Requirements and recommendations for the skipper (Master, authorised agent, or ship's officer)
1. The skipper shall submit the Ship’s Stores Declaration after each entry into the German territorial waters, or if coming from a free zone, after arrival
at the first German port.
2. The goods may only be used on board. However, persons arriving on the ship and going on shore leave, or leaving the ship temporarily fora
maximum of three days, may use up to 5 cigars or 20 cigarettes or 50 grams of smoking tobacco ashore (Section 14, German Customs
Ordinance). In all other cases the ship’s stores may only be taken off board against payment of the import duties. The same shall apply where
these goods are used on board for purposes other than those originally approved. In these cases you are obliged to submit the Ship’s Stores
Declaration to the competent customs office.
3. As soon as the ship has stayed in one port for a total of four weeks (but not later than two months after arriving at the first German port) the ship’s
stores may no longer be used duty-free, even if the ship has temporarily left the German part of the Community customs territory without going
beyond the coastal area. The skipper shall then declare the ship’s stores to the customs office responsible for the ship’s berth so that import duties
may be levied where appropriate.
4. Any changes of the estimated time of departure shall be notified immediately to the customs office of exit.
5. Where the customs office of exit refrains from examining the ship’s stores, the skipper shall be entitled to remove the seals affixed for securing the
stores, as soon as the ship has left the port directly seawards at the time declared or at a later time; if the ship departs to a free zone, or departs
seawards via several container ports, the seals affixed may only be removed after entering the free zone or after leaving the last container port.
6. The skipper shall keep the Ship’s Stores Declaration on board and available for customs controls until the ship is leaving the German territorial
waters.
7. If a ship engaged in maritime traffic continues its journey via waterways that are not subject to customs supervisison (Zollstraßen), the exemption
from import duty shall be limited to use within eight days after the first customs treatment. In these cases it is required to also keep a listing of
consumables (Form 1171).
