SALMA … PETITIONER
VERSUS
SULAIMAN … RESPONDENT
SALMA … PETITIONER
VERSUS
SULAIMAN … RESPONDENT
Salma, a shia Muslim married Sulaiman, a sunni Muslim on December 3, 2007 at Nalpur,
Bandesi Pradesh in Republic of Indiana. Salma is cousin sister of Afsha who is Sulaiman’s
cousin sister on the maternal side.
Both Salma and Sulaiman are graduates from a reputed college of Delsi University. Sulaiman is
also a qualified Chartered Accountant. At the time of their marriage, which was an arranged
marriage, Sulaiman was working with one of the leading firms in the State of Bangaloorie in
Republic of Indiana. Salma was working as a manager at a leading retail chain.
In January, 2009, Sulaiman relocated to Delsi with his wife Salma and has set up a registered
partnership enterprise Sulaiman & Salma Associates with his college friend Rohan. Sulaiman
and Salma live in 1 BHK apartment which is owned by his brother Rehan in Greater Palash, but
whose electricity charges, house tax, water bills and maintenance are all paid by Sulaiman.
Rehan is a permanent resident of Canada and is a doctor with NHS Trust. Sulaiman and Salma
had jointly applied for a flat in Delsi Development Authority Vikas Scheme, 2010 and have got a
flat in lottery in Vistar Vihar Extension-Phase 2.
After moving to Delsi in January, 2009, Salma wanted to have a child and stay at home, to which
Sulaiman did not agree. They were having frequent heated arguments about this. Salma had
discussed this with her mother, who had also tried to make Sulaiman understand the issue.
Sulaiman, however, had been unrelenting and considered it too early. Since Afsha had played a
vital role in getting them married, she also visited the couple, at Salma’s mother’s instance, at
their residence in Greater Palash and unsuccessfully attempted to intervene between the two on
September 29, 2015. It appeared that Afsha being an ambitious professional herself was inclined
to support Sulaiman. On November 10, 2016, when again Afsha visited Sulaiman and Salma to
make them understand each other and tried to persuade Salma to understand the Sulaiman’s
perspective which she could not accept and started raising her voice that resulted again into a
heated argument over the same issue. And thereafter, Sulaiman went downstairs for a walk, but
returned after 4 hours and divorced Salma with three pronouncements of ‘TALAQ’. Afsha was a
witness to this development.
Thereafter, Sulaiman moved out of the house from Greater Palash where he used to live with
Salma, and started living in a guest house which was available at nominal rent.
Salma had approached to the Delsi High Court seeking a declaration that divorce pronounced by
Sulaiman not being in confirmity with the Shia Islamic law as well as against the Fundamental
Rights under the Constitution of Indiana, 1950, be declared as a nullity. The Delsi High Court
dismissed her writ petition for declaration. Thus, writ petition is filed by Salma before the
Hon’ble Supreme Court of Indiana and the same is listed for its final disposal.
The polity and social structures of Republic of Indiana are pari materia to the Republic of India
and the Constitution of Indiana, 1950 is pari materia with the Constitution of India, 1950.
