What is Legal Profession

- Is a branch of the administration of justice whose main purpose is to aid in the doing of justice
according to law between State and the individual and betweem man and man.

Purpose of Legal Profession

- Law profession is a mission to administer justice not only to those who have the capacity to
obtain the services of a lawyer but more importantly, to those deserving of justice but have less
in life.

What is an attorney

- a person set apart by the laws of the land relation to the high interest of property, liberty and
life or an advocate who aids in the administration of justice

Privilege not a right. Legal profession is not a moneymaking trade. Compensation is merely
incidental.

Basic Skills and Qualities required in law study

Start wit proper Attituted: Dreams/Ambition, know what you want; Perseverance, determination
and adjust schedule; Patience, be prepared in school

Language - tool of the law. Instrument by which you understand, analyze and express the law.
Logic - Critical analysis of thinking
Law - read and master

Membership in the bar is

- a privilege burdened with conditions and carries with it the responsibility to live up to its
exacting standards and honored traditions

Why is Legal Profession a noble profession

- Legal Profession hasd been regarded as one of the noblest profession because this impressed
with public interest with the end view towards the administration of justice and is very popular
career since it offers wide range of opportunities in public service, private practice and business.
Lawyers are being looked up to by the community with high esteem since they are regarded as
leaders of our community or someone you can ask for help or support.

What is Practice of Law

- Practice of Law as define in the case of Cayetano vs. Monsod, the supreme court held that
engaging in law practice is not only confined to courtroom practice. It includes any activity which
requires application of law or knowledge of the law, whatever said activity takes place in or
outside of the courtrooms.
- Practice of law is the rendition of service or any activity in or out of the court, which requires
the application of law, legal procedure, knowledge, training and experience.

Admission to Practice

A. Power to admit applicants to the practice of law is judicial in nature and involves exercise of
judicial discretion

B. Integration of the bar, purpose:


1. Assist in the Administration of Justice
2. Safequard the professional interest of its members
3. Cultivate among its members a spirit of cordiality and brotherhood
4. Encourage and foster Legal Education
5. Enable the Bar to discharge its public responsibility effectively

C. Person entitled to law practice, req. before admission to bar


1. Citizen of the Philippines
2. At least 21 y.o
3. of good moral character
4. Resident of Philippines
5. Must produce before the supreme court satisfactorily evidence of his good moral character
and no charges against him or pending in court.

To become a lawyer:
Prove applicant has the required educational (Study of Law degree), moral and personal
qualification,
Pass the bar examinations
Take the lawyer's oath before the Supreme Court en banc
Sign the role of attorneys & receive a certificate of license to practice from the Clerk of the SC
Must remain member of the IBP, observe ethical standards, pay his membership dues and pay
his professional tax

What is MCLE
- is the Mandatory Continuing Legal Education where lawyers or member of the IBP are to
continously keep abreast with law and jurisprudence by attending the said seminar.
