Subject: Eliminate Street Railroad Crossing - NE Miami Court

Purpose of Item:

A Resolution of the Miami City Commission authorizing the City Manager to eliminate
the street railroad crossing at NE Miami Court between NE 71st Street and NE 73rd
Street approximately 200 feet south of 73rd Street, Miami, FL.

Background of Item:

As part of proposed improvements for traffic circulation near the Miami Design District a
new railroad crossing is being proposed at NE 42nd Street connecting NE 2nd Avenue
to East Dixie Highway. Additionally the Florida Department of Transportation (FDOT) in
conjunction with Miami-Dade Department of Public Works are working on roadway,
signalization and railroad crossing improvements at the NE 2nd Avenue/NE 36th
Street/East Dixie Highway intersection. The Florida East Coast Railroad requires that
for every new railroad crossing built, two must be eliminated. One crossing being that at
NE Miami Court and the other crossing will be North and South bound along NE 2nd
Avenue at the NE 36th Street crossing. On April 19, 2018 a public meeting was hosted
by the Office of Capital Improvements at Athalie Range Park from 7:00pm to 8:00pm for
the proposed closure at NE Miami Court. Seven residents attended the meeting and
none voiced concerns in favor or against the roadway closure. Additionally, a study of
the closure was conducted by a third party and determined that the impact of closing NE
Miami Court under existing conditions to adjacent North/South bound roadways would
operate at acceptable levels of service.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY


MANAGER TO ELIMINATE APPROXIMATELY TWO HUNDRED (200) FEET OF
RAILROAD CROSSING AT THE NORTHEAST MIAMI COURT RAILROAD
CROSSING, LOCATED BETWEEN NORTHEAST 71 STREET AND NORTHEAST 73
STREET, AND THE NORTHEAST 36 STREET RAILROAD CROSSING, LOCATED
ALONG NORTHEAST 2 AVENUE, PURSUANT TO FLORIDA EAST COAST
RAILROAD (“FECR”) REQUIREMENTS FOR IMPROVEMENTS, INCLUDING A NEW
RAILROAD CROSSING AT NORTHEAST 42 STREET, CONNECTING NORTHEAST 2
AVENUE TO EAST DIXIE HIGHWAY.

WHEREAS, part of the proposed improvements for traffic circulation near the City of
Miami (“City”) Design District is a newly proposed railroad crossing at Northeast 42 Street,
connecting Northeast 2 Avenue to East Dixie Highway; and

WHEREAS, the Florida Department of Transportation (“FDOT”), in conjunction with the


Miami-Dade County Department of Transportation and Public Works (“County”), is working on
roadway, signalization, and railroad crossing improvements at the Northeast 2nd
Avenue/Northeast 36th Street/East Dixie Highway intersection; and

WHEREAS, the Florida East Coast Railroad (“FECR”) requires that for every new
railroad crossing built, two (2) existing railroad crossings must be eliminated; and

WHEREAS, the City proposes to eliminate two (2) railroad crossings, consisting of
approximately two hundred (200) feet, at the Northeast Miami Court railroad crossing, located
between Northeast 71 Street and Northeast 73 Street, and the Northeast 36 Street railroad
crossing, located along Northeast 2 Avenue; and

WHEREAS, at an April 19, 2018, public meeting, hosted by the City’s Office of Capital
Improvements (“OCI”) at Athalie Range Park regarding the proposed removal of the railroad
crossings, no concerns were raised by the public; and

WHEREAS, a study of the closure was conducted by a third party and determined that
under existing conditions, the impact of the closure at Northeast Miami Court to the adjacent
North/South bound roadways would operate at acceptable levels of service;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF


MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.

Section 2. The City Manager is hereby authorized1 to eliminate approximately two


hundred (200) feet of railroad crossings at the Northeast Miami Court railroad crossing, between
Northeast 71 Street and Northeast 73 Street, and the Northeast 36 Street railroad crossing,

located along Northeast 2 Avenue, pursuant to FECR requirements for improvements, including
a new railroad crossing at Northeast 42 Street, connecting Northeast 2 Avenue to East Dixie
Highway.

Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

APPROVED AS TO FORM AND CORRECTNESS:

2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
