RESEARCH PROBLEM
Under the Ordinance, penalties for certain offences are inconsistent. For instance,
minimum punishment for gang assault by private persons is 20 years, and for gang
assault by a police officer is 10 years.
Age of consent has been increased from 16-18 years. There is a divergent view among
various commissions on the age of consent.
Marital sexual assault over a woman is not an offence. This is at variance with the
recommendation at certain commissions.
HYPOTHESIS
The horrific gang-rape and the subsequent murder of Nirbyaya (fearless) in December
2012, impelled the Government of India to pass the Criminal Law (Amendment) Act
2013.

METHODOLOGY
I have used doctrinal method in my project as I had used book, journals, articles for the
content of my project and I found this method to be very useful for my research. This
method talks about the work which is done with the help of book knowledge and with the
reference of many online sites.
The advantage of this method is to verify the hypothesis by a firsthand study of
authoritative source. This method is to use in present study because this method contains
a lot of information which helps the researcher in gaining knowledge.
