Any deviation to safety rules may result in termination of a violator and/or cancelation of the contractor’s
contract.
 Serious breach of safety rules by individual and/or groups may result in termination.
 Performing high risk work deviating from job hazard analysis, work instructions and in absence of
safety supervisor may result in termination of violators.
 Safety supervisor not fulfilling his/her safety duties will be terminated.
 Minor safety violations will result in a final written warning, repeated offence will result in termination.
 Terminated contractor employees will not be allowed back onsite to work.
 Contract may be cancelled when a serious or repeated breach of safety rules occurs.
 Serious breach of safety rules includes.
o Performing work without job hazard analysis.
o Performing high risk work without job work instructions or deviating from work instructions.
o Performing high risk work in absence of a safety supervisor.
