    EXECUTIVE ORDER NO. 2017______


    Series of 2017

    FOR THE IMMEDIATE DECLARATION AS PUBLIC NUISANCE OF THE


    POULTRY OWNED AND/OR OPERATED BY MR. FLORENTINO HIPOLITO
    LOCATED AT #89 AQUINO ST., BARANGAY BISIG,VALENZUELA CITY.

    WHEREAS, on 04 October 2017, the personnel of the City Health Office (CHO), in the
    course of their inspection and based on the complaint, information and documents received,
    discovered that the above-named poultry is liable for the following:

     Violation of Sanitation Code of the Philippines (PD No. 856) as per City Health
    Office (CHO) inspection report dated 04 October 2017;

    “FINDINGS:

     Florentino Hipolito is operating a poultry without business permit


    to operate;
     Upon inspection, presence of foul odor is present;
     Two (2) chickens and ten (10) ducks were seen on sight;
     Absence of septic tank;
     The flooring of said poultry is uneven or unconcrete causing the
    waste water to accumulate;
     Accumulation of manure and other refuse were seen;
     The site of the poultry is a residential area; and
     Open cage without roof.

    COMMENTS:

    The poultry operated by Florentino Hipolito is not suitable to nearby


    houses and residents in Barangay Bisig, Valenzuela City. As stated in
    the findings, presence of foul odor is present which annoys, offends
    and produce discomfort to the neighbhoring houses.

    XXX”;

    WHEREAS, the abatement of the chicken, ducks and other obnoxious materials that
    gave rise to the nuisance at the expense of the said poultry is necessary and appropriate;

    WHEREAS, in view of the foregoing, by virtue of the power vested in me by the Local
    Government Code & other pertinent laws and in my capacity as City Mayor, I, REX Gatchalian,
    do hereby order the IMMEDIATE DECLARATION AS PUBLIC NUISANCE OF THE POULTRY
    OWNED AND/OR OPERATED BY MR. FLORENTINO HIPOLITO LOCATED AT #89
    AQUINO ST., BARANGAY BISIG,VALENZUELA CITY.
    The City Health Office (CHO), Business Permits and Licensing Office (BPLO) and City
    Veterinary Services Office (CVSO) and Philippine National Police (PNP) or any concerned office
    are hereby directed to serve and implement this Executive Order through proper abatement
    actions, immediately upon receipt hereof including the abatement of the chicken, ducks and
    other obnoxious materials that gave rise to the nuisance at the expense of the said poultry and
    to submit report on the action taken therein within five (5) days from implementation of this
    Order.

    SO ORDERED.
