Defendant, through counsel, submits the following Motion to Release

Passport. Defendant was ordered to release his passport as a condition of his
18
release. On January 28, 2010, Mr. Simpson surrendered his passport pursuant to
19
the Order of Magistrate Judge Anderson. Mr. Simpson was released from the terms
20
21 of pretrial release and sentenced to a term of probation on August 29, 2011.
22 Because Mr. Simpson is no longer subject to a term of pretrial release and can no
23 longer be deemed a serious flight risk, he asks that this Court release his passport
24 to him.
25 The Assistant U.S. Attorney assigned to this case, Michael Morrissey,
26 has been contacted with regard to this motion and he has no objection to the Motion.
